All right, Chair, see the quorum, we'll call the meeting in order. I would remind anybody from the audience, if you'd like to speak for or against any bill that's on the active agenda today, to please indicate as such with the signing sheet to my right. So with that, oh, there he is. With that, we will move forward. I'm going to call over the bills.

Chairman. What I will have is an amendment adding a sponsor, and I believe it's Representative Kerr on that list, and he indicated his wishes to be a part of that bill. and I'll have some more coming. So with your allowance, that's all I'm about today. I still want to keep it in front of the public, but that's what this bill is about today. I'm just adding a sponsorship of Representative Kerr. Okay. It's already been amended. Is that correct? Yes, it has. Okay. Very well. It will remain on the active

calendar. All right. Thank you. Thank you, Mr. Chairman. Thank you, committee. HB 1056, Representative Lindsey, you're recognized. Thank you, Mr. Chairman, members of the committee. A couple of weeks ago, I pulled 1056 to add sponsors. I'm pleased to say that has now been done. And thank you, members of the committee, who have signed on and agreed to co-sponsor. And I'm pleased to report, Mr. Chairman and members of the committee, that seven of the eight members of the Senate Revenue and Tax Committee have also signed on to HB 1056. I hope that's indicative of the support that we'll have not only in the committee but in the Senate and that this bill can move forward in its due process and time to enactment. Mr. Chairman, I'm not ready to move forward. I will answer questions if there are questions from the committee, but I'd like to just basically hold until you're ready at the call of the chair to move this thing forward. Very well. Any questions for Representative Lindsey? Okay, if not, thank you. Your bill will remain on the active calendar. Thank you, Mr. Chairman. Thank you,

members of the committee. Representative Penartz, don't see. Representative Penartz will pass over. Representative Westerman, House Bill 1233, you're going to pass very well. Representative Gene, HB1255, you're recognized to run your bill. Thank you. Thank you,

Mr. Chairman. This is House Bill 1255. It's a bill that came out, and I'd like to introduce my county collector. This is coming from the county collector, Cindy Walker. She's the county collector of Columbia County. This is a bill originated from the County Collectors Association and endorsed by the Arkansas Association of Counties. It has no fiscal impact on our budget. DF&A has told me they won't come up here after we get through and state that. It does have a minimum impact on county budgets, and I've got Ms. Walker here to address that. But what this does is just basically rolls back the date property tax are due from October 10th to October 15th and cleans up some language. There is some language in here like assessment has to be done April 10th, and it rolls it to 31st. Another bill had already addressed that. This was kind of a conflict in the bills, and it's just cleaning up some language. and it gives also off the Columbus Day holiday. Your second Monday had fallen on this a lot and this moves it back so people get to, like me, Sandy, keep their money five more days because I'm pretty bad about coming in the last minute to pay my property tax. But I'll let Ms. Walker address this and if you have any questions for us, we'll be happy to entertain them after she gets completed. Okay.

Ms. Walker, thank you for being here, and you are recognized.

Representative Larry Cowling Chair Unverified 4:40
Thank you. Thank you, Mr. Chair. The Collectors Association would like to see this bill passed because we do have the conflict with the Columbus Day holiday, and we do not take that day as a holiday, but people come in and say, well, the banks were closed or the post office was closed, so we thought you were closed. And then you slap them with a 10% penalty you're not thought highly of. And this way, by extending it until the 15th, you also get that second pay period in. And it will help us with the delinquency then and help our cost on that. And then the other is just a lot of cleanup that we needed to do to the law as far as your installment periods, when that would go into effect and changing the dates on that as well. And then with the improvement districts, you know, saying that they're not delinquent until after October the 15th. But this way, it would fall in with your April 15th deadline for state income tax. you wouldn't believe how many people we have call and say well I thought it was the 15th well you know there again you're not thought highly of and so we would just like to see this and we would get away from the Columbus Day and help our constituents thank you any questions Representative Cowling you're recognized thank you Mr. Chair what What delinquent rate, how has it been over the last two or three years? Is it progressing, or how is it running? It's been basically about the same in Columbia County. I know other counties have seen a huge increase in delinquencies, but we're staying about the same. This year it was kind of hard to tell because we had so many producing minerals that we had to mark as delinquent that we used to could write off. Then you have a mineral tax then? Yes, sir. We do on producing

minerals. Thank you. Representative Collins, you recognize. Thank you, Mr. Chair. The federal extension, standard extension, is October 15th. I think you mentioned that. And so however that day would adjust for Sundays and holidays, it may fall on the 15th. You would just follow

that as well. Is that correct? MS. Yes, sir. MR. Thank you very much. Representative Gene, just a couple of questions, and I don't know if Mr. Sykes is here. If it's more appropriate for him to answer, he certainly can come up to the table. was the on page 3 what was the thought process on removing that prerequisite

requirement on line 28 through 32. I understand the date's been changed, but...

Mr. Sykes, you're recognized. I think that has to do with the Department of Finance and administration, making this work with them.

I don't know if they've got a copy of

the bill over there or not. Okay, well, I guess while we're waiting there, and
▶ Play Suggest a correction Report an error
Speaker 33 8:45
on page four, it looks like we're also moving the assessment date from April 10 to May 31st, which... That's already

done in a prior bill. This is just cleaning up the language. Okay. Yeah, that's just
▶ Play Suggest a correction Report an error
Speaker 35 8:56
to make it consistent with the rest of the law. And, Mr. Chair, virtually every one of these, once you start digging into them, are cleaned up. And a whole lot of it is just cleaning up the language as much as anything.

You know, once the Bureau gets it, they are, you know, they go through and change pronouns and different things of that nature. So a lot of this is accomplishing that.

I just want to make sure on that, back on that page three, that we're going to

continue to, I guess, require proof that, I mean, is that a substantive change or is that?

Representative Gene, I'm sorry for the – it looks like I've stumped the – We've kind of

been used to this for four weeks now. Mr. Chair, I apologize for that.

Speaker 36 10:44
We think it may be covered. We think it's probably covered in another code, but we're going to check. We'll get with Department of Finance and Administration. They're not 100% sure. If we could, if there is a problem, we could do a sponsor's amendment moving forward. We'd like to go ahead and move it if we could. Now,

that's up to Representative Gene. But there's no intention to not following that practice, if I'm hearing everybody correctly. Okay.

land shall not be sold in the county level. Does that come back to the land commissioner here and all? But he does come back to the county to sell the land, right? Okay, so that's not changing

either. No, and that's just wording, pulling up, I think, on there as much as anything.

Anybody else in the audience here to speak for or against the bill? Are there any more questions? Representative Barris, you recognize? Just have a motion at the proper time, Mr. Chairman.
▶ Play Suggest a correction Report an error
Representative Davy Carter Unverified 12:06
Very well. I saw another hand over here, I thought. Any more questions? Okay. Representative Burris, you're recognized for a motion. Motion do pass. Motions do pass. Any other questions, comments, concerns? If not, all in favor, say aye. Aye. Any opposed? Motion carries. Congratulations, Representative Gene. Thank you, Mr.

Chairman. Thank you, Committee. Representative English, are you prepared to run 10-23? Oh, got a bell out of here. There you go. First bill. Yeah. Yeah. Mr. Chairman, could I have a point of order very quickly? We were clapping for ourselves, not Representative Jean. That was the first bill we passed out. Well taken. Representative McLean, HB 1314, are you prepared to run that bill today? All right. I understand that we've got some on the deferred list, a

lot on the deferred list. Representative Jean has requested that we remove HB1052 back to the active calendar. So that will be done. We are not going to meet on Thursdays. I'm going to go ahead and tell you, with all the unknowns regarding the weather and the short active calendar that we have, there's nothing that we can't do on Tuesday that we could do on Thursday. So no meeting on Thursday. Anything else? And

So I'll try to remind you as that gets a little closer. So there's also some folks out here outside of the committee room that are offering some pre-cancer screenings, prostate things. So just for those of you to – there's Kelly. So that's all I've got. No other business. We'll stand adjourned.
