Pierce of West Memphis, Crittenden County, Arkansas, is serving the Arkansas General Assembly today as Doctor of the Day, And whereas, Dr. Pierce was appointed in January 1997 by Governor Mike Huckabee to serve on the Arkansas State Medical Board. And whereas, Dr. Pierce currently serves as chairman and congressional district member of the Arkansas State Medical Board. And his current term expires on December 31, 2012. And whereas, Dr. Pierce survived an attack on his life by a disgruntled doctor seeking revenge on the board, leading to an even stronger conviction to serve the state of Arkansas through continued service on the board following the attack.

opportunity today because I picked up the Arkansas Democrat Gazette this morning and I read where Senator Bookout had said that he had never seen a really perfect piece of legislation. There you go. And it just so happens to be my first bill. In all honesty, though, this is a really good bill. It is a clarification of some language regarding developmental disabilities.
This came to my attention because I have a daughter with spina bifida, and so this is how I knew about it. We first approached the Department or the Division of Developmental Disability Services, and Dr. Charlie Green and his staff over there helped actually craft the language here to clarify some language. The way Arkansas Code currently reads, there are functional requirements to establish developmental disability eligibility. And the diagnoses of spina bifida and Down syndrome both are qualifying their eligible diagnosis.
However, there's further into the Code some categorical examples cited. And in those categorical examples, it lists such as cerebral palsy and autism. but it does not specifically mention spina bifida and Down syndrome among those examples, though they are qualifying diagnoses. So what has happened over the course of a number of years is there are a variety of different state forms where they say check your diagnosis and there's little boxes there and they've taken those categorical examples and they have one for cerebral palsy and they have one for autism and for the others.
On some of the forms, there are boxes that say Down syndrome. On other forms, it does not. and I'm not aware of forms that actually say spina bifida. And so though you have children and individuals who are qualified for services, there's a lot of bureaucracy involved and a lot of government red tape. The folks over at DDS are in perfect agreement that this would help simplify some lives for some families that have some challenges out there. And at the same time, it would also help simplify things from their standpoint as well. This is not making anyone eligible for anything they're not already eligible for.
This is not any growth of government. This is not any increased spending whatsoever. There is no tax increase involved with this. I know that originally there had been a couple of concerns raised about a fiscal impact statement, but we've worked with DF&A on that, and that has now been revised depending on what the current form today is. it either says minimal or nominal, and that is coming from the standpoint that there may possibly be some people who take a tax credit who did not take that tax credit before, but
it's not that they weren't eligible for it before. They just weren't sure which box to check, so if that makes sense. So this is a really good bill. It helps people. It doesn't hurt anyone. It doesn't cost anything, and it crosses the lines of race, creed, culture, religion, theology, political ideology. I know a number of you have signed on to this bill, and I've had an opportunity to talk with you one-on-one about it. Probably three-quarters of you I've talked with about it. And I know that there are members here today.
I've mentioned my own daughter, but Representative Elliott has a daughter with Down syndrome. Representative Hobbs has a child with Down syndrome. Representative Smith has a niece with spina bifida. And I know there are probably others of you who this personally impacts. Again, this is something that at the end of the day you can go home and feel good about yourself and not have to second guess anything about the way you voted. On the surface, it appears that it only applies or only helps one person in the highway department retirement system. Upon closer examination and very detailed examination, I don't like how the situation came about. I don't like how the events fell in order to get us to this point. But Representative Carnine is correct that this needs to be done.
It is an IRS code change that happened about four years ago. And this particular person who is retiring just happens to be the first one in line to retire since that code has been changed. And quite honestly, I think they've just been putting off this correction until they had to deal with it. But I am going to vote for the bill and make

It is my intention right now, unless the road conditions are deemed reliably by the state police to be almost untravelable on Thursday, that we will come and continue our week's work on Thursday. We'll probably come in late Thursday morning for the committee meetings, the A committee meetings,
and then we'll go in session that, I don't know, we'll either come in at 10, go in session 11, or come in at 11 and go in session at 1, and then get out of here Thursday afternoon. That's subject to the best information we have in the morning when we come in session. So those of you that may speculate that we're going to leave will pack your car up tonight and be ready to go at 9.30 or whenever we get through in the morning. But our intent, we'll be here to work on Thursday.
