I thought when the letters started out, they knew we were going to have a little divine intervention to kind of keep us awake in the day. But the good Lord, there's infinite wisdom that is all here, so we're ready to go. So I think each of you realize that we're here for a very specific, limited, narrow purpose. Almost half of you have not had the pleasure of going through a fiscal session before. It gets intense, but under the constraints of the 86th Amendment to the Constitution, let's see, our mandate is extremely clear. And that is to, if you look at the precise wording of the mandate that's probably here today, is to consider appropriation bills only. Now, it also has a provision in there for a supermajority of us who think there are other matters that may be considered, but we can come together and consider non-fiscal matters. There are a couple of issues out there that are pending, and we will give you consideration of that. But clearly, the framers of that amendment, we want to just come up here, take care of the business, look at the budget, make good decisions, and go back home to our constituents. Now, there's a lot of speculation. If you go back to 2008, when the amendment was passed, a lot in this room and a lot around the state were pretty surprised when it passed. I was one of them. I know there are a number of years in here that were surprised also. And the speculation as to why it passed, I can see it be two basic categories of voters. One of them certainly will be a foreign voter that probably has some good business background and knew that if you put your eyes on that budget a little more often, so there are your revenues coming in, what your expenses are, monitor them a little closer, you're likely to do a better job. And you can rest assured that those efficient-thinking people that voted for it won't just come down and do just that. Make our concerns known, come together, see our revenues on, pass our budget in a swift manner. And there's a other group of folks that may have voted out for it for some unknown reason, and woke up the next day and saw what they had done. And you can necessarily, those folks are warning us to get up here as quickly as we can and get out of town. So, however you look at the overwhelming majority that voted for that amendment, I think it's clear that the voters of Arkansas want us to come up and focus on the business of them, take care of it, and then get back home. Now, we do have those that were in the category of presumably the majority in itself that voted for it because it does give us the opportunity to look at our budget on a more frequent basis. They were wise because we do have items that we're going to be considered that are ominous or important that are deserving of our attention to our own annual basis. This is certainly, as we all know, a big-ticket item we'll be looking at will be additional funding for Medicaid. This is Medicaid that provides medical services for those most median, I'm with the elderly, the young, and the poorest amongst us. We know that medical costs have been rising in alarming weight, And until we ever find the right solution, which, of course, continues to be in the world for getting control on those costs, we certainly owe it to these 700,000-plus Arkansans that are dependent upon us to see if they get the medical services that they need and deserve. And so we will be engaging that very important item. We also could not have foreseen a year ago the unfortunate circumstances we've seen developed with the Forestry Commission. As all of you know, recently we did, through savings in our relatively young agriculture department, we found enough time back over the past five years to justify reallocating funds within the department of bringing 15 of our firefighters back to work. And I know that everybody in here joined me and being appreciative that we're able to bring those firefighters back to do the job of protecting our forests and people in the state of Arkansas. Now, it would be somewhat of an anomaly if we found the money to bring 15 firefighters back and we ended up, for the end of the fiscal year, having to lay off a bunch of other folks in that department, which is what will happen if we don't pass a supplemental appropriation to meet the deficiency in funding just to get the department to the end of the year. So these are items, because we're obviously education always at the top of our agenda. We'll have additional funding to meet our needs and adequacy so that we'll continue our progress in education. I think that it's incumbent to say that when the famers of Amendment 86 grew together, they didn't intend for us to come down and reinvent the budget bill, but rather to come down here and keep the train on the track, keep it moving along. Those of us who are in our last time have come together over four budget sessions now, conservatively as legislators working with the government to produce a budget for the state of Arkansas that put us in an in-game position amongst the other great states in our nation. That is, that we right now are only one of eight states that are operating in the black. So that tells you that even in the difficult times that we've been under, that we've come together across the aisles of the legislative body working with the government to do the work that was expected, provide the services to our citizens, and not have to endure the mass layoffs that we've seen in many of the states around the country. We have a myriad of good ideas out there. I have no doubt about it, but all of them come to a surface, because we recognize that We don't come to agreement on all the same programs that we should be involved with or the extent of money that should be spent on the programs that we do involve ourselves with. And that's what we're going to be doing over the next few weeks is sharing those ideas. But I ask you to work as you are bringing forth your ideas for the people that you represent, as you work in a spirit of being always committed to coming together in finding the common ground of agreement. Whereas we do our work and we can complete our work, allow us to complete our work in an efficient and effective and an expeditious manner. If we're making our contributions knowing that we must avoid a characterization of some folks up in Washington, D.C. that we don't want to do like, We don't want to deal with good life. We don't want to deal with distractions that take us away from the business of the people. So we always want to look, come together, calm and round. Efficient, effective, and expeditious. If you need motivation and inspiration to do this in Arkansas, that's pretty easy to come by. Look around, look back at home to your teachers in the classroom. We didn't give up on their kids. We didn't give up on funding the education needs for our children, doing the things at the state and local level, so that we have seen ourselves, instead of being in that position that we used to be in, and that the government talks about so often, we don't find out from Mississippi, we're not there anymore. As recently as the past few weeks, we were recognized in the Education Week magazine in Arkansas, being number five in the nation for policies and performance in our education and our schools. and this is something that we rightly can applaud and I say that we applaud those teachers because they're the ones that are doing the work back there. They're the ones that make it happen. If we continue to do our job, they'll do theirs, and we'll continue to be where we want to be, not, thank God for Mississippi, but number one, where everybody else is chasing us. You also, if you need inspiration, think back to all the people that have come together and the myriad of disasters that have faced the state. The tornadoes, the ice storms, the flooding that we had in so many parts of our state in the last spring and summer. The first responders at the local, the county, and the state level, but not just those people, the people who came together in your communities and your counties and your districts to work together to take care of those who were displaced or were standing in the lines with a sandbag trying to keep the floodwaters on. Or if you're talking about volunteers, think about in the state of Arkansas, we have over 300,000 people who are involved in volunteer efforts. These are people back in your schools, if you're senior citizens, or volunteering in their local government organizations or state organizations. These are people like you that are doing what they want to do because they believe in it, and they come together to accomplish a common goal of helping other Arkansans. That ought to be our inspiration as we're down here working together in the next few weeks, coming together for the benefit of all Arkansans. And I want to tell you again how proud I am that you prove this. You prove that the members out here, Democrats and Republicans, prove that, yes, we can come together and we can do the work of the people, because when I addressed you back at the beginning of the 88th General Assembly, the regular session, I asked you to come together and focus on key items that were important for everyone in the state, important to everyone in your district. And you responded in a most exemplary way. We were able to come together in difficult times across the eyes, Democrats and Republicans. We passed a water plan that, where was Robert Bale? I was my man back there who planted that seed back when we were beginning and said, we ought to be coming down here not worried about what they're talking about us in the paper when we go back home, but what we're doing for the generations that follow us 20 years down the road. And you all took that lead and you took that challenge and we passed the plan. You're going to be getting some information on there. I've got an email that I'll be sending out. Things are working great on there. You came together in great adverse times, but you recognize that we had a funding deficiency in our carrying infrastructure in the highway department, and you passed a highway bill. It resulted already in the people proving the garbage bonds, the bill of the garbage bonds, that provide substantial highway funding. as part of that particular bill that didn't come about as we intended because we called it a nickel diesel tax, a little dangling in. I think I'm going to ask you later on to be taking care of that. But we'll also have another measure to come to the people in November that will allow us to have the opportunity to find an infrastructure system in the state of Arkansas that would be envious to the entire nation. We also came together and passed ethics reform. You came together and passed an ethics reform that was, by the way, it wasn't everything that we all wanted, but it was a step in the right direction. It was something that no General Assembly had done in many, many years in this particular chamber. But you had the fortitude to come together, Democrats and Republicans, to get that done. We passed a criminal justice reform act that's going to make, as it's implemented, make our streets safer, the cost of our incarceration, more power to build within the means of our taxpayers, and do a better job of identifying those that we need to invest in to rehabilitate, to bring them back into society. So you've already proved that we can do this. Maybe most importantly, we all came together and did something called tax relief. How about that? We passed a little, some tax relief for the citizens of the great state of Arkansas. All of these measures, it wasn't Democrat, it wasn't Republican, it was all of us coming together to get it done. So we'll prove what we can do. And I ask now as we go forward and see ourselves continue that role of good stewards for the people of the state of Arkansas, that we strive for the good works that we will be, that we strive not to be remembered in name or recognized in name, but to be remembered and recognized by the benefits that our work is produced for the people of our great state. I want to close by telling you one thing that I brought to you back when I made my remarks at the beginning of the 88th regular session from my good friend Billy Joe Shaver, some thoughts to think about as we move forward in this harmonious body that we're going to be in now. Billy Joe said, always remember, it's nice to be important, but it's more important to be nice. So let's come together for the common purpose of representing the people of our great state and do some good things and do it in the

It's a nostalgic occasion for those in this room who are attending their last session because of term limits. Save and accept, of course, a special session, which all of us hope is unnecessary. So for all of you, I hope that you will drink up and enjoy the actual feeling that you have every time you sit at this desk and pass on major public policy issues for your constituents, specifically in the constituents of our state at large. I recall the feelings I had in my last session as a state senator, and the nostalgia will creep back in as the session progresses. It is an honored group that you all are comprised of, and you don't give enough credit for all of the hard work that you do. And we have our differences from time to time. We have your differences among each other from time to time. But in the final analysis, you're the first branch of government. And you're the first branch of government for a reason. The final five is decided that the legislative branch would be the folks that were in charge of public policy and in charge of the money. and since you're in charge of public policy and in charge of the money the other two branches of government usually fall in line it is my job to propose it is your job to dispose that doesn't mean that you're free from proposing yourself because you have that obligation as well and I received your proposals and sometimes adopt them as my own sometimes applaud your initiative, and sometimes wonder where you came up with the idea at the beginning. You all dispose, but if I can help you dispose, that's part of my job as well. So I don't choke from the responsibility of being of help and assistance to you as I can. I'm also cognizant and mindful of the internal workings of these two houses. and have always been mindful of how I felt as a senator when I thought a governor overstepped his bounds in dealing with the internal policies, and I try to refrain from doing that. But this is our second historic fiscal session. The first session was short, sweet, and to the point. It was a fiscal session, and you had another matter that you dealt with, but you dealt with it in a form of consensus that caused it not to prolong or unduly harass the intent of the voters with regard to the purpose of a fiscal session. I urge and applaud you to take that same approach this time. Many of you will be filing for re-election or filing for other offices within the time frame of this session. And I know I can speak for you when I say you are going to be out of here as fast as I want you to be out of here. Obviously, after first having done the people's business. we have

together weathered this economic recession in a fashion

and a manner that most other states would begin to sell. We are not immune. We've had our shared problems. We are not immune. We've had our people laid off. We are not immune. We've seen certain revenue sources decline, and some of which we are asked to address in this session. Nevertheless, compared to virtually every other state in the country, Arkansas has weathered this economic downturn, the worst of my lifetime, better than virtually any other state. And a large part of that is the conservative, rational, reasonable budgetary approaches

that you ought to have taken, and you deserve credit

for it. I will tell you that we continue in that opinion with my proposed budget. It is a relatively flat budget. Two major areas of increase are, first of all, K-12, with adequacy increases as defined by you. The Constitution, the statutory laws, and the Lakeview case all recognize that the legislature will determine adequacy, and once it is determined by the legislature, it's incumbent on the rest of us to fall in line and fund that adequacy. My proposed budget does precisely that. It addresses that first priority of K-12 and adequacy, both in the

letter and the spirit of the law. The other major increase in the proposed budget is for Medicaid.

It is a substantial increase, as increases go, for this session, but merely a small portion of what we're going to face in the long run going down the road. That's why we continue to try to work together for issues which won't be addressed necessarily in this session, but of a substantive measure going forward to try to get a handle on the the ever-estimating health care costs that strike all of us in the private sector as well as the

public sector, but specifically strikes all of us in state government because of our Medicaid responsibilities. Other than that, in a few minor tweaks, the rest of the budget was relatively flat.

I think all of us would like to see increases for our state employees, and I'd be the first to say I wish we had it. We've hunted and searched and looked to try to find it. Hopefully, there will be some savings in various budgets that some degree of merit or some degree of individual assistance can be provided by the agencies, but across the board from the legislative session, there is something that there is just not the money to provide. We will also ask for some supplemental funding. Most of you have seen that. It's been real leadership requested that this information in your request and have a very good disseminated area so that you have the opportunity to look at it, digest it, and make up your minds as to the validity of any of those requests. That's all been done, and hopefully you've had the opportunity to look at that. We have about $70 million in surplus money, which, incidentally, has been lauded nationally since most states haven't had any surplus money. Of that $70 million, roughly $30 million is being requested in supplementals. For those who do not know or may have forgotten, that is not spent in supplementals goes into the general improvement fund pot next time as a basis or base for general improvement monies which are always needed for the capital needs of our state. But in the meantime, those necessary items to be funded with supplementals are usually the first call off of those monies and the request is in there for all of you to be able to see with regard to what those requests are. There may be some other items that members have suggested. I have tried to be open and responsive to understanding those requests. The only thing I would ask is that you keep them as limited as possible and that we work together in a fashion that doesn't delay the session and that it doesn't break faith with the people who actually voted to have annual sessions that even in the years of which would be devoted strictly to fiscal matters. I think the people understand that if there's a tweak or two here in a very limited fashion that requires to be done, that they can live
