Okay here we go all right we'll start over house judiciary will now come to order chair sees a core uh members we have two bills on our deaths today i'm going to ask arlina to pass the bills out in while she's doing that on it introduced to you ratio whose are legislative analysts today he's not with us. He's not he's not really ours kobe hours is on his honeymoon so we have raining ray we're glad you're here and got a sale said that are line will be with us as our staff person so we're going to give you just a second best the bill out as the bills are being passed out i'll recognize representative gas way to go the into the table as represent gas ways growing in a table just a little housekeeping for the committee committee we do have a some interest study proposals there i'm anticipating some time in the far will have a meeting to start addressing some of those in our proposals so just watch when we get to that point you know we don't typically meet a lot during the interim but we do have some interest study proposals represent collins you're recognized thank you manager just a quick procedural question so on the senate bill are we I guess we didn't pass those waivers of the rules so we're able to hear this senate bill it's about denominated long enough etcetera it's my understanding that is correct it's been on the desk long and can get up. You can get it ever by just a just a second to look over the bill. In your words you have a opportunity to look over the bill if you'll discount a look up so I engage if you all are ready to go. Ok with their representative gets away you recognize to present to the committee house bill one zero zero six thank you madame chair committee so the bill that you have before you house bill one zero zero six as a bill that comes to us from the code revision commission. That's where this discussion originated it is really just technical and nature and for the purposes of clarification as you'll see the bill concerns what we call the firearms enhancement sentencing for a felony with the firearm and basically their exists in law currently and enhancement a sentence enhancement of up to fifteen years if you've used a firearm in the commission or escape from a felony and that's existing law and there are certain release eligibility requirements that apply to the farms enhancement that existing law and so what we want to clarify was we changed that in the protect act that beginning january one twenty twenty four any release eligibility on the firearms enhancement would be one hundred percent time so for any time that's imposed on the parm is enhancement beginning january one twenty twenty four there will be no early release and so we just all we did was inserted those dates ending the current release eligibility rules on january one twenty twenty four for the laws as it exists now and then saying beginning january one twenty twenty four there will be no early release eligibility for the period of time that a person is sentenced on the firearms enhancement that's all it does it just simply clarifies how the release eligibility rules apply and that they change on january one twenty twenty four that's all it does and i'm happy to answer any questions members are there any questions we have same property recognized for a question thank you manner chair representative gas away when it says line twenty three for an affairs committed one or after july seventy two thousand seven does that mean it's gonna go retro active to those people already in jail no and that's a good question so this does not change any sentencing for anyone. Uh who's already committed in advance in it this is but the changes the day for people who commit an advance on our after january one twenty twenty four while it makes clear is that anyone who commits an affairs honor before january one twenty twenty four will be uh senate according to the law as it exists after january one twenty twenty four the new rules apply so it doesn't change anything. Presently for how people would be sentenced thank you members any other questions seeing the other questions with job have anyone who has signed up to speak for against the bill for procedures you recognized close for your bill thank you madame chair i'm close to the bill would make a motion to do pass members we have a motion to do pass on the floor through any discussion of the motion. Seeing no discussion all in favor of please say I in the opposite of the eyes have it congratulations you have passed your bill we've seen against where you also going to be presenting senate bill six yes you're recognized to present senate bill six thank you madame chair this is an identical bill to the bill that I just explained the house bill. And so uh seeing bit I expelled explain that bill i'm happy to answer any questions if anyone has any but i'm close for the bill members any questions seeing the questions represent gas was going to first bill once again we have no one who has signed up to speak for against the bill so representatives were here recognized make a motion to press membership we have a motion to the past on the floors during the discussion of the motion seeing no discussion all in favor of place say I opposed please say no the eyes have it once again congratulations you have passed the bill members we have no other business anybody have any. This is what you're a calendar for when we will need to take up in a study proposals and with that we are adjourned.
