something that we can recommend to the general assembly in that regular session too at least have a process to fix it but that's still in discussion and we discussed it with the executive community members have actually talked about it but i'm only saying that to reiterate for those that are in the room don't understand what the issue is but I would you please tell us about the specifics on jerkow mister johnson okay jerk it has not been was not able to
be here today we also have a request from the town of dice but in your packet there is a spreadsheet that goes over uhm can details what the committee has done before and what is being requested yes specifically bajair co and dias um you'll be considering dias because they're here today but this is committee in june approved a process where they required cities in the situation
the to fill out a questionnaire and before the this committee here to prove to cities for to pay less than ten percent the general revenues back and that was crop for sville and twin growth and the payoff time in number of years was around eight years in around eleven years and away in the end the town of fortime was approved by this committee in september and they approved a payback of two hundred dollars a month and that was about five and a half percent of their general revenues it will take them
approximately nine years to pay back. Uh jeer cohen dias or requesting um jerko's requesting fifty dollars a month and it would take them over ninety five years to pay back what they owe which they are almost sixty thousand dollars and dias is here today in their requesting to pay back two percent of the general revenues which is about one hundred eighty nine dollars a month and that would take them seventy years to pay back the almost one hundred and fifty nine thousand

smart towns have is if. Mister jones and missus jones if they have a part home further street. And if they have a sureline on the city on the city side this backed up. The mirror is going to have to fix that sooner. I've had still your list the plan to see for january of twenty twenty five I think we should relook this long
if we say it's now that the funds were for highway bridges that maybe we had more more port in that says infrastructure because we see this over in over and over in in towns are really. Taking money out of one of their pockets in their shifting it to another I was only seen the council for twelve years. That we get caught in the same thing so that's that's the issue that this really small towns have when you don't have a fort
house staff or you don't have a four time mayor we have great citizens like sort of major your more that steps up it does it but we probably look that hard with that i'll i'll back up in the job beat him to the mayor give more welcome they they're fire yourself for the record and you have any opening comments I do american affair more like to
thank you for giving me the opportunity to come down here have a few comments in you did a very good job of explaining it I would like to address the committee just hopefully a little bit more than that I can understand how dascal in this position it was actually several years prior to me taking over as a mayor. In years past when the state used to send back turnback money sent it back and one check and there was a spreadsheet that came out there was codes multiple codes on there they were not all grouped together so list a site code forty four was for street phones you may have a
forty four and and you may have a toy over twenty two to forty four if you have a new person that works for the city or a new recorder treasure that didn't go back and know to add up all those forty four is from that one state check and do a transfer at that time from the turnback money and specifically put it into the street account then that's exactly what got us here we had people on the staff that didn't exactly understand the process from the state they were newly elected officials there weren't very many schools that we could send him to your
classes they educate a moment process you've taken measures and corrected that now when it comes back and specifically come back in a fun directly goes to the street account there's no misunderstanding what what has funds for. Just to give the committee a little bit of fact I know we ask for two percent but that's just to help us when we get in times of need so far so far this year's forced turnback money goes the state has actually sent us back eighty thousand three hundred and eighty five dollars and forty four cents of ten percent of that would be eight thousand three hundred and eighty five dollars we've
already transferred from the town account so far this year almost eleven thousand dollars so we've exceeded the ten percent or goal is to continue to do that but if you look at last year's audit that we actually got in our town account we actually spent more money than we actually brought in from the town account our sewer systems over forty years old were working diligently to try to get grants are eliminated showed it we were one of the wealthiest towns in arkansas we struggled hard with our
people with east arkansas planning development to get that corrected. We submitted it and it was on the wrong form so they rejected it to all these rounds of grants it came back had a like thirty nine percent on a real amount. When we actually got true studies done which the grant window had closed worked seventy six percent on a limit so we're extremely difficult for us to make ends me with the amount of money that we've got an amount of people that we have so what we're asking and i'm at two percent in chairman i'm open to any discussion that the committee could have on those
times when we have a really really large bill that we've got to fix something whether be sewer whether they are our equipment that we maintain the town with their potentially are going to be months when we can't horribly meet that and still be within budget on our town account so that's why i'm asking for some lingency not to take it up to seventy five years i'd like to get a paid off from five if I could and if everything goes good that would be great. But during those months when we have those struggles it would be nice to not have to fail on one part of the other I mean they're
fighting because i'm not putting appropriate money transferred to a straight account or i'm failing because i'm what my citizens down because I can't maintain my infrastructure like I need to so I hope that gives a little bit more clearly to the committee and without a yield and will say that you're the new you and your city counts are looking at two percent as a floor that you will pay two percent and then more when you can and and and I appreciate your you're hoping to get his done in in several eight years or whatever and that's for that
kind of money that's that's that's good that's good but this will be a competitive decision for forward i've definitely appreciate uh what's in the wall is sitting in full disclosure he have had a brief conversation about this before with we need to come up with a long term solution not just for diesel cover anybody else in that situation but where a we solve this problem to the best
we can be treat all communities fairly and equitably cause at the last thing I want to do and we've discussed this before it's say you will hear you you can take quarter you want and that's what i'll be here we're going to come down with hammer we're going to treat everybody as fairly as we possibly can depend on the circumstances and my you're being forthcoming with this is is appreciated I believe we we do have a queue in center for love I believe you're the first one in the queue

to take ten years or it's just a this is a hard situation but monday we need to make sure that we put a lot of thought into before we begin to to to kind of think of a remini I would say in so my question to the mayor is this is either you said that you're your agreement was based on two percent of your revenue and then
you see it well we've already paid back more than ten percent the ten percent which is kind of the formula that we've already come up with would it why did you not why did you choose to say the and just take it out at two percent both then we are paying instead of a sale will pay the ten percent unless we fall into in the contingency is that we pay the two percent that's a very good way to look at it and my thinking way is the same way you're saying it our goal is to pay ten percent at a
minimum everyone if we have a situation where the. Something arises and we can't. We want to know that we're not breaking the law intentionally or not because we can't comply with a directive that this committee has set forward that we must do then if you pay the ten percent how long would it would you take for you to repay there the outstanding phones i'm not for sure what the current balance is at this point we were showing a little under a hundred and fifty nine thousand I don't know that included the
last month or not but I think it's close enough for it so that would at ten percent that would work out a little under seventeen years that correct mr and that's how I obviously that's not good but it speech night here two hundred thirty five is a major argue back in the they can thank you and I think what you stayed in center love
is what we all want to reach in the fact that uh my gilmore was straight up with this about their situation and they're he's we can agree to this and will do more than we can and i'm proud of it for say in that but we need to not just look at the situation dash but coming up with a way to handle this as many times as it comes before this committee when auditors come back for their reports thank you and the next representative
thank you mister chair mayor have you had any work done with state aids from your streets when we've had our second round of uhm paving that's been done the first one was probably about six years ago and I believe it was just over two hundred thousand dollars and now just over a year ago they came back and did a second iteration from stay on the streets okay. How long we have your own i've
been paying have you been using the street fund money for other purposes. Since the article it in the audit directed us to pay back a percentage we haven't used the street money to use any other funds the problem has not been now taking more out of the street fine just being paying back the penalties and rears yeah but you you know one time you were a hundred sixty one thousand dollars in with your budget you didn't do that overnight notion and
every same rears of them not transferring money the turn back money into the street account prior to my administration and every audio will say that you are taking those funds out in every out of response or saying we will correct that in here you are of today and you want to say let us pay two percent will pay ten percent what we can and we'll be here two years from now and there be another mayor down there saying I don't know what you talked about I just got elected might
that's my problem with that mayor nothing against you and your proposal and understand cannot respond yes please do okay I guess i'm confused by your response because since the legislative audit came down and they auditors and they said it we weren't putting the required amount of money into the straight account we have not they've never got us for that call again taking street money music and appropriately the call has been we have been paying back the extra money when we have it or couldn't and that we still owe that account that we haven't paid the whole hundred and sixty nine thousand back
they've never repeated the same call and said it were using street funds on any other project we have it mean the call has been that we haven't paid that money back that when they initially found the big deficit and identified a dollar amount now we o hundred and sixty something thousand and more obligated to pay that back so I just want to be clear for the committee the way I understood your statement is it now we're still using a straight fund for something else that's not no I did not mean there but you did not accumulate a hundred and sixty one thousand. Over a two year period of three
year period it make of decades you know okay thank you thank you just just a moment representative uh mister jones over how many years was that was the city out
of compliance on the item in the art. It goes back to two thousand three is what we're in every year since not every year but finding goes back that that's when their problem started in two thousand okay mayor when did you become layer my first term that I was elected was in two thousand and sixteen uh did not run for reelection the last one in and I ran for reelection again this time so i'm in my first year of this administration tomorrow okay thank you we just want to try to get that in the record i'll say so hammer neck for sure I want to go back to the comment about the training aspect when you let's just deal with you when you went in and two thousand sixteen you or your staff did you receive training from the municipal league as far

him I do the what takes place between the municipal league and newly elected minismal members such as the mayor and other staff as far as offering training on subjects act as the unitiate action and you document that you've reached out to him and just talk about what you do please yeah so i'm sorry we do you know we have two major meetings each year we have a winner conference and a summer convention where every.
Municipal officials and vaded we have uh probably four five other regional meetings smaller meetings throughout the year training sessions we have list serves that each city official can subscribe to where we're sending out messages and different types of uh whether it's training or all cans of information so we and now us as of about a year ago we have hard
fab we call them feel reps we have one and rate back here former mayor in fact all of them are former city officials and they represent its we have fab districts come up congressional districts but they are constantly going out to cities in their region. And drop an earn and you know what can we do to help you having problems with anything let us you know talk about it so that's kind of what we do we've
stepped at up a lot over the last couple of years and but yeah there's nothing mandatory about having to take training we certainly encourage every elected official to the to to get training through us the city band to any of the trainings or could you check on that I could check on it sooner I don't know the mayor would know whether or not they attend uh the either the summer convention or the winter
conference okay and I know mayor if I understood center walls right you your employed full time somewhere else in did I understand that correctly union and I can answer a question about the training as well yesterday which played yes from my first time as mayor we went to all the municipally conferences and as far as training goes at that time my current assistant actually sent her to a city that had a very good reputation with the municipally on our own to go to a week long train with them to learn what her job should be
and could be. We are also planning on attending the january municipally conferences upcoming okay II understand be difficult being full time employed somewhere and being a mayor the city of your size can be challenging and was this was yourself reported or was it found through the auditing process it was we found it in the auto process but the mayor said it about how it occurred a long
time we have went back and took a look at our previous reports and that appears to be the case uhm the mouth been steady since two thousand thirteen um and so they since then they've pretty much been using the street foreign the street turned back money for street purposes okay i'll i'll start now thank you thank you center hammer representative I recognized thank you mister chair so I think my question i'll be
for use that so they had artists in two thousand and three that want good and a since then in two thousand and thirteen they quit using time back in that ten years how many audits was done that showed them that they were out of compliance with the law can be checking on their again to you this there are five percent of our clarify and and we'll get the starcher to clarify his when you say out of compliance it means have they
paid it back versus have they continued to place that new money in the wrong account and I want to clarify that they're those are two different things we need to clear so I would like to know about that those are yeah though those far particular those the balance win up that was out and so that's and we you know that's consistent what you usually do those smaller towns most the time we do two years ago so that's you know that average is what happened can I have a follow up yes mayor.
Thank you sir so you have two employees not count yourself for a town of five hundred that's great and then if i'm if i'm understanding this correctly they take up the majority of the money that the town actually receives. But that's the payroll right to pay for and that's taxes and everything right so you're not left with much money once you have to employees that are getting this money so a a town of five hundred why don't you need to employees I
have one outside employee that takes care of all sewer issues at a read rate again our server system was forty years old we own quite a bit of ground that we actually have to maintain during the summer's hard moen waiting all other maintenance on the facilities that we have the inside employee she handles all administrative activities from everybody coming in to pay their water bill to paying all the invoices all the bills and everything that comes in on a
database one more question and I promise that the yes ma'am so you have two employees are those employees new to the office and if yes was there not something from the past audits that was in the paperwork that showed where you were at a and how much money that was owed to the state they for the misuse of the money both employees have been with the imposition for the last four years they're working on your five right now one of them just one over five years that was one of the last things I did on my last administration was higher
the assistant to the mayor that's currently in place she's very well aware she's the one has been maintaining and making sure that we're paying back money the other employee uh is the outside employee uhm he probably does not understand to the detail because he does not work budgets that I do with her but he is a where that we have turned that money that we had to put back in the street and again nothing again to do or administration or what you're trying to do is just hard to understand how we got from two thousand and three to twenty twenty three and we owe this
much money and we've had five audits that showed so thank you in in representati. They owe it to their street find its their money but they can't spend it for their under the law it has to be spare on on roads etcetera so and that's just again a clarification it's not like we're sitting here holding a day we're not there they owe it to this their own other account
representative brown thank you mister chair i'm really appreciated senator wallace explaining the um challenges that they smaller community space I do not know what lema stands for so long modered income percentage okay so when you were ranked you were ranked at a much higher income level for your community which made you an
eligible for some grants now did that occur during your just a term in office yes when they went back and um officially recorded our element it was much higher to to put it on a and i'm sure i'm not going to break this down is accurately as I should but half of america if you were half of america then you're fifty percent so if you say that we're thirty nine percent our element you're saying basically that we are eleven percent better than half
of america on income and how that were run in our counts and how we're doing our budget when the actual data when we did the cost study and got it back in used east arkansas plan in village to come into assistance and capture that we went from roughly thirty nine percent in that area that might not be the exact number up to run seventy six so now you're twenty six percent worse than half of america that's actually where we are so followed when will ubroad for the next grant cycle to now the chip got
corrected information as soon as the grant portal's open were already right now is this for actually the g. Where what which program are you there there was a couple of grants that came out when i'm I think last morning I think the other one june or so they were eligible for the uh our biggest problem that we have is cost and it's the most amount of money is our seose water is water okay so but it's that that figured the LA m figure would apply in every
grant situation from this point forward right but they were misclassed about him they were they were statistically supposedly richer than they really were at long and short so just two other comments it sounded to me like the way the money is disbursed from the state to the cities all they were it was all on a spreadsheet and it wasn't grouped and
I don't know maybe yeah i'll know more about this scenario but that sounds like a very complex way to. Uh cause uhm a small town that may not have the uh talent pool or whatever you want to call it then people trying to do. Detail work I mean or you might not have access to a lot of people to do that for you so just seems like the simpler you make it or the easier you make it really anybody would be preferred rather than
having straight money scattered around with the budget codes on a big spreadsheet having less simplified things in the are the are the cities and counties required to keep separate checking accounts for the two turnback amounts they receive or they just have to keep dedicated accounts but they please mister down's answer that from professionals yes the cities and counties are
required to have two separate accounts and so that cities do have a straight fund bank account the your other concern a few years ago the state quit sitting out money in one laptop they used to do that they'd send out both the the general and the street turnback in one check and it would that's there's the mayor said that's how they get in trouble they didn't move over the proper amount to the street fund in a lot of a lot of cities were in that same boat two years ago they quit doing that they
have a direct deposit into the general fine bank account and once directly into the street from bank account now I would almost think that maybe we should have it set without a direct deposit but actually have a check that santa warrant it is attached to it a sticker that says do not put this in your general fund and that's an oversimplification but I think we could see the situation in the mayor described the codes and things and in representative where that's probably a very good adding at least we're part away in that direction trying to
claim that but uh that's just part of the problem we as sarah wallace said we've got to recognize the contingencies that each city. Has to deal with from time retirement i'm appreciated with the mayor just level with that situation well in it from different meetings have attended understand infrastructure and a lot of our small chances really said shape and when the amendment was passed that probably said that this is street fine uh infrastructure
probably at the time met street and now it getting suits were water maybe even other utilities are controlled with the city so we we need to take a look at the and I think we all cover that conclusion so thank you for pointing that out her representative dobby thank you mister chair may or looking at this sheet that you turn the earned audit so one page sheet in the quote looking very quickly and it
looks like your general revenue I was a hundred and thirty two thousand three hundred and fifty dollars a year and then you're paying back some are something that they are so that's leaving you that ninety four thousand but what concerns me is when you look at what your payroll is your payroll seventy four thousand while over seventy four thousand dollars which is about seventy five percent of your general revenue by reading that correct is that correct your okay
for the record I just can't agree with two percent when you're spending service five percent of your seventy five percent of your revenue is going to pay roll can I enter the certainly with my answer okay we had to find a way to keep someone that would stay at the position thirty one thousand dollars may look a lot of money but when you offer them no health insurance you offer them no retirement the only thing that we have to offer them is payroll to be able to keep them in position because we have less than ten employees we don't have to have FMLA and I don't know for them
insurance like physical health insurance I can't afford to do that if I give them less money and then pay health insurance for them i'm still paying more than what i'm paying right. Now so you're correct ma'am i'm paying on fifteen dollars now that's what i'm paying them for to run my city i've got an assistant to the mayor that for all practical purposes is there forty hours a week that runs the city for fifteen dollars now and and I understand where you're coming from and and I got it I wish I had more money coming in but I wish I could pay her twenty five for thirty dollars now because she absolutely make
sure she took over that this city is not delinquent in anything we haven't recovered the funding that we have to pay yet but we know what's there we're not adding to that death anymore so I understand where you're coming from on the payroll sir taking a consideration that's it if i'm a jonesburl not only do I have a payroll i've got health insurance i've got a four o one k i've got other benefits and I can use it f m l I other things that will help me my employees have none of it they don't have anything so much a male yes I
wouldn't disagree with you that based on our income but what is enough to pay an individual that runs that town she is about she is a representative for me when i'm have my fifty hour a week job that i'm at some point sales anybody that calls if you call right now she's the one that's going to answer the phone so what is acceptable to pay them I understand and I appreciate those comments but if I understood your previous testimony you said you had three employees and that's not counting what's your getting paid so we're talking about the treasure in these two other
individuals is that correct that's correct myself the treasurer recorder and two full time employees well once again just so the committee knows where i'm coming from we would offer emotion at the private tenth of this fraud so they could come up with a better plan than two percent so when you're looking at other cities and we've held their fit to the fire and they've got less money coming yet with the bed that that's for
another discussion that let me add a representative that the mayor I hate to say that our underpromised and overdeliver. Uh we've had communities that would underpo- overpromise an under deliver they'd say we'll pay the ten percent they couldn't quite do it where the mayor saying we can do two absolutely and we're going to try to do more and they have so II don't want to you bring up the whole gist of this problem we're trying to deal with and i'm not so sure
there is a single answer but but appreciate the fact that you've defined and will we what we are through with this by anyway so mr chair you know that I agree with you ninety nine point nine percent yes i'm proud of i'm i'm just thinking that instead of a a oral promise down at the end of the table we have something in writing that sales what what we're going to do but with that being said I do appreciate senator wallace and his comments the people of that area or
family rip are represented by what I consider a senator of high quality and standards and I appreciate him coming to the end of the table in the first of his of his cities and he always does a great job and I appreciate that it's just that i'm having a little hard time personally reconciling some of the numbers we've been given thank you thank you represent so wallace just a quick comment on salaries I own a small country of thirty five people in that part of the country maybe twenty five miles away
and pay in twenty dollars an hour good medical benefits health benefits in I could not hurry by fifteen dollars now okay thank you shatter fighter you in the queue you're recognized all right thank you thank you mister my question is the staff the wind up per slegislation saying the cities had to have a check in account with direct deposit into it.
From state checks on the half sentence sales tags and also the turnback fuel turnback. Now I know this that the code says in the mission will counting on that if the city receives straight turn back money as they have to have a bank account that that money goes into uhm there is an exception if and I only know of one city that ever did it where you can get an exception from having a straight from bank but it's a very rare thing the other monies if it's
straight related it should generally it generally goes into the street part okay the in also this amount here it reflects the road village if there's road millege in that county yes in our it does reflect uh the property taxes there are restricted for road is well okay you would know more about that uh representative by having been a carry judge now when when that is remained to the end
in the case of selling can if you all reminded it to the individual settings they're shared that take three mill road tax how was that and I know it's been a few years since you were judged but what's your recollection about that was it was sent with one check with separated on the check just one check separated on what the purposes the land adams but that's for the various funding things for roads roads for everything for all the turnback okay alright
but may I do have one follow up yes or do you all have a direct deposit now for your street finds coming money is coming from the state we do and we also have a a lot out of turn back from the county from the road that comes back yet as well thank you thank you anywhere else have six representative and then sure thank you mister chair I just have a quick question what is your monthly expenses it's not listed on here.
I did not bring a monthly I mean II can break out right now what I brought right now is everything year to date through the end of uhm from january the first to the end of november I could go back and and try to break it out but I can tell you to the penny for at on each of our accounts from january where to know if you'd like the reason I was asking is cause I see that you have forty six thousand six something sitting there in reserve so that would be like eight months worth of salaries is there a reason that you have to have that much
money in reserves and is our way that that could actually be used to go toward this that's going to be a question acting an answer because then actually what it is that he is our shortly of their set or shortly of the assets also a requirement fund that we're required to keep in case the water tower goes out in case anything big like that goes out and we're limited as for what we can use that for so that's the funding that you say that's the forty specimen thousand dollars is our shortly basset fun

open to anything the committee may come up with the requirements ten percent and we're exceeding the ten percent how long have you been exceeding the ten percent so I took back over the mirror the first time and since i've took an over mayor again on january so so how many months have you been exceeding because where i'm going to your friend as asking for two percent but you are approved in history that you're exceeding that by doing ten percent how many months have you been exceeding the two percent. Eleven months this year so far
do you see a changes in the forecast of your budget you're revenue income or anything that would you know laying out there that might cause you not to be able to continue the pattern you've developed over the last eleven months at adult representative one my water tires leaking right now at the bottom which and a minimum is going to cost me about five thousand dollars just to patch it they're talking over a hundred thousand dollars to repair it uh my wise water facility that I have which is over forty years old is not a
lagoon it's a facility and it is deteriorating rapidly that's what the majority of our available funds go to every single month. If I have a grander motor that goes down your talk eleven thousand dollars one time that's the total amount that i've given so far transferred from a town account back to extra on the street account it's going to take me one grand or motor on one of my three of relief stations it goes out and there that money is walked out at one time is that not party justication while you're reforced asking for the two
percent because you're trying to hedge against what you know who's common that's exactly right okay but at two percent you've knowing those things that are looming out there you feel that you could hold the two percent and you're trying to ward off the other until you get dug out from other nate this thing and then you'll take the bounce and start putting away for those other things if you can keep them held back is that they can out your mindset where you're going on this exactly okay right thank you

twenty seven years twenty eight years I don't know a long long time we've been good friends traveled all over the world literally with each other so i'm in here mostly just for moral sport for him in this I didn't want to bring to light a little challenge that comes with small talents often times a small towns they do have people that they hire to to help with uh some of the challenges that was with him over the thanksgiving holiday he had to leave because there was a problem with sewer in one of his little subdivisions he spared animal
four hours over their working with it had uh person come out to try to blow out superline. That malfunction he came home covered in well let's just say covered and stuff and it was a big chance but that's what uh that's what you do as a small town mayor you have to get out there and you fight for what uh what she feels ridiculous to take care of the people that are there so this I really wanted to ask him a question I guess we're still not in question and answer conversation so you can ask that question I think yes when you do as your pain back these funds
may or give more to yourself essentially to the city and does your using those finds that you're paying back for what purpose we're using those finds to maintain our introductory straight to actually maintain our straight equipment to get to fix potholes like specifically like senator wallace so that we can maintain the if if any of you could come to mississippi county I would directly appreciate it because if you've never driven roads on
gumbo then II can explain it to you but she won't understand one of the questions ask me earlier as have we got any state aid have we done anything to the roads short answers yes does exact same road if they pay five years ago have got cracks big enough now I can stick my hand in the ground as made of claim independent on when it's weight or when it's draft it moves it was it'll swall and it'll shrink so those exact roads that we stay date helped us with i'm constantly patching right now the ones that were done a year ago I can take you on those exact road trip down some of

Should those repairs not be reflected in the water rates and sure rates instead of taking money out of general revenue for that purpose they are we have a new water system it was putting in and we had to increase our water rates to our people and there's a twenty dollar on every bill now uhm alartment on every single we are going back toward repay in that loan that we got with usda. Currently right now at a bare minimum where we're paying just water sewer and trash picker
every people that we've got in the town understanding more income level is is paying an average of seventy dollars a month for water bill so if we start adding more to them a lot of room fixed income that make it nine hundred dollars a month that's what they get to live on for everything so i'm already charging him almost ten percent of their public i'm just for water bill currently but to short attractive questions yes it is and we just did a new right study we're doing a new right study now in the water to make sure that we're far with
our with our citizens at a hand so I feel very helpful after january first after the right studies don't were even going to increase more which is going to make it even more difficult for our people to pay bills to to make it but we can't lose money a week we have to at least make our money on polar yes okay be honest we are you know seventy year pay back we're going to have other cities coming in here if we said here
with a seventy year pay back you know we might as well not have the law in place i'd like danger that very honestly new setting into honestly there's been no misappropriation of funds in as far as das has not stolen used or done anything with the money we did not have the educated trained people in place when the state over fifteen years gave us money back all over one confirm that didn't break it out we use money from the town every single month on street
we use the money that we might have on them on streets if this had been an intentional oversight which II realize the law is what it is and don't matter if it's intentional or unintentional it is what it is it was not put in the correct fund where it tried struggling to maintain is what we're trying to do seventy five years. We're going to have something cash profitably break in seventy five years because my short lived assets not big enough to cover when my treatment the facility which you're going to cost almost half million dollars to replace goes down and i'm not
eligible for grants or haven't been to the evening stuff going again. If from me looking at my people if it had been something that we had done to to a deliberate act of something would be great. But we're not told my pay in a statement with him at paying herself back where utilizing the money already as it is more were not holding money back that we owe another entity it's our own books what I would love if we
want to get down to if we're starting to be to start a claim slight I would love to be able to say okay we understand how we got here it was not necessarily on anyone delivered act to do that we're here we're not doing any more haven't done it anymore since a state started direct deposit into that account and to not have that hanging over my head of the month to a fixed water bill or do I maintain what the states ask me to pay myself okay and my you were right now setting for a lawsuit illegal
extraction tax for one purpose spent it for another and you've got violation of amendment through with the road millage in a valuation of member seventy one with the halfs its sales tax and so the I think the urgency in the region this law was passed there at that time there was thirty one cities like this to get him before there was a lawsuit and get it corrected in a timely manner and again when we look at on paper for seventy

the street fund so their balance has decreased to something of uh one hundred forty two thousand five hundred ninety six dollars at the end of two thousand and twenty two um when we look I mean that the code talks about a monthly repayment it does. Uh but when we do this checking now we have a responsibility in that law to check to make sure they're paying back what they're supposed to and we're if if they pay the a little bit less one month a little more the other word
probably not writing a finding for there if they pay back what they agreed to over the the course of the the calendar year which is what it on an average base yes now our i'll tell you everyone's while something happens beyond our control somewhere down the road and you know that that situation might change i'm just telling you if they repaid on a yearly basis what they had agreed to we're not going to be writing of finding that they didn't make
the exact mouth for one month and so that's just for your information of the hopefully that may help okay and and I appreciate that mister channels were part of is if we've pulled out they owe this themselves and I came up with think about you know if a family has a budget and we're going to put ten percent of uh of our income into a fun for our kids college education or whatever and then kid get sickness to go the doctor so we're gonna need to tap into their little bit

legislative session in in that code twenty seven seventy two or seven which includes everything that goes into the general fun unless it's restricted so that's not just general turnback or it's not the percentage on the street turn back money it's everything else in general that be ten percent of general turnback plus those other things that go into the general and less it's a like a restricted grant or or that kind of thing
call up sir team if ten thousand hours you say a failure of ten thousand dollars in how much do they actually owe the the straight find a hundred and forty one. The hern forty two in some changes and this committee has that's what they've approved a few they've approved a few times just a dollar amount per month okay so what percent with that way about seven well i'm just various yeah on what they get in grow was good but also included and II presume that

And so for the year two thousand twenty two uh an audit agreed from procedure poor was not obtained for the water and seers system is required back home a similar finding was issued a getting back to two thousand eighteen found and cost revenue of two hundred eighty two thousand dollars exceeded thirty percent of the cities total
expenses in the procedure by thirty thousand dollars and non complaints occurred this revenue was generated from traffic satan's written arrest made by the seasonal enforcement personnel or from insurer actions related to the enforcement of traffic offences mayor charles nation kinney in place you can help her here to answer questions just a couple things before they begin last month there were some questions uhm the two thousand twenty one report for the city
grady was presented in may and we had a speed trap finding in that report as well and it was referred to the prosecuting attorney and are he has requested a state police to look at it and an investigator has been assigned in there were questions about cities in counties authorities to patrol split highways and what we learned is they do have the authority to patrol the how is within their corporate limits that's given by the year or kids are constitution
cities and cars do need to obtain authority from state police if they're going a patrol in interstate so those who are a couple of questions the the committee had for staff and the last time so anyway the mayor in the police she for here to answer questions challenged good to see here they can you deliver who you are please can you hunter chief police charles night mayor thank you for being here today this thirty percent you know this is
something that exceeds state law. On time what do we usually do in a situation I don't remember this coming up before I know which come up but not here in the last year so this particular finding these tap findings have to be referred to us by the prosecuting terry in the prosecuting attorney doesn't investigation to determine whether it's a speed repronounce we just have to do a calculation where required by law to do that calculation and prosecuting

The time of this finding year today how about that how many tickets have you given and how many of those would be considered speak trap. at one month after we did the calculation on the percentage but we looked at april of two thousand twenty two there were total of three hundred eighteen tickets written and two were for less than two miles per hour two in the month of april out of three hundred eighteen at the end of that one I asked the question of chief that I just go right chief could act able to see the greater you've hutchisons in generally
i'm going sixty five and maybe do a little bit more than the sixty five might do something almost seventy five and have here to go up the thirty day of going test some of your offices but I hadn't been stopped yet I don't know it's become they saw my tax and put out a road but anyway but but my question is as a rule but if it it since you've been the chief how many tickets have you seen that your officers have

both it's it's either if you hit either one of if it's you know the thirty if you're your fees exceed thirty percent of the expenditures and prior or it's fifty I think it's fifty percent of the tickets for less than two miles an hour that's would would trigger what we would have to send to the brasketing attack so when that's triggered then legislative since it's a prosecution attorney and then they have to make a determination and take a look at it yes sir that's yes heave legislative audit date everything they need to do or is

uhm the insummit their water and serve report to us now uhm the mayor was invited but we did receive that report recently so staff would recommend filing the report most of our second although the favorite say that all right on page twenty three bigger water works for the years two thousand and sixteen we had one finding we received a response just in the last couple of days staff would recommend
following their report most of our second although version the evening shape water department uh for the years two thousand twenty they have one finding there were no printed adjustment journals the adjustments have to be properly approved and so that was the reason for that we haven't received a response of staff would recommend deferring until we get a response although it's favorite air are moving to the next page with
this reports with funding through the responses on pages twenty four three thirty there are seventeen reports with responses are staff would recommend following these reports of you have questions we would be happy to try to insure those questions that uh one report of might be of interest is the city of augusta for the year two thousand seventeen the fundings for that. Uh private audit or their beginning on page twenty four but again and staff are
recommend following these reports if you don't have questions most found second representative care of all those in favor. K on pages thirty one to thirty three there are thirty three reports with no funding staff would recommend following those reports although it's very very say all right now we're going to go back in cover the city of the the two reports the one deferred
report and the end the two thousand twenty two on page three is the finding the reason is that the goal two thousand twenty one in two thousand twenty report was was deferred at the average is finding a couple meetings in the two the funding there's one of the findings in two thousand twenty two this almost the exact replica so on when I not read this when i'm gonna read the one in two thousand twenty two and
so that report it begins on the snaps is on page nineteen and so it's too far the first one the city paid two thousand forty seven dollars for son to the to be displayed outside city holder more or last the death of a city employee in conflict with the public purpose doctrine as interpreted by again that I won fourteen accounting procedure from especies of set forth in arkansas code fourteen fifty nine one or one through one
nineteen the city was in nine compliance with these codes and other counting procedures is notable of cash receipts and dispersioners journals were not properly maintained or reconciled to bank bank accounts were not properly reconcile receipt books were not properly mean obtained receipt for not always issued in sequence of order checks did not always have to author signatures or issued sequentially but that check numbers or issue in the general phone invoices and supporting documentation were not provided for all dispersements the fixed asset
listing was established not include all required information electronic funds transfers were used but no written policies and procedures. Exist to provide internal controls and documentation for audit in accounting purposes giving consideration to the information system best practices approved by the legislature and on committee similar issues were noted in the prior reports dating back to two thousand and seventeen so uh recorded treasure shila mangram smith is
here to answer questions on this report staff I think I would like to make just can I make a statement here before she answers this may answer some of your questions that uh you want from her but so this is the two thousand twenty two report as you know google has been invited to the last three meetings and we're we've been looking at their two thousand twenty three records as well to see how they're doing currently and so
staff listen with recorder treasurer siega magna smith and an employee from uh sir port software who they've hard to help with their bank reconciliations to that point and they've we look and they see us their record so we could look at them as for mainly we were looking at their bank reconciliations and the receipts in disparse must channels cause that was the ones that the the miserable calling while really sinner around they don't have those right there's a whole
the rest of you can't have correct so they've made progress but those reconciliations in those journals are not correct through the end of october two thousand twenty three so that we went up that's as current as we as they had bank reconciliations when we visited with them last week. So uhm we legislate of audit is notifying the committee that gold is in substantial non complaints with the municipal counting law and staff recommends the beginning of the
process outlined in arkansas code fourteen fifty nine one seventeen so what that would that means is upon the approval of this committee and recommendation by staff to begin the process in this code the code directs the legislative joint committees and notify the mayor in the city council in writing that their accounting records do not substantially comply with the missive counting or and that's the code from fourteen fifty nine one oh one
three one nineteen and so if you guys if this committee approves it the city will have sixty days after the written notification to get their records and complaints before uh having fifty percent of their turnback put it into escrow now the just so you know but the time we get notification of them that sixty day period will be just beyond the february two thousand twenty four meeting and there there are no meetings in march now scheduled meetings in march april or may so this would.
In reality they would have more than sixty days to get their records in law so staff will revise that the condition of these records that the request of the city and staff begins to the we begin to plan the two thousand twenty three engagement in february of next year so uhm we're going to be in the middle of it substantial staff will recommend that these two reports before because this is going to
be an item on the gender it's going to be if if you approve beginning this process in fourteen fifty nine one seventy we believe uh they're they're going to have some testimony beyond from my smith and then the mayor and the uh city council member will be the next item on the agenda to talk we believe their imposition more than get into complaints and the next remarks but uh they are a point where we believe staring
the process is the right right thing to do and so in the end after you hear from this smith uhm we would I guess we would if you want to go for we'll need a vote on the recommendation from staff and a vote on the filing and so that's more to want to say question chairman can you recognize it reflected tell us why we're not meeting in march there's not a well I guess
it has to do with the fiscal session april with this there's none of okay well there's not a meeting on the calendar on the legislative joint audit calendar anyway so in is my understanding that there may be a meeting in may but it would be one I guess called the will the chairs but at the moment the counter does not have meetings in march or shares authorized to call a special meeting. It can they call a special meeting in march seat

assets are miss jones is one of our one of our council members are we've heard something about the bank reconciliation it's her job she's uh she's going to take online responsibility to go back and dig in and and see where the see what needs to be uh changed we not take it in actually use but. Ah I think I can speak on behalf of the council that we are going to hire somebody
to uh to do what needs to be done to get our finances back in order with that. is a system I mean won't question that I see in here one the first findings is there was a budget that was adopted. But a budget could not be presented to auditors while they were there. But it was approved but then it was never provided so could you give some inside on there as to what happened they are ours are just a check lias that say you need to approve a budget so we check that off the list III don't I don't know for sure and I know I know the the
problem I don't know what the the the dealt that I know that they are there was a budget proved but when it came time from the auditors to uh they wanted a copy of the budget I can't be the budget could not be. Provided. In earning it seems like you said to get your books in order or get your count straight we really don't know if there they may be in order we just don't know so how can the council
attend a meeting every month and get a financial report and have any confidence at the county I read the city level. That the record you're looking at. Are are worth the paper the printed all good question and you've been there since march I have yesterday. There was a budget I had a hard time coming up fine in the budget it was on different counsel members had different pieces of paper that had different but so when I came on I tried to consolidate everything from for myself personally i'm trying to consolidate everything into a budget then I would go to miss smith.
And I would say mismath in and basically what we got every month was a was AAA bank statement and I would I would ask mismear that so you know we have this budget and the items in the in your software need to be tagged to an item in the budget.

So other so I guess i'm just i'm curious about the process of things getting approved from the city council standpoint when again back to the the point from representative baby I mean you didn't even know what you're looking at so what was that process how how could anyone move to a pro anything um a grand it I get it it wasn't provided but how could anything be approved when there
was nothing being presented so you get more that. I don't know how to answer there there is it is that the council came comes together once a month they're presented was with information they're present with the uh with a with the bank statement we have legal council it can advise is a advisers this along. And it's just difficult it's
it's been it's been difficult yet so that being said I mean wins and when did you in the clearly been on there since you said march so when did you in the council get together was that immediately when you when you became on there because II mean was this ongoing from the council standpoint of trying to figure work through this process or did that start when you became when you got on the council then III think the council has been aware of of of issues you know before before work anymore. It's just I don't think that
anybody realize the severity of the issues. Well I would be quite honest that both my mind considering that things are getting approved nobody knows what they're proof in uh to to some some rise that in a probably uh to uh to simplified it simplicity of a term but i'm just trying to figure out I mean how this behavior has gone on and on and what's what's going to be the process to stop
it because quite frankly that's what the checks and balances of a mayor of a treasure of a city council uh there to do is to stop this behavior and granted we're here today and you'll have worked through this process I just don't know that I have the confidence going forward that that's going to stop anything considering that it didn't stop it earlier and and I would not I would concur with your hesitation

anything there and in that if if you'd like for them to speak they can but my impression is they're not they're not there to fix the problem they're there to advise us on how to fix a problem in they have they have come up with a list of things for us to do fixed asset found the the and go on through the budget process and then I mean that they're given us like ABCD e that we should do. In order to to work through this
process in the way is the city at based on what the cpa farm has recommended they've given you guys of listed things you need to do so on that list we are a wheel net where I think we're current we're current on the list you might could go if the chair would permit could we as the least one want from the CPA firm to come up and address that absolutely surfer or mine could
you come to the table identify yourself if I can use the same how you guys do it dear and hamilton and a partner in the cpa for him denmark hamilton and socialists were located here in west middle. Recently did agree to plan procedures with gold the goal was to address the items. That mister jones talked about because they were quite a few
so we started with the process as this identified the problem developed procedures why sweet developed the procedures then what we do as we circle back around the procedures are developed and there we do a sort of lack of internal audit for we go back a value way to see if they've done what they said they were going to do and then we're going to write a report that can come to you guys to the city and everybody else that they could
see what they've done what step they've taken since the report came out. That's what we so if I may ask I know you are not in the position to give us a report is to where the city at google is at this moment but can you give us some sort of estimation is that the progress with the city is made based on the less yes well i'm going to answer two
ways the first one answer it is they haven't done much yet but what i've done i've seen is we went meetings all day yesterday with them and the one thing that I do see about the senior gold is they have a passion in the desire to get it right but they just don't know what to do and so what we're here to do is help them learn what to do so for example the bank reconciliation process had
never been done properly csa did the bank reconciliation csa they're button push it well I don't want to say blood places but their job is to reconcile the bank account and not go to individual transactions. So on that bank reconciliation there are a ton of transactions that are not clearly identified and that's what they have to do that's what we have to identify to we can address it so that that cash balance is correct in all the funds are correct in one less one last question is
due so. How much time do you think it might take before your firm is able to cannot give us at least a good progress report as to what's happening and how is this happening it's a great question all this is going to be within sixty days our goal is to to really degate in a value of the process the first thing I think we got to do is we got to get the bank reconcile correctly
and then the second thing I think we have to do is from the expenditure of expenditure process they're expenditure process doesn't exist for example there's not proper approvals of expenses before cutting the check it doesn't get their proper signing it doesn't get the proper approval nor does it get the proper coding because they're not referring to the budget before they write the expenditure so those are some of the things that I think we have to do to work help them get there and I think we can get him there within the time but it's really got to be honest is
dependent on deal just as much it is so you think this can be done within sixty days I think that they can be within the term mister jones you substantial compliance then you comply with this sixty days to do i'll be fixed in that after joy yesterday one supplies and and that's what we were talking about how do we get them to substantial compliance. In in a reasonable amount of time and that's what our goal is yes thank you thank you very much
representative by the low year question to and and my question is kind of going to be too part first the question is to stay off and in conducting the articles of of city governments our county governments are the auditor to perform and agency level how much time extra time and effort does it take from an old extend point when you enter an entity such as the city of google where the records ran such.
I mean disarray shambles how much extra time on that on it does it take for you to perform a discharge the date is they that you've been there in covered about your position. Okay there's I guess there's too many mark phone area that uh it definitely takes more time and that that depends on the entity uhm independs on sometimes it
nothing is easier to move through than if they have some things because we just write the finding and in it and move on or that's what we we should be doing and so we knew going to do the twenty two engagement that. We we cut to the chase because we just finished two thousand twenty one and twenty basically I guess you know I got some experience there we knew what we're looking at so i'm not answering your question specifically that depends on the
engagement but it always takes more time when the records are are not in good shape no question about. Representative how order for up sir I mean that's more by concerned sitting here is you know many times since i've been in the legislature we've had other items that legislative on it we wanted to refer to legislative article to help offset some cost and intake care of about the
other governmental in these and the capacity for you to perform the audits is not there because of of the work you have and to do already you don't have enough staff there's on the powers so my concern is when you say something like this it's easy and when what I understood you say it's more a curtain past you know what the problems are you cut and pasted in and cut straight to the chase so it does it cast to state more money it takes more time in in
man hours to perform those are it's because you haven't looked through all type of different documents so my question back to you as a city council member and a mayor in city council. Is to have your records in this state and in this fashion one like I said for your confidence level in the confidence level of the citizens of your town they can have no confidence in the records of their city council when things are in this in in in this nature and this form
but the other side is to know seeing in your position that you're creating extra work for the state and cast the state of arkansas extra money to deal with your problems and things that you should be taking care of so i'd like to know your feelings on that and and how you're going to make this top priority because it really haven't heard that I heard her george say you met yesterday and that's that's kind of II guess good to meet the day before you're going to come before
legislative on it and have to address some of these issues in public and on the record but I mean I want to hear a real commitment that these things are going to get taken care of i'm not a mere with the creative but i've been in here several times and it can like. Yeah a lot of family your faces uh that a representative from south arkansas we see the same same city in here with the same issues so I want to hear a commitment I think this what this committee would want to hear that these things are going to be addressed because this guy
can't do it for you and in the lady here I mean II kind of sympathetic to her that they she's trying and she wants to perform those duties but I need to hear a little bit more from you guys that that you're going to get this done. We did me yesterday for a lately lengthy time that was not the only meeting that we had with cpa for and we've had we've had we've had several before so we didn't we did make yesterday but that's that's not the first one that we. Uhm the only thing I can tell you
representative that that we are as a city council we are committed to doing what we need to do is for hiring somebody to come in two get the records. Or they need to be I understand your concern I need and I can't do anything but say i'm I have my head man you know it's it's a mess and and it's and and and i'm i'm part of it's there because I
didn't do what I should have done better. Ok represent your current I am just curious for things to be in such disarray was all this being posted on a book keeping system a computer as system and in order to get this all straight you're going to have to go in there and change every code for every entry for several years is that what it's going to take to make this makes sense and get everything categorized into the correct area so that you can
know whether you've been within budget or not I mean is this a is this are they using a computer. Yes march of twenty twenty they have a computer and and of software system ten point software in in the people working it had been trying to know how to code it various entries in which led your gaussian all that sort of stuff well recorded treasures

account correctly csa has the account matching in the system to the bank statement but they're hundreds of transactions that have been reconciled that we got it will like my youngest here see it they have to go and identify what those transactions are it was they do there it will sink up all the accounts and it will sink up the revenue to where those financial statements are accurate to took to what you want to see but I think that's the first step and then the second step I think they have to do as they have to figure out on
the frontier before they even could a check it goes to this account based on why the budget based on the fine and cnn get it approved before they do anything and I think if they do that it'll take care of a lot of the things that that you have in to deal with right now so those are just a couple of comments from your sir you are correct in you know it looks like before the year was start next year there should be a revenue stream and then there should be a proper
