move on to the business agenda. Senator Johnson,
you're recognized for the motion.
Senator Mark Johnson

16:08
Thank you, Mr. President. Right before we recessed, actually right after we recessed, the
House passed Senate Bill 179 as amended by 86 to nothing. This is a bill that would allow a simplified method for the city of Little Rock to change their form of government if they so chose. It was totally optional on their part and permissive. The amendment that was put on in the House was by Representative Love at Senator, at
Mayor Scott's request. And so, Mr. President, I would move that we suspend the rules and take up Senate Bill 179 as amended. Okay, stand by just a second. We, your
Speaker 24
16:57
Committee on City, County, and Local Affairs, to whom was the first Senate Bill 179 by Senator Mark Johnson, recommend that it do pass
Speaker 32
17:04
to concur in House Amendment No. 1. Okay, members,
so the motion is to suspend the rules to hear, to allow concurrence with
this bill that just got signed out of committee today. It does take 24 votes. Are there questions? Senator Teague, you're recognized for a question. Thank you, Mr. Chairman. Mr. Chairman, I thought I was

But we've never done it. Not that I can recall. Okay. Thank you, sir. Senator Chesterfield, you recognize? Thank you,
Senator Linda Chesterfield
Unverified
17:54
Mr. Chair. It is unusual that it happened, but it is something that the people of the city of Little Rock would appreciate your considering for the first time. When Mark and I agree on something, it would be helpful to
us if you would, for once in your life, do something a little different.
What the heck? Thank you. Thank you, Senator Hickey. You
Senator Jimmy Hickey, Jr
Unverified
18:25
got a question? Yes, sir. Since this involves a city manager, former government, and I hear it's just Little Rock, I'd like to know a little bit more about the amendment, because one of my cities does have that, at least one. So I want to make sure that we're 100% sure that that's not going to affect them, because I have not seen the amendment as of today. Number one, Senator Hickey, it's totally permissive.
Senator Mark Johnson
Unverified
18:48
It only changes one new methodology if a city manager form of government change. And there's also a threshold of 50,000. It applies to city manager forms that are over the 50,000 threshold. So it's essentially a little rock bill. Thank you, sir. Thank you,
Senator. I'm sorry. Senator Pitch, you recognize
Senator Mathew Pitsch
Unverified
19:10
your question. Thank you. Well, then that raises my question the same as his. I've got a city that's 90,000 plus with a city form city manager form of government
is there anything in this bill because I've not reviewed it
Speaker 50
19:24
with my city administrator or anything well
Senator Mark Johnson
Unverified
19:27
sir pitched a slight distinction as I recall Fort Smith as a city administrator form of government and this only applies
to city manager form of government changing to mayor council form Yeah, can you
Senator Mathew Pitsch
Unverified
19:41
explain that difference then? Because we call him city manager a lot in Fort Smith.
Senator Mark Johnson
Unverified
19:47
Well, there's actually the three forms. There's mayor, council, city manager, and city administrator.
And this would only apply. And again, it is a totally permissive local legislation. It does not apply to any, it doesn't force anything on. It simply changes the election procedure should a city that is in the city manager for them, over 50,000 residents, if they opt to do this. It simplifies the process. Senator Sample, you recognize? Thank you.
Senator Bill Sample
Unverified
20:19
Senator Johnson, the people of Hot Springs, I mean, Hot Springs is city manager.
Yes. The people in Hot Springs have had, I know, two ballot issues. And so why do we
need to set this in law? Because the cities can do it themselves. Yes, the
Senator Mark Johnson
Unverified
20:38
biggest change, Senator, it would allow the city board of Little Rock by a vote of the board to refer this to the voters rather than it only being through the petition process. It doesn't remove the petition process. It simply adds, if there's consensus on the city board, to refer this question to the voters.
Senator Bill Sample
Unverified
20:57
Doesn't this fall into the category of local legislation? No, sir. What do you mean, no, sir? You said there's only a part of the

city of Little Rock. And as soon as Hot Springs hits 50,000, I know y'all are a growing city with all the economic activity. Well, we

can put it on the ballot. We already know how to do that. So it's local legislation. Thank you, Mr. Chair.
All right. So we had a little latitude there. Actually, we talked about the bill. The motion, though, is
to suspend the rules to allow the bill to be heard. Are there any other questions anyone will speak for against the motion?
All in favor of the motion, say aye. Aye. All opposed? No. Chair is unable to help determine 24, so

Amendment 1 to Senate Bill 179. You're recognized to explain

the amendment. Thank you colleagues. This is an amendment requested by Mayor Scott and the one of the attorneys at the city of Little Rock to clarify some language. It removed, the biggest change is it removed a section which I had originally put in which would let the Election Commission draw the
ward boundaries. The mayor didn't want that. He wanted the city governing body to draw the ward boundaries, and I told him that was an agreed to thing, we would do that. So this was Representative Love's amendment, friendly amendment, and I appreciate a good vote. Senator Chesterfield, do you recognize? Thank you, Mr. Chair. Yes, ma'am. We passed it with only two dissenting votes, and the House passed it 86 to nothing. Thank you very much. Thank you, sir.
Okay, any other questions? Anyone who wants to speak for against the amendment? All in favor of
concurring with the House Amendment say aye. Aye. All opposed? The amendment is concurred with. Now we have to hear the

Again, it only applies today based on the current population to the City of Little Rock. It was requested by the City of
Little Rock and it doesn't force any city of any kind of form of government to make any changes unless they so desire. If it does, it simplifies the process and and allows them to make that change smoothly. Appreciate a good vote.
For an explanation of the bill, any questions you want to speak for or against?
