Mister chairman item D. is a request for the department of commerce for the division of workforce services your question the creation of fifty one new positions from their growth pull established by special language in their appropriation act the positions we used to help staff an employer FOR unemployment assistance positions will cost roughly two point five million dollars which will be all federal dollars the positions include thirty four work for specialists seven operations managers in various attorney and legal specialist positions OPM is recommended the requested positions and staff concurs. P. in and teacher's assistant positions in return for twenty five registered nurse positions the goal is to provide better medical care to their clients the state's human development centers by increasing the number of are in positions they can create a two one ratio ratio of LPNs to our ins instead of the current four to one ratio and allow DHS to adhere to best practices model because arms can perform more functions than OPM's in generally provide a higher quality of care due to education and experience OPM is recommended the new positions and staff concurs sword were given up forty five for twenty five. Hire a stay right with us with registered nurses and so this will still leave as a hundred and twenty some odd LPNs but we just realized we're trying to shift as not yes really in for cove it but we just kind of realized that are as our population is getting older and any more medical care we just have a really good result with registered nurses and I think like they said earlier they can do more than that opinions can Dale and and we think will be able to stay more staffed and we switched out some LPNs I guess around this time last year and hired registered nurses we've been able to retain them the turnover has gone down tremendously. All right talk to me about talk to me about that because what we're these a teacher's assistants doing before and what kind of gap and we gonna have of in the needs that you can provide for for this population that's a great question so I'm these teacher positions like the LPN positions stay vacant we have a large number of teacher assistants you'll see that they're very low grade there and to so we still have teachers that do the classroom work with their and with our clients and then we have re have instructors so we have higher levels that it's easier for us to hire we just continuously do not have these to teacher assistants fall so they were the ones that we decide to turn and because we did not feel like it was going to hurt our overall operations. Mister chairman item F. is actually two requests for the same thing this is a DHS request to pay hazardous duty differentials to employees at the five Arkansas human development centers in the state hospital providing direct care to code positive patients the agency is requesting the ability to provide instead incentive to existing employees and trying to recruit or came retain new employees is needed to care for clients in the facilities the cost of the differentials will vary greatly based on the number of employees caring for the covered positive clients opium is recommended the request and staff concurs. In it thank you Mr wasn't specific on this but it may include is to just going back to. the fifty one positions that were reviewed These extra people are being hired due to the. Extraordinary tabs that we're in what is the process when those are needed less or no longer needed is that part of the hiring on I know when we've had federal dollars before we've hired extra people that was in there but is that covered so it's fire both ways. An thanks senator rice so although it the request is happening during the pandemic I would say would be asking for this regardless of the pandemic in terms of kids at the five centers with the with the clientele that we have that need constant nursing care will continue to utilize these nurses the LP and like I said earlier we have a high turnover rate so if we get top heavy during the pandemic we continuously have LPNs leaving and we re balance constantly to make sure we don't have too many staff and again Matt majka to read it wasn't as much about this because I I and I will understand the need for this but in some of the other if you could address that if we're covering that such as that fifty one positions within. Right of us thank you senator rice there is always all the department's always continue to balance our funding with the personnel that they currently have an in match that up and so specially did biennium process all those We do a lot of different budget items on a monthly basis to make sure we have the funding to support our operations if any time that funding goes down then we we have to re adjust we do must also we try to do it through attrition but every now and then you know as we have an up turning down turn we may come in for a reduction in force we don't foresee that happening right now but I think everybody's knows that Back when we had the major recession back in two thousand and eight there wasn't up tick and work for services at that point in time to and that's one reason that special language was put in to allow them to have those pulled positions so they can gear up and down fairly quickly and so that is that the just standard operating procedure for all of us as we can't find a position than that positions not gonna be filled. We're paying people twenty three thousand dollars. Senator we are and and I just mission this come to work for us house. They do we do it we have a lot of difficulty with it but I'll mention that's we've come to your earlier and we have a plan in place we're trying to move those lower level employees to see an ace which is a great three and so that price will be more career path those individuals five more incentive for them to come in so we are trying to address that recognizing that ones and twos that's just that's that's a tough. As kind of pitiful what is NO three come in it. The the other three comes in at twenty six thousand thirty four and that tops out at the maximum at thirty seven thousand seven hundred forty nine dollars index with experience how does that work is the predicate our experience and and an evaluation Sefer eyes at the human development centers we have a lot of people working direct care that are in ones and twos right now we just started CNA schools and all of the human development centers so you can come to us with a high school diploma or GED and we pay to put you through school on site and move you into an of three that makes me feel a little bit better thank you. You know I've talked to you a few times about how do you do that but not only telling them but the turnover is a big issue had a hundred percent turnover I think in some positions. So as you elevate these. Wages. Not only will that help fill the positions but it'll reduce the turnover is that correct. So yes I represent lane and that's our goal is to give people more of a career path and by giving them that see in a certificate I mean they we have a good chance that they will leave me and I'll go work at a nursing home but we have that chance right now we have people leaving to go work in fast food restaurants right now so not only will we give them a career path but then they'll be more highly trained to take care of our staff and the credentialed you I mean they do go sometimes from a CNA to an LP and two and are and and we do have programs at DHS that allows them to to go to school and continue to work for us so that's what we're trying to do with the C. in a certificates thank god this plays right into what is on the agenda on half on the hazardous pay I mean that's the people were talking about that are in line into positions working direct care with people that are Covin positive at my human development centers and we're really struggling right now two and maintain staff. Well I know when the training program up to to to go to see in A was announced in Jonesborough we are public health meeting there and enthusiasm of the nurse. group there was was very high Have have there been a lot of people signed up for that or you for no longer have that training going on house that working so it is going and a couple of centers unfortunately you know we we so we're going to start that training in March and and so we and we got delayed a couple of months because everything that was going on but we have started the schools at the centers at this point I think everywhere but one and we are able when people come to us now and new hires were putting them through school immediately so our goal is to have everyone to see in a before January first and so that they're above minimum wage when the minimum wage increases even more so and that is our goal and we think we're going to get there. Mister chairman item G. is a request from the department of parks and heritage and tourism the department is requesting to surrender six positions that have been moved into their shared services division in return for two positions which will all be also be assigned to the shared services division the department requesting at a managing attorney at GS thirteen to assist with the expanded legal work of the department in an HR administrator to grade GS twelve FOR flick the scope and duties of the now signed into the combined shared services of the department OPM has recommended the request and staff compares. Stacey Hearst I'm secretary of the Arkansas department of parks heritage and tourism. And I'm David bell with offices secretary thank you. Thank you secretary Hearst I Come back to this issue periodically I have a great concern that. We are not being efficient in terms of marketing we tend to add millions and millions to the contract of Cranford Johnson they are in control of just about every advertising and public relations contract that we have in the state of Arkansas and I think we're heading in the wrong direction I think that there's a lot of the good professional people at parks and tourism and and first let me just say Cranford does an amazing job and has for decades in parks and tourism. But I think that we have some great folks that could do a lot of the work that we're paying millions for could do in house so. If this were just a you know just the information specialist position at I have no problem but the marketing and promotion director that position being surrendered what what do you have in the house to do some of this work so that we're not just continuing to hand this over to the private sector. The re arrangement that you have before you doesn't does not If fact the ability of the current staff that we have in place to do their job and they do their job well but it also I mean that the contract was C. G. R. W. predates may has been in place as you know for a very long time it is far specific roles marketing advertising online services analyzing data and so it's it's really far a roles that are not assigned to the staff and I'm happy Representative Lowery to provide you a full detail of what those responsibilities are and how we divide them and I don't have it with me at the current time but these are positions that we feel confidence not reducing the ability of the staff to do their job what can you give me a just a general idea of what the staffing levels are in the area of marketing and promotion marketing and promotion within your department. I am I can I can send that to me just generally speaking I mean I have five employees to give ten employees. We have been operating under and. Really each division has its own staff and so for example within heritage we have four P. I. as a graphic designer and a communications manager within the department of tourism is a little different they have very specific communications in PI those they have a staff of a videographer and a photographer they are all basically working on marketing the state so they are they are sharing and that responsibility and then state parks has handed three positions that are devoted to marketing and advertising and. We're hopeful that we are transitioning to a communications department that is just is a shared service and is more effective for the entire department so I'd have to look at exactly the number and I can get that to you. Well. My criticism of the expansion of this marketing to Cranford Johnson had had become somewhat muted over the years until I started seeing them getting just about every contract that's out there the used to be I've talked to people in the industry and they said that there was a general understanding sometime back is a kind of a ceasefire among agencies that mostly knowledge the Cranford Johnson was at the top of the field and parks and in reckoned tourism Betty the he gave the other agencies an opportunity to compete for other contracts will now that's not the case anymore in Cranford getting all the work and I think that we're really going the wrong direction on in this transformation process we should be coming more efficient with transformation of not having separate silos working with promotion and marketing and actually shared services so that we can start recapturing some of those millions and maybe being able to spend. Twenty cents on the dollar you know we we we have an added new parks we've got the same. The same fifty the owners the same photos the same marketing materials I mean I know you have to change it over time but it's been successful and there ought to be a point where we ought to be able to recapture and do some of that in house well to touch just a little bit on the cost of our personnel and and add the efficacy of a shared service. For twenty nineteen compared to twenty twenty so we have we look regularly at the cost of the total cost of our personnel and far. This year at the end of twenty twenty we do show a reduction in the total cost of personnel so we are moving in the right direction and that is something that we look at. At least on a quarterly basis what is the total cost of personnel for our entire department. Well. I don't see that is moving in the right direction it you know if we're wanting to become proficient and be able to use state employees to promote and market the state rather than I mean that just seems to be an argument again be made later for adding another five million dollars or ten million dollars to the contract for Cranford. We haven't done man the contract claim for Johnson is based on largely to two percent tax and in the state. Legislature when I pass that may say in that language that is to be used to promote the state and so the contract this year is based on appropriation that we've had for two years and I believe it is capped at fourteen million dollars so that amount has not changed. Yes there's a managing attorney position is is one of the positions they're adding so the queen of the transition. Amy has over the last month or two. Constantly told us how we were saving money by combining lawyers and here we are adding a lawyer and I just wondered to. how that could happen with this new transition plan. I would to let details even agree to it yes Sir. I would let the TSS speak to that or or the agency. I don't know if it's necessary I just had to get a gig in. but of a if if somebody could just tell us why they had to have this lawyer. Senator we do seriously consider every position that for we do I mean honestly we do make that assessment but we have to also rely on the day to day operations of the particular departments and I think the secretary of Hearst my speak into the details of why that's necessary. I will I will attempt to senator Teague we within the new department we have a number of legal issues that continue to a car so we do have a heavy load as it regards disputes we have a lot of land we have construction contracts we have concessionaires that we we have the garnishment this they're just it's a steady and heavy flow of issues that need legal examination in addition to that we have gosh fifteen boards and commissions we have as well we have rules that we want to bring before the legislature I'm it's a very heavy load so our thought is that we would bring in another attorney that would be well versed in all of those legal things but could also help us with policy and legislative affairs we are about to lose our legislative affairs person to commerce and we will need someone we're thinking that it could be a dual role but bringing in an attorney would be the best approach the staff you know I'm always on your side and I appreciate what you do but it seems somewhat disingenuous to be set cutting all these lawyer jobs house all of Mr Fisher's been able to talk about for months and now we're hiring one I just just want to make that point thank you Mr chairman. Thank you Sir. And the chair recognizes senator Chesterfield. Thank you Mr chair senator Hearst. How often do we let the Bee ID. The contracts with outside sources such as grant for Johnson. I believe her and her Johnson is a we review it every year but it is there are seven opportunities to renew I believe on that contract. No I'm asking do we ever let if would be it or is it just under so yeah we're going to completely do business with the same company I'm sorry we are required to put it out for bid every seven years I believe so they have seven years of. Unfettered access to. The monies from the state. It it is it is reviewed every year but yes it is the opportunity to renew it without going out for full bed is in place for seven years so we have no opportunity for anybody new and upcoming business or anything else to have a shot at it state contract because for seven years we are locked into this wanted this seven year began. I believe it I was before my time when it was put out for bid came lab was the executive director at the time but I believe we are in the fourth year of the contract he said I'm concerned too about. The the need to advertise this state. And are getting rid of the marketing and promotion director I guess this act takes cure the for the fourteen million dollars that we paid them takes care of that right. They do a substantial portion of the advertising placing of the advertising marketing the digital component the online component at the website they they do all of that I'm happy to provide all of what they do to you all in a document. And they have several other state agency contract is that correct or is the fourteen million for the whole state or is it merely parks and tourism thank you have other contracts that is fourteen million is specifically for you specifically for the Arkansas tourism contract yes is there any way to find out the total. Amend that we pay as a state to grant funding Johnson I can certainly can look into that center thank you. It is seven year renewable annually what do you do annually to determine that you would want to consist continue the contract. The we are constantly looking at performance The digital approach that is employed at CD RW provides far a lot of crunching of data and numbers and visits to the website so we evaluate that on an on going basis we also look to the two percent tax to see if that is increasing which indicates that we're driving tourism to the state of Arkansas and we have been successful the two percent tax has increased every year since two thousand and nine except for this year because of cove in. So prior to them having the contract four years ago the trend was already trending upward is that correct it had gone up for it has gone up for ten years but they've helped C. G. R. Debbie has held contract for a long time way before the the four year. Four years ago when it was and when they put it out for bid okay so can get a copy of the annual reviews yes like to get a copy those if you don't mind please yes Sir okay and then to the question of the attorney that's being hired what happened in the transformation move that made the workload increased beyond what the current attorney could handle because the way I'm interpreting the conversation is that one the transformation happen the workload increased to your agency which is necessitating have hired another attorney so give me some background you would please so when I was director of the division of Arkansas heritage I hired I deputy director that also served as the general counsel for heritage when we merged with state parks and tourism they did not have an an an attorney on staff they relied entirely on their liaison at the attorney general's office so state parks alone is a substantial load regarding legal issues there so many issues regarding land construction concessionaires as I've mentioned so it's a it's a substantial addition to the load of of an attorney plus as I mentioned we'd like for that person this additional person to serve and I at legislative affairs role and policy role. With the attorney have time to do that because what you're making it sound I mean they're gonna be pretty consumer just a legal side of things. And the annual port legislative affairs on there too we are we have a very competent general counsel who will continue to serve as the lead on disputes and lawsuits but does need some help. Just check your us the did you approach the AG about continued to help carry the load what was the response you got I'm. They are still available to our general counsel for assistance and advice but they aren't directly were involved really and our commissions anymore are in any of the issues unless the unless we need them to represent us on a daily basis they are not involved do you know how much time they were. Being asked to give prior to your determination that you have to hire the staff I'm only familiar with heritage and it was it was pretty substantial that's why when I was at heritage I thought we needed an in house attorney just because we had so much land so many easements that we were dealing with and we needed someone with I'm a legal background but also some continuity so they could manage well those on billing disputes and I just I don't have the familiarity with parks and tourism yet to know what all day. How much they were relying on the Attorney General and there are a number of things we've realized that that it would have been much better to have an in house attorney looking at a lot of their matters so do you ever get into settlements were you get claims and is that money returned to you then or was it being returned to the AG or is it now going to be returned to you if you get in the matters of litigation or is that even fall under your purview. The most recent one we had was a dispute with the reservation system and that money was returned and we had to pay it was a dispute was settled in the claims court and I'm I think it went back today if the night who then re remitted it to They reservations company. Follow up with you off line thank you Mr. The chair recognizes Representative Lowery thank you Mr chair for allow me a second round here just want to get clarification on the two percent tourism tax there's nothing in that that says that that can't be spent in house for marketing correct there is some prohibition on using the two percent for salaries before I was in my position they came to the legislature and asked for some additional ability to cover salaries it doesn't it it does say it is to be spent specifically for marketing the state but it it there's some prohibition on. Paying for our salaries marketing positions with the two percent money okay in my in my understanding of the industry fourteen million dollars on a lot of that is the placement of advertising I mean actually paying for television advertisements radio whatever do you know if Cranford receives an agency discount for those placements and then passes that discount on to the state of Arkansas they're in there and it is all of that is contained in the contract it's all outlined the the fees that they collect on placements Everything they do really the hourly rate everything they do is outlined in the contract and I'm happy to get that to you it's very thick but it does outline it very carefully when you were pulling together the information of all the various contracts the grand for it has I'll just go ahead and assist you a little bit that you can look at the lottery contract which was to it thirty four and a half million dollars a year five year contract economic development. Right as part of office of state procurement I can I can pull that information for of this committee and make it available okay either that or officer transformation I'm sure would want to know you know how much is being spent in this all this cost savings they were wanting to do we would not want to look at more competitively marketing the services and allowing other agencies to compete and lower the the terms I mean five year seven year contracts that's extremely troubling a lot changes as we all know and in the market place so thank you very much for clarification thank you Mr chair.
