Members of the council. the revenue report for may. Twenty twenty. Reflects that after. Eleven months of this fiscal year. We're currently approximately two hundred nine million. Less than the previous year in total collections. the growth rate there is a negative three point two and on a net basis we are down one hundred six million dollars gross right there negative two percent. A turning to the graph page. A you can see that to. Since the revision of March twenty third we're currently about two hundred eighty eight million ahead of. The revised forecast. They're revised forecast is a five point three eight four billion. After. You can see we are at five point one six four in that. So to make to make for cash only gonna have to have a net of two twenty in June. A. To give you an idea June is is pretty big month. June of nineteen that was six hundred fifty two million. And the June twenty estimate from DFA. Is five oh eight so you're gonna make that forecast no problem this graph is going to go up even greater. You can have a big number at June thirty. For a transfer to allotment reserve. We're gonna have to change the scale on the graph. Because it's going to be a big number. The that happens in eleven days. So we're close to the end of the year. Turning the page you can see For the month of may gross receipts. Negative three point three percent but for the years still positive two point seven so you will in the year with a positive growth rate in gross receipts however in negative growth rate in the income tax is currently about six percent. Turning one more page to page to the spreadsheet that every month we we create this. Revenue report based on treasury reports that they send us. And those are basically bank statements and the the agencies and institutions of the state or the depositors into that bank and so I just wanted to point out that near the bottom of page two. The you can see secretary state is depositor the franchise taxes of course and a couple other small accounts. Course DFA has revenue and they're gonna be the big depositors on all the general fund but just point out some others you can see on page three the spreadsheet the state auditor of course unclaimed property state commissioner of lands when he takes of lands that or or delinquent taxes and they have willing gas on them that is deposited into the general fund. Those royalties a state treasurer there and even the you can see the Attorney General I just want to point out. That over the decades there has been always set up were constitutional officers if they so choose send money to the general fund. Okay that's there's been a long history that. The last month I had a question from senator bond about the split of gross receipts that is going to the the online purchases versus the brick and mortar mom and pop stores in Arkansas we have inquired through NCSL and DFA and yet to receive any replies from either one of those and also Senator Clark ask about sector by sector job losses and revenue losses. And both in Arkansas and in United States the sector for leisure and hospitality have been hit by far the hardest with that Mister chairman I'll be glad to try to answer any questions. Richard where we have ended up in relation to the forecast had it not been revised woods two men fine up so like I mean above below how much approximately we were down to percent right now on the net so we were above A going into the end of February we were in great shape. But to now at the end of may were two percent below last year and if you remember last year we had the I think. We anticipated it was one time money due to tax cuts and jobs act in the way the corporations were paying in. We'll see how that ends up because June is is a big corporate month. And June is also the true up for all the insurance premium taxes and that's a big number for June so you think we would have met forecast. No we we never were going to meet the the the budget. According to the forecast but we were so far ahead in February I think a hundred seventy million dollars that it was gonna be a problem to make the entire revenue stabilization act budget for this year until the pandemic. Okay I know we were way far ahead I guess I'm saying is with that cushion would we have state would relief in it up with a surplus or deficit in relation to the forecast before was revised I think it's surplus all the way of the. Endemic in the associate recession has has obviously changed the cash flows but basically made up on our surplus that we would have had. Thanks. Subcommittee also reviewed involved letters concerning agency updates on delinquent rulemaking under ACT five seventeen of two thousand nineteen and I move adoption of this report. D. C.'s representatives from the following entities provided testimony three on health information systems department of health DHS division of developmental disabilities services and division of provider services university of Arkansas for medical sciences Washington regional medical system Baptist health Saint Bernards health care respectfully submitted subcommittee cochairs Senator Eddie Cheatham represent a Fredrick love I'm all for the adoption of this report. Thank you Mr chair of the peer subcommittee met on Tuesday June sixteenth the subcommittee approved the following items a reallocation of resources request for the department of Human Services various appropriation transfers various temporary appropriation request cares appropriation request a restricted reserve fund transfer and maintaining the two point one percent deduction for state central services the subcommittee also approved the shared services appropriation transfers with the exception of spending authority associated with the positions for the state plant board the bank department state securities department and the state insurance department subcommittee reviewed several other items and receive monthly reports Mr I will make a motion that is not completely consistent with the report and I just wanna give everybody a heads up on the shared services we had discussion with respect to the bike department state securities and insurance we thought that was clearly set out in the transformation legislation and should not be included but we also included the state plant board and I think the members that were concerned about that have had discussion since our meeting on Tuesday and so my motion is not going to include excluding them from the shared services so here's a motion I move to approve the peer report with the exception of allowing positions requested at the department of agriculture plant board to go into the shared services appropriation of this motion will allow the state plant board to go in a shared services thank you senator in its proper motion and we have some discussion but I want to make something really clear to the committee those of you that wasn't here for peer our personnel what ever this motion is passed in however we decide to change those positions has to be changed in the personnel committee as well so these two motions half to mere each other so remember that in your discussion because the positions for these are in both Senator I get that correct. These are these are listed in the report is items five through sixteen the committee also suspended to rules and took up the supplemental agenda them their required approval to transfer positions from their existing division level appropriations to the department level shared services appropriations the request was with the exception of those positions it had been requested for the X. pardon me the Bank department the securities department the insurance department and the position of department of agriculture that are attached to the plant board. I'll be happy to answer any questions but I move for the adoption of the report is submitted it is appropriate time. Of these positions are paid for by fees by these. Departments like the banking department interest department and also the plant board what we learned this week as a plant board position here at his or microphone yeah I moved out of the way of it I'm sorry the the plant board positions had already been shared positions within the department of act so those had already been moved in the practice of those had already been moved so that's why you're seeing those pulled out as an exception and left alone the banking department enters farmers cruise department are still funded by those fees so those position should move and the transformation law Senator Hickey can correct me if I'm wrong was actually changed to reflect that and they were still put in to search shared services this week and now taking back out to that makes sense. Okay so these positions are What would fees it what what these and they paid for by are these. The solid Jake bleed answer that for you. The the bankers the the the banking. the banks of the state pay fees to the bank department securities or secure the same way from security agencies and the insurance up I believe is the premium tax. Is paid by the premium taxes it's been the historic of revenue for the for the three agencies they're independent of general revenue and the and so the they stand alone and this sort of like this word but they are autonomous in some ways is IT relates to to general revenues. Is that correct Mr chairman that is correct and Mr bleed you want to add anything to the yes Sir a Representative one of the kind of recommendations that the rental your aspects are one of the recommendations of the transformation act had in it was to create shared services and so if you've got a multiple of departments that are combined into one large agency one of the things we wanted to avoid was it having six or seven different agencies all with separate human resources departments accounting departments purchasing I. T. where you don't need seven different I. T. directors are seven different HR directors in one department so we would create them into a shared service so that we could create some efficiencies and lower costs for all the different divisions and be able to move more those monies like the premium taxes and others to carrying out the mission of the agency ideally that might actually reduce some of the fees that are out there and being imposed on on the folks being served by these agencies. In order to do it though because these are special revenues were cash funds or federal monies we need some special procreation to allow us to cost allocate out across all those different revenue streams in a manner that can survive not just our own internal audit and legislative audit but also any potential federal audit that comes down. Okay. Thank you I do have another question Sir please don't leave table yet. Senator of RAPERT is that you insert a Clark C. yes Sir thank you very much Mr chairman Mr bleed we talked about this like yesterday. Aside from and and it's already been stated it's very clear that those three agencies are totally funded by the fees the been raised in fact the legislature several years ago might be more than twenty years ago is a release the insurance department said you're gonna stand alone pay for yourself. And they've done that and those agencies have manage themselves very efficiently one there's two things that bother me about what I see going on with this number one it was very clear when this was discussed and debated in the previous session that dealt with it is very clear that those are going to be left alone. That was that was the understanding I don't know of anybody that was involved in it did not have that understanding and so I think this that that's when the primary things that is wrong with this number two is there's been an absolute an appreciation for what those entities have done and what they do and who they serve in the importance of the roles in my opinion meaning that there are people that are within the administration that have a total lack of understanding of the prominence the role of the bank commissioner to promise the role of the securities commissioner the prominence in the role of the insurance commissioner and so I've told you that. On those on those two premises alone I I can't support any of this this going on do you not recall or would you say from my question do you not recall that we had a clear understanding your in the session that there was a separate agreement there in even a senator Hickey and center call well on no stand out of my mind were very clear on that. The I was not involved in a lot of the discussions this was obviously a very big piece of legislation a nineteen session or a lot of discussions that went into it I know that some members here worked very hard on making sure that the bill answered all their questions and several amendments were definitely added to address those three specific agencies and that language is clearly in the law yes it is so what I would suggest it I think you ought to pull pull down the effort to do that and if you want to come back and do this in the future and have the language change I think that's an appropriate thing to do but at this particular time I just don't think it's appropriate to go against really the spirit of what was agreed to and what we see in there thank you Mr. Mr. I have a question of the senator what a Mrs first reason for being against this. I missed your first reason for being opposed to this. Yes had to push a button there you go center I'm not opposed to the motion to take them out I was making clear I was I'm opposed to frankly that we're even having to deal with the discussion or because it was clearly understood originally and I I as again there is a motion but I was trying to offer the opportunity for the administration just to say we can see that and we we we agree to pull this off and pull it down. Before I give my report Mr chair let me stop and recognize that this is Jim king the one hundred fifty fifth anniversary of the freeing of the last les eaves in the confederacy in Galveston Texas and hope that as we move forward in this society that we understand we're still set fighting some of the same battles for equity in education economic equity. Adequacy of education and that maybe when another group of individuals get together such as this will be able to celebrate this is a state holiday with that I'll give the report the policy making subcommittee. Met on Wednesday June seventeenth and discuss the proposed committee fund allocations for mileage and per diem for fiscal year twenty twenty one the subcommittee recommended approval of the committee fund allocations that are set forth in the attachment to this report these balances will be effective July one twenty twenty I understand that Representative Dotson wishes to have a substitute motion I am going to move the adoption of this report as is my responsibility and I would ask that you recognize Representative Dotson for his observations. Thank you senator. Representative Dotson. Thank you Mr chair The staff is passing out a a breakdown of the the expenses for the last five years of various committees and in policy making of the day we just come off of a a fairly long rules subcommittee and didn't have a chance to really look through this order or even have the previous years information in that committee at the time so actually went through and had staff pull up the last five years worth of expenses which is in the hand out that you see in front of you and if you see all over on the right hand column all the all of the Expenses that are and read our recommended reductions over the FY nineteen to nineteen twenty and authorized amounts and the ones in green are increased. Recommended it up amounts if you look over the last five years everything except to the new recommended amount would cover the expenses on the first line item economic and tax policy if you look in FY seventeen eighteen as the new recommended amount would not cover would not have covered that years expenses and then also in the J. P. R. line item the new recommended amount of fifty thousand would not of covered that you're either so my substitute motion would be that we. Okay. So you make a motion as so either a motion substitute motion whichever chair deems appropriate I will make a motion that we adopts the recommended amounts except for line item number one which is economic and tax policy committee and increase that to ten thousand and then on the J. P. R. line item I would recommend we leave it at the same thousand FY nineteen twenty year had Had we had we're operating under currently and approve the remainder as recommended. Mr. Yes ma'am of I am not to add Representative Bragg and I came down last Wednesday look at the allocations for the previous year we found that economic and tax policy had not made it all in the previous year legislative facilities joint had not made it all the previous year thus the recommendation to reduce the amount. I quite frankly I'm not opposed to any of this simply because it is in my money. This is the decision that you guys have but it would be my responsibility to offer a substitute and that section two would be to adopt the original recommendation of the subcommittee and by the way we did have this material available Representative Dotson ask a question it was insufficient money what would happen and I told him that policy meets again and anybody who wanted more money to come before the policy committee and get that money and that has been the practice of the body quite frankly I'm not opposed to his motion but it is my responsibility represented the committee to offer this substitute motion and I would ask or sick second in that you adopt the original report. You're recognized to give the occupational license review report thank you Mr chair the occupational licensing review subcommittee met Monday June fifteenth to receive reports on occupational authorizations from the office of long term care which is in the department of Human Services commission on law enforcement standards and training state board of pharmacy state board of registration of professional soil classifiers department of agriculture and the state board of nursing and I will say there are some boards and commissions that have They have reacted very well to the military licensing legislation that we passed and some have taken the extra step of waving those fees I've licensing for our active military and their spouses so just wanted to pass that along I applied at their efforts the subcommittee will continue its review of entities that issue occupational authorizations I move adoption of the report. And AS and an expense that's reimbursed through that program some businesses are putting signage up but others are wanting to know if they can utilize those funds to actually also put radio advertisements out about their businesses and the precautions that their businesses are taking so I'm not sure others are getting that question but that's a legal question that needs to be answered. Our our people still able to apply for these grant a not not for the Speaker program no ma'am I'll close it's it's close this point the applications are that closed on may the sixth okay so notice we have been talking about for a long period of time yes ma'am are there other grant opportunities available for small businesses. Of that just didn't in the water with the with the. So they're they're couple of options for small businesses presently one would still be the P. P. P. program which a small business lending so going to your banking you secure a loan there there are still some money available a current federal law and federal laws what drives this of those applications I believe to be submitted by June thirtieth there is some discussion Congress to potentially extend that but it present it is June thirtieth they can also apply for what is known as an economic injury disaster loans with the SBA so that's available to there's also an allotment of money that has been given to the federal reserve under the the federal leaf efforts the federal reserve at this point I don't think yes stood up that program they're getting a lots of feedback I believe from Congress and business leaders to move a little quicker we believe that will also be a good Avenue for small businesses as well alright thank you so much thank you Mr. Thank you senator. we have a motion and a second for prove all those in favor say aye. The Four ninety five thousand dollars to replace ACT cooler tower on campus and I'm just wondering what that has to do with covert nineteen rainy day funds at. Kind of appears more of an item that probably should be for regular rainy day funds not cove in nineteen why we drawing this out of that that fund. I believe. Jake plead the DFA office of budget but this is a request we got from the the university and I agree but I think when we first looked at we thought sought as a capital project but in talking to the university they confirm that this was a project that they had planned to pay for this year and and they would have conducted but for the corona virus and its impact on the finances of the of the school the school was cut two point four million dollars and in this fiscal year as a result of the the budget cuts and other school confirm that they were not going to submit a request for covert nineteen rainy day money to back fill that money which of course they had that option to do instead made this request so you know when you look at it institution of higher education they obviously have a lot of different revenues coming in and I think that they had to move some things around to maintain operations and as a result they weren't able to produce the move for with this operation this this project so obviously agreed with that assessment or yes what why didn't you go ahead and. Did you explore the. Rainy day funds allocations because I think we have what sixteen million dollars still in rainy day of what will we have a couple different pots of money that we could have utilized but because this was tied directly to the financial situation that was created because of the covered virus we felt rainy day covert rainy day was appropriate. Thank you Mr believe the the rationale for this four hundred ninety five thousand it seems to me that every single institution of higher ed could say we had something we planned on covert hit now we can't do it because we got cut why are we gonna give a issue half a million dollars and not you have a and not take it not you a PD B. I don't want why we treat them differently when everyone was hit we treated everyone equally with the cuts. Like I would say every single institution of higher education make the same argument one when when you APP comes next month and so we could we could have we would have give us half a million how we gonna say no to them. That's a good question we've actually worked reach out to all the institutions of higher education just like we have all the agencies to monitor week by week payroll by payroll how they're getting through this process we've made sure that all of them are aware that the code of nineteen rainy day fund was created specifically to help them offset the costs either of the corona virus or the lost revenue and we've made sure that they know that Avenue is there if any requests come in we have for them to this committee in this case this is a cooling tower that's obviously pretty critical for the university they feel it's important so they submitted the request and after reviewing it pretty thoroughly we felt it was ballot for for this purpose. So. Your term either the only institution of higher the didn't plan properly and not prepared. Well keep in mind the budget cut from the general revenue was two point four million so the way the recover nineteen rainy day fund is set up they could have asked for a significant amount of money there is another institution of higher education I think you and mass also ask for some allocation of funding there as well I think Henderson of would receive some support so there's some other entities out there but in this case the more we looked at the more comfortable we felt with this request so in my my opinion on this is again people that if operated properly and have you know good financial been responsible are punished people that don't budget aren't doing things you know I don't say responsible but not prepared are gonna get rewarded again with more money more money more money for people that aren't being responsible those that are being responsible I just saw Senator Davis walk in like tax to operate on far less than a issue are gonna get another half million dollars because they're they're they're operating properly. So it is just something that continues to weigh on me as we continue to throw money at higher at when there are plenty of institutions in math thank you that that that we should be given this money to I'll be done. Senator MALOCH. Thank you Mr chair of the mislead about that as to a few questions and part of it's in response to senator Hester questions which I appreciate but with respect to SO you up. My figure showed that they had the highest percentage of their funding in category B. which was the productivity funding so if that's the case does that mean that SO you was actually doing what the policy goals of the state are. But by having that high percentage in for in category B. which was productivity funding based that's how I would read that yes Sir did the did essay you and and mop. By records show that is so you got cut more than ten percent of their budget in category B. and the next highest school got cut two point seven percent I know you don't have those figures in front of you but does that sound right to you from what you've looked at I know that they did take it significant budget cuts and so if a university that receives you know the a projected amount of seventeen million dollars gets two point four million dollars could in the last three of much of the fiscal year it doesn't necessarily mean that they paid poor planning budgeting. No Sir this came out to right field for a lot of phones are thank you. Representative Jean recognize you. I'm one of for an area on a different level. I've been in the legislature for ten years and I've been on this committee. And this is a capital improvement and other universities in that time to come with. Ruth problems air conditioning problems and we have all four of them through the rainy day fund this is nothing unusual this is not a request to help match salaries are travel or anything like this is a capital improvement on a state owned institution. And though this is not unusual we've done this before for members maybe in the first term of but I just wanna let you know that this is something that you don't budget for you don't budget for a air conditioner going out on north part of campus with the school going open up August twentieth of they need this and not to Ruth also add on to what senator MALOCH exceeded with this just standard practice of what we've done since I've been here for a decade but anyway that's just something I want to add into the discussion thank you. Thank you Representative Representative Senator Hester you're recognized for follow up did did went I thought we had already voted maybe a month ago or so to not hold any of these higher is accountable when they have loss in productivity funding. Now you're saying ash essay you has been hell is being I thought we were there and hold harmless on that not the way it works is and I don't have the numbers in front of me but essay you would have benefited from an increase in funding other schools would not and other schools would have lost funding because the budget cuts came in and cut category B. so those who would have benefited from the productivity funding of would have not benefited. But at the same time because those who would have lost to productivity they already had their budget cut we found herself in a situation where the policy would have in impose penalties without also imposing benefits so we came in and provided funding for those agency or those institutions that had penalties to make them whole recognizing that we weren't also going to provide benefits in effect we said we're not gonna do productivity this year so wasn't that we gave the money we can give SO you money to fill what they would have gotten instead we sent money to other aid agencies or institutions to back to what they had already lost. And I I guess just you know here and some comments from my colleagues I guess I would put the higher end on notice that it's common practice for us to spend rainy day fund on roofs that they need more air conditioners they need him so I'd say send the request in higher ed looks like this bodies open to give away all the money we have left. You're recognized so you may have answer that's not college as if he did I may have stepped out but this is the code rainy day fund so we're always going back and forth between rainy day funding covert rainy day fund so can you tell me. Why did we choose one over the other the covered rainy day fund was set up for two purposes one was to pay for direct costs of the corona virus the second was to back fill a budget shortfalls in effect for the agencies and institutions in this case when we got the request the school warranted to was that it was directly result of the corona virus did they would have done the chill replacement or something to that effect but for the effect of the coronavirus on their finances as a whole as I mentioned they did have a significant general revenue budget cuts and so we felt it fit within this category the this was why the cover nineteen rainy day fund was really created but we but we do finds capital. Projects out of the rainy day fund yes ma'am so it's it was just a choice yes and all the cities that was just a choice and then the same with the crisis stabilization units the crisis stabilization units were in category B. over at DHS within behavioral health that had been in the past paid for with one time funding is a pilot project that a couple years ago we stood up and it's something that DHS has been funding through the year with the expectation that that category be money would come back in and reimburse them for it obviously that category be money has been cut and so now they're asking for that reimbursement yep so I'm and just if I stated my preference my my preferences that I've I like that part I like the crisis stabilization units coming out of the coveted rainy day fund which was the surplus the the first one I think could to come out of the other rainy day fund as a capital improvement projects which is pretty consistent with I think what Representative Jean said so again you know I just think that's something and my last question is the crisis stabilization units is that mainly because of the revenue back fill and the not necessarily code related yes it has nothing to do the the back filling of those budgets the cover nineteen rainy day fund was set up and then after that we got the cares steering committee which shall part of set up so primarily now because that federal money is there the covered nineteen right fund is really its main purpose is to help back fill of budget cuts and help meet the media right to see it the agency I understand that one last question. Are the mental health crisis units that by my same concern is with jails and I don't want to get to that discussion but are are you see are we having to make sure what. I guess are you tracking expenses that could be encourage from having to jail people differently because of coronavirus. I do that are there in this or across the board that's a question try DHS that we can get with you on a you know that's something that of course we've been telling all the agencies once the of a pandemic really broke out to begin tracking expenses and create a flag within the accounting system so that we can track those extensions and get reimbursed for the okay thank you. Thank you Mr chairman hi I just want again to the members to know that I appreciate you bringing this to the to the ALC that was kind of the agreement that we had in as we have stated before while the law gives the six legislators the ability to prove it in situations like this I don't know about the rest of the members but I'm going to vote in accordance with the will of this body because they think that's kind of the way that we had agreed to do it up front so thank you for bringing this rather than use the process that we used when there were some legitimate time sensitive emergencies thank you. I think Senator. Senator DISMANG I believe is in certain Flippo C. thank you Mr chairman and and I just kind of want to get back to this discussion on rainy day versus coded rainy day versus restricted reserve and you know kind of the different pots that are there and I think just to. The kind of help clarify I think what you're hearing is there's comes concerns that there's a reluctance to use the existing rainy day money I would argue that this is a capital expenditure and it is probably very well needed I mean I have no idea I'm sure that it is but capital expenditures I mean that that is the purpose of the rainy day fund is for those types of needs I understand that there was a cut there's this argument we're having that it's a capital expenditure that was built into their budget but it was still capital expenditure an unexpected which that I don't understand all the back and forth that we're doing with it I would just say personally in and I think what you're hearing from number the committee members is. Let's get back to utilizing the rainy day fund for capital expenditures as it was supposed to be utilized the existing rainy day fund before the cause of it and thank you and I appreciate the let me make a comment share. Of capital improvement inspect is expenditures would require the necessary appropriation here depending on the size and scope of it might require method of finance through review committee I think that there might be some other criteria depending on the project you know building a building buying real property that sort of thing. For a capital project yeah and mean it depending on the project and I think there's somebody from DBA who might be here who could maybe help answer some of the questions on it but it can be fairly rigorous depending on the size of the project cattle projects course that include could include you know building building or what have you. The question if I can relate it was the balance in the cove in nineteen rainy day fund so it's right now it's one hundred and fifty point seven million dollars if these requests are approved that would drop down to about one forty eight point one million and costs money supposed to be rich. And so the question was this this money would be returned by June thirtieth not spent correct under the law that funding whatever the balance is in that fund would revert back to the general revenue allotment reserve which is surplus in effect. The sense say sense institutions are finding out today that. Bentley they can. They're not going to have time to send in their own request because this body won't meet again until July that money will already be returned. That money will be returning general revenue allotment reserve on June thirtieth this. So either it's it is the other institutions won't have time to send in a request that's were finding out that this is what we can use Kevin rainy day money for when originally we were told it would be used for you know things related to cope and like maybe we need to help with the funding at department of health or DHS or some medical emergencies we sat in testimony yesterday fry and doctor can't Patterson he said we would see an all time high in September as echo the cases that we were understaffed and under resource in our hospitals across the state so we're looking at projections of some of that hi this outbreaks will see possibly this fall we have a hundred and fifty million dollars sitting in rainy day funds and we're spending it on a cooler for essay you because they were productive the loss of productivity funding we've made all the schools who were unprotected we've made them whole and now we're picking and choosing schools that work productive we're letting some of them still lose their money even though they did what we mandated they do based on our productivity funding formula and now we're choosing some schools to make call are given the cool or whatever capital improvements they want and we're making other schools continue to lose funding. If we're going to do this we may as well just say Hey we have enough money the productivity funding that we've put in is around ten million dollars so we may as well just take ten million from the rainy day and fun the productivity funding model for the productive schools so they're not hurt we didn't hurt the schools that lost why are we making the schools that were productive Hey now we're just using any other schools that were predicted that didn't get there finding. They don't have an opportunity to send in a request. Last month we listen to it department of higher ed coming here with Anderson state and ask for a hundred twenty five thousand dollars. Dr Martin said there were two schools that email me when we said who's going to have trouble making payable to schools called and emailed her and said they thought that they would Henderson was one there was another school Teague and when that school St and there are questions that we don't know if we can make it. Department of higher in the phone call that institution used some words I'm not gonna repeat today and said what do you think you're doing we are in the middle of a pandemic and you're going to ask for money. So that institution never brought the request forward they cut their budget fourteen million dollars this year they haven't asked for a set in the middle of this emergency because they thought it was inappropriate because call the rainy day funds were supposed to go to fund our hospitals to make sure people work time make sure we can test we can have PT ET keep three point one million our hands and say. And today we're going to sit here and vote on a cooler. Yes you may not have any reserve fund they don't have any other money they can use anywhere else. And we're going to tell the other school sorry. Good luck to you lost your productivity funding that there's nothing we can do about it. It's wrong what we're doing and we continue to do it month after month. We pick and choose what's in which institutions. We want to find anyone in for no rhyme or reason. No reason. We do whatever sounds good because it's institution in our back door from south Arkansas or central Arkansas or northwest Arkansas but you know it hurts it hurts the kids because all those institutions have kids from all over the state coming there. Most of our schools have kids from most counties in our state so when you. To give one school money in another school not you're hurting families in your district. It's not just about the physical location of institutions in your district it's about more than that. We are almost last in higher education in the entire nation and this is how we do business it's wrong it's embarrassing. I'm embarrassed. Thank you. Senator Elliott you're recognized for a question on a. Thank you Mr chair I think one of the things that we are facing is something that we've talked about time and time again is I know a lot of people disagree up but the numbers tell the story we end up with where we are with higher ed because we have Deliberately I think in very carefully died vested in higher ed for about the last twenty five years and the chickens come home to roost after while we end up in situations like this but my my question Mr believe it is It's so originally and we talked about the cold at nineteen funds we discussed that generally when you get federal funds you may not supplant. And in some meeting sometime back we had a discussion about that and we've come to understand there's an exception made in this case it that with higher ed in that they could use money from back feeling some of the expenses that they that they had if they could make the case for it and supplanting might not be the right word for it but did you just clarify for me I'm not familiar that there's any federal dollars involved in this project yeah well but I'm I'm I'm talking first about federal dollars to get to this point this project I don't know if it's if for you what what I was talking to about that or not maybe was not you. So but in this case where we get to use and rainy day funds but as we talked about not being able to supplant and some of the dollar is somebody read I think it's Representative Lundstrum said that we could supply but that did not extend I don't think for things that came up that word new. I don't think that came that was for things that were new and it even for federal dollars so the only place folks had to go is to the rainy day funds to do what we have normally done. And if people following that process and you have indicated that you said earlier that every one of the institutions had been informed they could make applications if they needed to. Is there is some kind of communication break break down that you know what if you gave them that information that is what you said right that if they have a case to make make your case my understanding was particularly after one of the hearings here before this body and related to Henderson state there was a push by the department of higher education to make sure that the institutions were aware and that they were reviewing their finances seven do you have any notion and maybe you are not in this communications this line of communication do you have any notion of. Why it is then somebody would have been told that they are doing something wrong they should not apply. Do you have any any knowledge of that whatsoever I do not other than to say that when the cover nineteen rainy day fund was created three months ago we were looking at and much we were projecting out a much different future in a much more difficult economic environment and at that time I think we all honestly thought that we would need all of that money to just keep the lights on now the economy has responded differently federal stimulus and some other actions that were not anticipated have come in and so we're in a much different place we've not been able or not been required to hit the cover nineteen rainy day fund I think a lot of the agencies have done in the institutions have done an excellent job to Senator Davis is point of operating within their means and so one of the reasons you're seeing this request I think is that because of that we were able to accommodate this and would it be fair also alleges say in the case of as a you who thought they were going to get performance funding. That they had planned based on having that funding like any other institution if they were going to get that that funding they didn't get that so they wouldn't even have that amount of money to meet this expense so that seems a logical out flow of that would be that they would come and ask for this via the rainy day funds that's my understanding yes okay alright thank you Mr. Senator Malick you're recognized. Thank you Mr chairman I just wanted to correct arrest Mr believe if I'm correct on a couple things first of all the legislation that we passed in the special session actually specifically provided not only for some expenditures that were directly Kobe and related maybe as far as PP and that type thing but it also specifically provided for cutbacks and to back fill holes in the budget so I mean it's is that correct that the that this request or back filling the budget even though the budget expenditure might not be for you know covert supplies but the the shortfall was created because of the cut back and so is this is a proper expenditure under the legislation that was passed. Is that correct that's my interpretation. Now and and Senator Davis did not mention any specific schools but I've had discussions at length with the director of the department higher education and I actually know who that the school that a nationally indicated they might have trouble making payroll was in fact it's so you. And but because of cutbacks you know they they made is that they've they've not requested that she told me that she did it did notify all of the universities but then when the chiller goes out even though they could other expenses and they'd you know we're gonna make their budget otherwise then then they've got this expenditure and so at any rate a I think it is a proper expenditure in. Whatever at the appropriate time out I would move that we recommended I understand that to commit go to the committee of six but I would move that we recommended for approval. All right thank you of Senator Breanne Davis you're recognized for a question do you have your mind there. Can I just like to clarify I don't like to be speaking on behalf of at this that either then there must have been three because the other one was Arkansas tech university and they in fact had fourteen million. So I'm not saying this is an improper expenditure based on the wording of the law that we all understand that the purpose of kind of it nineteen rainy day was for have emerged. Senator Hendren you're recognized for statement or question. Yeah I don't I'm not sure which it is either there's again you can see why appointed this to the ALC because it's so enjoyable to make these decisions but as the sponsor of the bill let me just be clear that when I presented this legislation a couple things I made clear was that as Senator Davis said it is for the ability to respond quickly to cope with nineteen related emergencies and that's why there was a lot of debate about the approval authority in the ability to approve it quicker than waiting for another a LC meeting which was somewhat controversial was included in the legislation. But senator MALOCH is also correct the legislation and I said this from the well is also to fill holes in the budget that we anticipated to be created because of the economic downturn. And I also worked with the G. Mr believe him with the governor's office to make sure that in those cases unless it was a time sensitive emergency would go through the normal process so that's that is why we're here now you may recall at the beginning this I also ask Mister Wilson about the budget and I think all of us are pro pretty surprised that we're basically going to meet forecast for this fiscal year and that's why they're still a hundred fifty million dollars left in this fun that has not been expended because the holes that we've had to fill fortunately have been far less than what we expected. But I also think it's important for us to realize as we go through this as we've heard we may not be near the end of this yet and that hundred and fifty million dollars we may still needed in September October more than than we realized and so I guess if there is a question and it may be there for our staffer for Mr believe maybe you can answer so in June thirtieth my understanding is whether this is approved or not. We're gonna make mend up without a hundred forty seven hundred forty eight million that goes into unallocated what was that phone call again general revenue allotment reserve general revenue allotment fund so what is what is the procedure for getting those funds release for either a emergency use or for capital expenditure project at other institutions have funding would remain where it is until the legislature enacts legislation authorizing money to be pulled out of it it's basically locked there and till January yeah when we would have the ability to do whatever we wanted with it unless and so we requires legislation access those dollars at that point yeah absent some kind of a a special session it would remain there until this body took action in January. And you guys are comfortable with locking that hundred forty seven million dollars up in it in the midst of where we find ourselves in that will happen as the main function of law whether I think we're comfortable with that or not I think that's the direction we're headed okay thank you. Obviously Arkansas take as the other school that got dismissed from not get money they still have to the thirtieth to apply for those funds. Yes or the but they have to be spent by then at the same time I believe the transfer has to be made out of the Copa nineteen rainy day fund by that date so is that did they bring that request to you did you know about the request yes the request was submitted to the think the governor's office and then why was it denied by the governor's office and not brought to this. What request I'm sorry or hang up for tech I don't believe that we have that are you didn't know that anything about the tech I was not aware of a covered nineteen rainy day fund requests from Arkansas to okay alright thank you. I'd like somebody to clarify is this air conditioning system broke just wore out because when I read the letter it doesn't say that his quick and it just says that it's thirty five years old and sounds like deferred maintenance to me but is it broken is it not working because a I was on a tractor baling hay with the John Deere baler this war problem out but it's not broke it was still making hay I read that the same way you did Sir which is as deferred maintenance okay thank you thank you Mr. Senator Chesterfield you're recognized for a question I was going to move immediate consideration of. This however I said I was. You could always voted down if you didn't own it so it's not a big deal but what I wanted to know was with the moneys. I want to make sure that you have one of the institutions. That is not brought forth on the are there requested not been brought forth to this committee there is nothing to preclude an emergency meeting of council should those institutions say that we really need some money is that correct. Mister chair. The. It is obvious you're not paying attention to me I'm. Hello my question is very simple. If or is this Arkansas tech needs some emergency money as dean by their administration. And the money must be spent by the end of this month is there anything that would preclude a special meeting of council to approve that one moment. As I'm not a I guess I'm trying to understand if Arkansas tech or some of the institution needs something they can bring it to the chairs of this committee. We can do it through executive so I'm I'm all must not be for second they would have to go to the governor's office that you have been a what have to submit a letter to this committee and then we would schedule a meeting with the six day notice are we have done in the recent past we we spend the rules and have the meeting within the six days and then the six thank you so I am saying to those as those individuals representing these institutions with this amount of money left if they have concerns obviously since we're being caked around the world that they would know that they could come to this body S. one emergency meeting of council to approve those things that they deem to be important but I don't think it's if I don't think is right for us to say to an institution of higher rate like I say you which seldom comes before this body that we kill them too bad to say because somebody else can get some money. It's important that are key is to be able to go back to school. And do so in an environment where they can learn and you cannot learn if you do not have air conditioning in magnolia Arkansas. So I would ask a positive vote on this motion and that we move ahead in in in former institutions that if they have some difficulty that they try to take advantage of this as quickly as possible I'd like to also hear from doctor Markham as to why the request was turned down is she here. Because Mr believe is being asked to answer questions of what would you of which he has no knowledge so I'd like to know if somebody from higher it to tell us we we sent staff out to the lobby to see if they can find okay because I don't want us to institutions against institutions. They all have the same. Function and that is to provide our children with a quality public I'm a quality education that's what this is all about and we keep getting into this but my institution verses this institution we should all literally be in this together trying to promote higher education which is is really really needed in the states as we do rank so low in our commitment to education to higher education so I would ask you that if that indeed happen that doctor Markham explain to us why and that the request from Arkansas tech be resubmitted and that this body would come back in special session and deal with that issue. Going to the proper channels and then we can move on and help this institution today. Thank you senator. Senator Rapert you're recognized for a question or statement. I withdrawal thank you. What the just a follow up I'm I'm for the requested on general revenue allotment reserve the the money left over from covert rainy day flows to their barring a special session there's nothing that will be done without money until January but also what Mr will someone over with us we're what are we he's. The money above forecasts now that's going to flow and he predicted three hundred million is out of how much do you think what is the FAA's projection of how much we're going to be over the reduced forecast of the end of the year. We ended may of two hundred eighty six million dollars over that and we're over that amount so I think it will be in excess of three hundred million dollars here at the end of the month and so that three hundred million plus the hundred forty eight million those that will also go to general revenue allotment reserve no Sir sep some of that will run some of it will yes Sir what's the projection on that it depends on the any decision we might make regarding the revenue forecast between now and the end of the month and that's something that we're looking at discussing with the governor's office for a few you're saying if you increase the forecast at one all flow there correct but if you don't increase the forecaster in the last eleven days it will all go to general revenue allotment reserve no Sir some of the transfers will go to institutions and some state agencies that are not subject to reclaim revenue so for example the public school fund will get their peace and that will not be swept back to generate a lot members are by and large institutions will also keep any funding that will be transferred to them state agencies though will forfeit anything they receive in excess of forecast so the general revenue allotment reserve is gonna be the one forty eight that we talked about plus at least another one forty eight. it's actually a little less than that but it all depends on kind of how things work out towards the end of the month right has it administration considered or do you all have a position on going back here in the last part of the physical year and just get funding the productivity money to hire at all of them who were entitled to since we have more funds than we suspected I know we've we've sort of been focus just on the code red rainy day but we're gonna have this other amount that rotates over to general revenue allotment reserve why don't we just go ahead and find the whatever less than ten million it is sort of productivity does the executive branch have a position on doing that with the the way the revenue stabilization act works is that funding is going to be distributed regardless of any actions of what we unless we have a a pop up special session to change the law between now and the end of the fiscal year that just that the revenue will be distributed according to the RSA so of you we for example cut two hundred and thirty five million dollars out of category Hey if we project coming in about three hundred million dollars that means that all of the category a cats will be fully funded and then anything less would be transferred over to category B. and that will be funded up to however much we bring in that's just going to happen as a function of law not under the revised forecasts that you're still going with the revised forecasts right correct but some as is explaining earlier it's kind of a strange process but some agencies and institutions are not subject to require that I understand that but what I'm trying to point out is that we're gonna have more money in general revenue allotment reserve than we thought yeah why not just go ahead and find the productivity funding formula which would be fair it's what Senator Davis is brought up out of the money the extra money we could do it on a couple of it to back fill and you're talking about a million Bucks and you're still going to have two hundred fifty three hundred million dollars in general revenue allotment reserve the covered rainy day fund would be the only legal mechanism I'm aware of to to for. Under that there's nothing in the law that would allow us to take money once it's in the general revenue allotment reserve there's nothing in law right now that would allow us to pull that money now what I'm saying this body could move that money now to the productivity formula out of covered rainy day if the N. F. approved correct mom yeah we would need request to do that yes Sir hi and we can ask the division of higher ed to make that request I guess the governor gets a net but we could do that could we. When we were talking about the chiller it it was thirty five years old is that correct. That's my understanding of what the letter says yes so we've known for a while we have a thirty five year old chiller that's either gonna need to be repaired maintained it's not been a surprise maintenance item that was my reading yes. I'm to me this is something that's not covered related is something that's just normal life related we all know these things happen I'm not sure even why this is something this body would take up at this point is just a thought I don't know that even need to reply. So that we all have these things that happen I just don't know that we're we need to be in this business and there's other universities are gonna have chillers that are thirty five forty years old and they're gonna have problems. Well with the option would be to revise the forecast up to reflect some of the revenues were coming in and so that additional funding could be provided to agencies their number of agencies particularly public schools in Medicaid that operate on a reserve funds those reserve funds are depleted significantly this year and so one of the options would be if we raise that forecast up to what extent could we benefit those agencies going into next year understanding the next year is going to be difficult one thing to keep in mind is the increase that we're seeing this year is at least in part due to the tax filing deadline shift and we had anticipated that a fair amount of money would be paid in July when the deadline was moved to well we know that are a good amount of that money is actually been paid now in this fiscal year so we're seeing good revenues well above where we thought we were going to be our expectation though is that next year made those revenues will not be coming in if that makes sense do you have a rough idea and percentage how many or filing before the deadline versus I don't I don't have that entered seventy five percent I don't have that percentage no Sir okay thank you Mr chair. So if we do this so you're saying that if we do this out of this funds they're going to get this plus half. More yes depending on where we in the year okay we can't do that. That's going to be a problem. So even though I supports funding the productivity find I don't support funding it at one and a half percent. one time plus the members if we got discussions is care I'm outside the room and give her by the respect that though. Explaining compliance with statuary backing and everyone tends to be in agreement with that they've had it been checked off by the by the governor's office. But the one problem is that they don't have the time to go through the regular process and within the motion we made last time go through the regular process income before LC now they can go to the merger of the executive committee and get it done three emergency rule but what they prefer to do is go through rule the rules committee go through the regular process and so we need to do is is if yeah as body if you want them to be able to go through the regular process that we need to once again make another motion to extend the time in order to enable them to go through the the regular process I'm happy to answer any questions about this but it should be everyone's on board to be non controversy just give them the time to to finish rulemaking without having to go to the executive body so that having said that I'll make a motion to enable the bail bond licensing board the flexibility as far as timing and and actually ms Garrity do we know how what we need as far as can we set up a time frame for to sunset.
