We're going call this meeting to order I don't think we're going to have anybody else. If they are they'll be a little late but. We're going to get started. Kathy one turnover you for the for to items on the agenda thank you Mr chairman skews me way back when the first item on our agenda will be under item see cash fund appropriation increase request these will be for increase for spending authority for line items that are supported by cash fund these request or for appropriation only in the agencies have existing funding to cover these requests the first one is going to be on page 2 from the department of Veterans Affairs were in this packet see they're requesting $723000 for their veterans homes this will help them cover operational costs related to staffing and residents knees needs excuse me on the next page number 3 this is for the department of agriculture they are requesting an increase of appropriation by $60000 for operating expenses and this will cover of further promoting the Arkansas agriculture through the Arkansas grown program that they have available on the next page is one from apers that's on page 4 in your C. packet this is actually for judicial retirement they are requesting to establish re funds line item with $250000 an appropriation of that they explained that this this is for new pension administration system and allows direct deposits of the new line and appropriations needed to send rate funds to members leaving the system on the next and that does excuse me are all of the cash appropriation increase request on today's agenda. Alright members you've heard any questions on these items. Senator Hickey. Did just take and maybe staff can just do it I don't think that having trouble course with 4 but I didn't I don't guess I really understood what it was an increase. And because it said that. It was because of their new pension administration system but I don't guess I understood why that was there was a need for a a larger appropriation. For this do we understand it correctly Senator I believe it is requesting to establish this re funds with this amount because the new system they've gone to a electronic banking system and they didn't have an appropriation in order for any members that used to drop out to be able to reimburse them and so this is setting up the appropriation and the mechanism and the to be able to make those refunds rather than by cutting check warrants from the state to do it this way and Jake is here I believe he might be able to provide more information. So in Venice find Jake bills that have you want to do it but Mr chair but. I do want to ask another question because this again I don't think I have an issue with that I just don't understand. I assume we were doing the refunds earlier no matter if we were doing manual a check or whatever it appears the pension system itself is already set up I just I didn't understand why it's 0.25000000 no more dollars. Actually do the re funds it appears like is that and and I'm I my apologies I was in the temperature check line when you asked that question so I didn't hear the original question but I assume we're talking about the apers requested yes the rules laid for so retirement. Yeah that's a good question and the unfortunately the circumstances I don't have anybody from apers that I can call up here but what I can do is send a tax over to Duncan Baird who is supposed to be looking at his phone and I'll try to get you an answer as quickly as I can 8. Can we come back to that we missed yeah like we we can put this on the end and then come back that we get in touch with neighbors thank you Sir art thank you Mr Billy any other questions on any of these other items. Are not they will stand approved. You. Thank you Mr chairman the next group of items under the package indeed these are all items for approval they'll be 6 of a Muggle to amend a visually but again these are items for approval these are new up here items that allow agencies to increase the spending authority for line items that are supported by the various fund accounts not just cash appropriation our federal funding creases and so these request over 4 appropriation only and the agencies have existing funding to carry out these request again these requests are required prior approval by either this committee are the ALC peer committee so the first one on page 2 you'll see a summary of all of them and then there's other documents to support these request of on the following pages but the first one is the department of education and they're requesting and increase the preparation of $3000000 for their early intervention day treatment services and they note that this will be to support the special educational services that I've seen growth over the fiscal year and the extra information on that is on page 3 A would take each one of these separately and yes ma'am Mr will separate so that's the first one again this is an approval item for this committee are any questions on the first prove a lot of. There is 3 me a total of 3000000. House bill that maybe it is. You're recognized centrally thank you Mr chair I was a trying to determine if any of this is related to. The. Catastrophic of a cost that districts are facing or is is this just straight ahead in the summer request I can't tell if it is it is not. Could we get somebody to answer that question. And. At the same time tell us whether or not we are okay with catastrophic funding if you know the answer. I've asked mark address the this is about the early intervention day treatment act like I that's mark white from DHS and Greg Rogers from a D. E. due to join us in the room it has to do with making sure that educational programs services are still being provided to those children who are in early intervention day treatment this call request would allow us the appropriation to fund through the coops and the school districts those educational resources. What if it's a day treatments then the odds are probably pretty good that is not anything addressed in the catastrophic funds Mr chair so I I think I can make that inference from that response and I can move on. Are you are you finished after or yes I yeah thanks for any other questions. Are not. Objection items then reviewed. I think mark if you want to come on up thank you for the question maybe for you. You going for the record more thank you Mr chairman mark white chief staff DHS. Our. Senate bill if you want to repeat your question. You have to okay out of mark I think I might have figured out but I was just trying to determine if it's this is anybody related to of those students who need catastrophic by services for catastrophic issues but I had just inferred from the response from Mr believe that it probably does not for you can clarify for the not I'm right or wrong no I don't believe it does okay okay that that's fine Mr that's all I need to know thank you all right thank centrally you're welcome. Any other questions. It's not that I'm standards proved. Next item Mister chairman the next item there are actually 2 on here FOR the department of Veterans Affairs the first one is for an increase appropriation of $5000 for their state operations they know that this will be to allow them to purchase new technology that's needed due to outdated and the unsupported computers and then another appropriation for their veterans cemeteries of the item of the next item is for an increase of $108200 and this also is for the new technology and out dated and unsupported computers so that's to approval items for Veterans Affairs one in state operations in one and cemeteries. All right any questions on the Veterans Affairs request. Thank you none that objection of stand proved. Mister chairman the next item is the the documentation is on page 6 but to summarize it is the department of commerce a request to increase appropriation by $500000 for the state insurance department FOR member restitution and the this new spending authority will allow the department to return funds to Arkansas association of correctional employees trust members that were illegally obtained and again that's for $500000. Approval item. All right any questions on this. Awesome all of your where A Senate right Representative Jean you're recognized. You're recognized by my chairman can explain to me what illegally obtain. Maybe somebody from insurance or Mr believed would could claim that better I have a that's Courtney trailer the CFO for commerce to come in and she was also see if insurance at the time this is the result of work that the insurance department did involving the correctional employees trust program which provided insurance benefits but it was determined by the insurance department that they were not properly licensed to these were funds which A would be refunded back to the employees who participated in those insurance products and paid these amounts was it a scam. It was not a licensed insurance program was it a scam. It was not a licensed insurance program. Thank you. And Jake exactly how much was returned. The amount is about 490000 almost $500000 that would be refunded back okay any other questions on this item. Senator Hickey your question. Yes I guess my my next question is since he was an officer employer officer we we did. We were not carrying a top of the in top insurance that would cover this did did we look into that or did we just bypass that port. Yeah if you would identify yourself for the record my apologies for you Michael yes Sir sorry Courtney trailer department of commerce CFO. You're recognized to the I guess you're asking if the department of community corrections had an insurance you know yes if they if and I'm not for sure how that works I understand sometimes that we look at it that if we have those I believe. That are munity is only covered. Order or that we bypass are immunity up to that however if they were cut if they were carrying an Ian policy to another insurance company for their employees and officers I would think that we would would need to look at trying to file a claim on that again I don't know if they do if they don't but I want to make sure that that's been pursued before we. Just give this state money away. I can verify that the investigator did not mention out in her notes that she provided to me this morning I'm hoping that that has been pursued but I will verify that okay thank you ma'am. Senator Stubblefield is that something that we can also hold till the end so we can get some answers on that slightly thank you but that to them. Any other questions on this item. Members. R. on call contracts for that agency those are the construction related contracts on today's engine to. Any questions on this contract. Senator Elliot. Hang on just a second. Alright you're recognized Senator Elliot the question is for number one I want to know if this is replacing an existing facility that is an adequate or is this just an addition to of facilities we already have. Number one. Senator I'm not a of sure about that of an purposes here she might be able to address that or okay alright thank you. When recognize yourself identified several records amend Purvis chief of staff for department transmission shared services this is a facility that we have it will be. There needs to be some renovation the all time makes building in order to bring the other facilities and so we'll have private lease space it'll go away as we we start bringing people into the space privately space for your around this just different offices around the central Arkansas. Sir but this get rid of all of the the privately spaces around central Arkansas are just some of them yes some of them just for this FOR these opportunities and we talk about the Timex building out on bond of wherever that is what are or but not alert work which on time X. building we talking about. It's when a little rock. In little rock. About airport way yes okay alright. All right thank you. Yes recognized. Thank you Mr Aniston this is goes the staff the light of the budget concerns we have going on right now do you know of anybody of any these agencies schools anybody's pulling the contrast back because of budget concerns. Jim I know that of Jake you want to come on up the answer that. At that check we deify I don't know if this answers your question Joe but the guidance that we've given the agencies to review any contracts that they don't need or can otherwise get out of if we're bringing them to you all that means that that's a contract that that for whatever reason we can either get out of or we feel like we still need to maintain critical services so it it gets to you all then we're not doing some right on our end but we're working with all the agencies to make sure they're taking a hard look at those because what I'm ordering you say a Jake is it's been very good and. Your staff about as good with I it's been vetted yes Sir thank you. So in other words any those contract they could have gotten out of there was none of that but returned well what we ask them to do is look at them and say okay do you need these contracts to maintain your critical services understand that the the future is uncertain and the budget cuts are coming and so they're coming back to us and saying yeah we need to move for this contract and that's something that we need to look at work with them and if they we bring it to you all and that's means we a can pay for under the current budget circumstances and be we need it does anybody of I want this contract is to the priority or well I know that TSS gives them a very thorough review and of course the the contracts of a certain size also go to the governor's office. All right 8 any other questions. Without objection these are standard review. Next. Mister chairman the next group of contracts begin on page 5 these of the inter governmental contracts. The first one is career read this is an amendment to an existing contract for online system to manage the Perkins project dollars that are coming to the state the next one is corrections department this is for you a mess and this one is for overseeing risk assessments the next one is education department to evaluate the aware project the next one for education is for coaching and technical assistance the fifth one for which is for education apartment is mental health first aid training number 6 on page 6 is I education for online college and career ready in the system on page 7 health department has one with little rock ambulance with already for communications insurer infrastructure for the Arkansas Thomas system number 8 the health department with you a immense to provide a PhD scientists to will offer expertise in various programs including cancer registry tobacco prevention and chronic disease number 9 health department you a in this this one is for the trauma image repository and working on current real time access to imaging for Arkansas trauma patients number 10 of starts the one for just for DHS a person with a issue DHS has contract number 10 to 20 and the first one said I is for assistance for childcare and after school providers to prove program quality the next one number 11 is for training for childcare workers number 12 online training of being make a made available number 13 DHS for enhancing the competency of training early childhood program staff for family engagement related activities number 14 is far statewide early care and education professional development number 15 DHS for training for early childhood inclusion project number 16 DHS for a continuing to support a healthy child care Arkansas program a number 17 is to elevate social and emotional learning in Arkansas number 18 DHS contract to do Arkansas partnership FOR public child welfare number 19 is the DHS contract for providing family treatment services and number 20 DHS contract for supplemental assistance program nutrition education services contract number 21 is for the state police and this one is for their he crash program those are the inter governmental contracts on today's agenda. Alright members any questions on any of these contracts. Not these. Sorry bout that Centel you're recognized on numbers 5 and spent well I guess it's numbers. Yep 5 and 6 that's an education contract. The. 56 and 7. It appears there are all. Doing something and doing the same thing and I would just like to understand why we have 3 different people doing this the company is seemingly doing the same thing. Rather than safe pick one. The aware program yeah we're we're talking about yes indeed with Mister but number 5 is to extend contract fund college and career planning system this number 6 on 9 college and career planning system and number 7 on the same thing I just need to understand why we need 3 of these I believe there's someone from the education department out in the audience number 9 does the same thing as well. Clarify on that yes if you want to come up front in. Text. It is actually the north little rock facility that they're gonna have an or replace these DCC central office lace north rock parole office lace a little rock drug for the pro board lease the sentencing commission lease are we talking about number 5 on page 2 now I'm sorry clarifying what your earlier okay so sorry okay all right all right to you I think this is an education I think I see Greg back there at some point somebody is ready to give us a. Yeah that was for Timex that we talked about later on you. If you want to identify yourself for the record. Craig Rogers permits cation I'm sorry I missed the question Mister Rogers I'm I'm on page 2 and there are seem to be there for contracts here from different folks that seem to be doing the same thing and assault described this online college career planning system and I was wanted to understand why we have 4 different contracts with 4 different entities of. So it's going along the same line that would deal with a K. to assessment we're letting the to districts who are using that system we trying to contact those to bring the price down let everybody have the one they were already using for the career service. Already used to pay for I think it was yes and so that not I ever district was using that so in trying to bring the price down for all of them were allowed on to have a certain price if they want to use the ones that we've approved. A so is there is there is there any advantage to that apartment or somebody else consolidating these into one company I'm not saying we have to the fourth floor of getting the best cost purposes it will we were able to get a lower price for having those people in their first certain costs the lowest one that offered in but it also allows the districts not to have to go in and change everything they were already doing with one if they were using ones we had approved but also gets a chance to kind of bring him all in together so we can have a quantitative assessment of what they're going through with all of them says he'll have to be the how to be able to cross reference with each one the so we can understand the data that's on there so they're doing that they're prosper hissing yes and did I hear you say that all of these are ones that you have previously approved for the district to use when did you do that that what we did this time going through the these contracts here that's what we're doing right now. 8 and and so when you do that that the cross checking I think there's a word for that the father could not recall. Yeah yeah 41 when you do that cross check in is that something you already your just starting to do or so we don't per hoping that having them under but where we put contract out had that required that is something we can start date yes okay. And the purpose of that is going to determine whether or not all these are basically about providing what you need to provide and if it shows it does not does that well that inform us to find one and go with it rather than having for we can look at we can evaluate it once we got through being able to look at all in together yes some and not just you could that you would write yes ma'am okay all right okay thank you thank you I appreciate it thank center only any other questions. Thank. I have one question before you. Review these. 3 elements for any specific elements in any of these contracts that would meet the criteria for. The covert stimulus money. A I don't know offhand. What. Emergency. So the emergency MF Jeez maybe or some the emergency contracts will bring to you what we've done is we set up in our state accounting system a method where agencies can of flag code related expenses that we think qualify for reimbursement from the fence so as those expenses are anchored they're using that process so that we can run reports regularly and we can track how those expenditures are being made and hopefully expedite reimbursement when that federal dollars and made available to us so someone is reviewing the someone will have to the agency's right now responsible for doing that but that DFA will do it also I assume whenever we get the code fund set up and do reimbursements that's a something that presumably when the we still don't have rules from the feds on how we can spend that money or what they're going to reimburse and what they're not going to reimburse the whenever those rules come in we're gonna have to review that so that we can comply with whatever the federal rules put. Well I was under the assumption that the those funds had to be spent specifically for covert related that's what the law says yes Sir okay. Are any other questions thank you Jake. Any questions from members. Are not without objection these out of this this contract for stand. Review. Mister chairman the next group of contracts are out of state contracts they begin on page 14 of item J. the first one is for Arkansas heritage they have a contract to do stewardship services controlled Bayern's will also see some more of those for heritage under the in state contracts number 2 is crime information center FOR computerized criminal history system number 3 is DFA revenue services for online insurance verification system of number 4 through the number 9 or offer the education department these are gonna be for online college and career planning systems that takes is to page 16 contract numbers of 10 there is far begins for DHS this is one for supporting staffing for quick based applications number 11 DHS for environmental engine Toro services FOR the Arkansas state hospital number 12 is for DHS telephone answering services number 13 I DHS for qualified residential treatment program number 14 DHS for quality services reviews number 15 DHS for therapeutic foster care services number 16 is an amendment for contract for enterprise project management office a number or. 17 on page 19 is for Arkansas integrated eligible is eligibility system to a Medicaid management information system this is for the sub pharmacy integration project number 18 is the insurance department for workers compensation telephone nurse triage number 19 is parks and tourism FOR mailing services number 20 public employee retirement from banking services number 21 state police this is for transcription services number 22 on page 21 is for teacher retirement they have to they are the first one for actuarial services in the second one is amendment for their consultant services number 24 U. a fable with computer a this is for SharePoint development services contract number 25 A you a fate bill this is for SI if a student information system implementation UAMS has one there for legal representation you a P. B. has one this in original contract it was done as a sole source it's for automated student information center system the interface will work with the current and future worked a software that you a P. B. as you see a has one for a consulting services for its retirement plan and then the last one also for you see a on page 23 is for their health and wellness program for the you see a employees so those are the out of state contracts on today's agenda are members any questions on these contract. Representative Jean you're recognized I just got one on how to 28. Knows her present further in and I had seen this before we water retirement created a if the if the buying of how that works. Someone. Have represented we don't have any members of I think bill is looking but my expectations we don't have anyone from you see out there somebody give me that out of shall never have seen retirement credits as a funding source under trying to figure out what that is what that is so. Yeah hi just give it to run it out for I thank you thank you Mr chairman. Thank take you're recognized right I just the page 6. With this amendment 830 $0 to the and performance indicators of the pass system. If there's somebody here I'd like to get a little bit information on that because I don't know if 37 percent of that is state funds. Because at the top is saying 37 percent so sorry senator Hickey what what contractor you looking at what I'm doing is looking at the. Agency is Human Services. It's on page 6. I don't J. page 19 I'm sorry thanks okay and it's the amendment 8 that this there's a whole list of amendments I'm looking at the amendment 8. Force for 30 minutes. I guess my question is is. If if all that is truly because of the pass system that we set up or if there's something else in there and again I see at the top that they got 37 percent of state funds I just don't know if that's consistent across everyone of these amendments are not. I believe it's the. To the committee total Sir but in practice all right mark thank you Mr what I'll I'm no you're out said so if my question and I don't know if you've got it in front of you is going to be in in regards to that 30000000. Of for the past phase 1 and 2. And I'm for which numbers that. It's 17 it's under number 17 on the agency's Adam J. page 19. I'll let you find that. Mark is actually looking at amendment 8 there of. And referencing that. And are using safari why that was done at the purpose of it or to probably a 2 phase question yes the I want to know the exact purpose since it's such a large amount and then also probably based on that how much of that is state because I see at the top it has 37 percent state 90 north that was. Acumen total of all those and if that was federal funds is paying 100 percent of that or if the state really was paying. 1011 $0 I believe the 37 percent is the cumulative amount across this contract and so for that particular expenditure specifically it was likely a different match rate and don't have that in front of me I know that for Medicaid IT projects very often we have an enhanced match rate where the fence pay 75 percent or even 90 percent I would need to verify whether that was the case with this contract without of this typical for Medicaid IT contracts and this would been done back we're implementing the past these were big changes to our the piece of our Medicaid management for motion system that handles all the claims for prescription drugs Jones the contractor that handles that the entire drug side of that system. Okay and again I understand it's it's tough with everything we have going on with the. Code 19 but do you know exactly I mean whenever we say to add performance indicators to include the past phase 2 and 3 do you know what that actually means. The at the time that would be in when this conference first awarded that would been prior to the past AS redeveloping things and so what it would ment is we were asking the vendor to go back and add features system add capabilities that were needed to implement the passes. So this but this is for work is going to be done in the future correct I believe amendment 8 of Lee was already done for this most recent one on minute 13 the ones before you today that is to make changes and out of audit firms are stick but the question that is to make changes for a new eligibility system that is being developed as ari's and again that's we're changing the criteria for the vendor or say not new expectations for them that have developed as a result of the development of that new system and that is at the higher match rate okay and then again this nothing I'm looking to hold up but I would want to get more information I'd like to know exactly how much of that state funds and kind of some information on. Exactly what that what that means and I'll say it and they just let me know that for that for this amendment is a 9010 federal okay so the 10 percent state funds all right. So state funds around 3000000 on this yes thank you Sir thank you. Our members any other questions. On the contract. Not the standard without objection of stand. Route. Our. Members any are there any questions on these contracts. All right without objection I was then is reviewed. Mister chairman before we take up the reports that ARE on today's agenda we have one additional out of state contract that we've put under other business it's item EM in your packet this was received in time but we've already posted the agenda we knew it was coming and in order to prevent moving everything around a lot DHS has a of out of state contract with kids game in it's federally funded as well as 30 percent state funded it's an original contract in is to purchase the fingerprints gaining device software licensing training hosting and support to fully implement and maintain that fingerprints gaining solution again we knew this was coming D. at the I. S. had some special review of this and so we page place it here would like to go ahead and present that to the committee for review today as well. Eliot your question yes it is this who's been fingerprinted under this contract. It's cents kids and so I'm just wondering if it's kids. We need to get mark white back in here to answer that question. And I think they're going for him. Scores. For me but. Mark question Senator Elliott. A. The question was who's been fingerprinted with this contract sure this country's related to new fingerprint scanner seems were purchased purchasing to use for as many of the different categories of people that we require fingerprinting for across states that include child care workers would include health care workers our own employees that whole that whole group no right now the server as paper based system and we're working to move that to electronic system so that it speeds up processing time so that no of jogger facilities help your facilities they can get those kids no not standing kids is just is just unfortunately named yes ma'am that's exactly right for okay thank you. Members any other questions on this contract. The questions. Our with objections the Saddam this contract standard review. Mister chairman if you'd like we can go back to the 2 items that we held over right we have a C. 3 first see 3 yes Sir that is the it's I in item. I could see page 4 that's the judicial retirement the Arkansas employed public employed you just retirement to establish that fund the new pitch and administration system for refunding members leaving the system and. Was Jake. Did. A question on this the sun. Was. It shall retire the judicial retirement. Only if. The 3. Alright you're recognized in taking his and I guess this is for all members since were in this a Mister bared his has come back and I'd ask you ms cash flow issue he said it's not you know my my question was exactly if we've been doing it why would we need anymore money he's come back and said that he could wait on this because it be in the next biennial however he city could to they could reduce the appropriation court request down to 50 to 100 from the 250. Represent Dotson I know that's a lot of longer lines with reducing appropriations so I mean as far as I'm concerned if you know he's telling me that they had less than 20000 in distributions I mean we could limited to the 50 here if we could make that if that motions allowed in the committee so we can go forward with it. Did you make that for motion if as long as as appropriate I'm I'm more than happy lately yeah so moved on what I said we will reduce it to the. To the 50 and again that's per Mr bears request in a text to me. He said 50 to 100 so we have a motion to reduce. Reduce it from 250 down to the to 50000 okay and again he is said they have less than 20000 at this point anyway so okay should be more than enough to cover. Any discussion on the motion. The second. I have a second any discussion all those in favor say aye all opposed. Motion carries. Any other questions. Not stand is reviewed Mr chair up on the yes Sir the next one was that in the package a packet of the these where the approval items the department of commerce $500000 for the state insurance department FOR member restitution. But any questions. Hickey you're recognized okay I'm gonna make sure which 1 we're we're on the the 250 for the insurance department yes. No we're on the restitution that was paid. We're saying that we're so with a loss we're saying the same thing. Right I think Mr believe has an answer that he's gonna probably say that we did not have any in a you know insurance there so there's that's not a bill to cover it. You are correct there was no at you know insurance on the okay my other question in the I don't know if you'll know or not but. Actually we paying this to this this money to my understanding is it be restitution reimbursement to the employees okay so it's actually going back to the employees and sales yes Sir okay the whole mount the insurance department not keeping a percentage as far as you know was not that I know of okay alright okay I'm good like say I just want to check to make under percent sure that we did have some insurance that would cover that there is an emissions so any any criminal. Charges in this on this session. I can ask my recollection was that that was referred to the prosecutor. And I. The insurance department did investigate to the extent of their authority okay. Alright members any other questions of this. Thank. That was the this this was for pro. Are not stances proved. Next item. Mister chairman the only other items on our agenda now will be reports out provide you the information on what reports we have there's peer monthly reports over there you have a copy of the rainy day fund budget stabilization trust fund the tobacco settlement report and state central services and then as far as review reports there is a report of services contract amendments with no material change of those were all just date extensions and there are executed contracts under the threshold there's a report of that and then there's one critical emergency procurement amendment that was done it is to contract for managing nursing homes that were taken over in receivership so those are all the reports that we made available to you on today's agenda as well those are all the items on today's agenda alright thank you Kathy it we do have a question of. Senator display you're recognized the thank you Mr chairman this is on K. one and probably just for Mr bleed. 7. The questions just on the rainy day funds you know there's a there's a fund balance left remaining there we we dispersed 20 fourth 0 through the development Hanson's funds is there any intention or do we have any any of those dollars pledged for any other any other those preparations or kind of what's what is the plan for that rainy day fund this point. So there are no outstanding commitments in FY 20 the that I'm aware of in FY 21 there are some the fire training academy for example down in Camden but in FY 20 there are not in light of the budget situation that were in we had to go back and really reassess all the available funding that we have man and like Representative Jett asked review whether or not any plan expenditures really have to be made at the same going on with the rainy day fund okay I thank you. Are any other questions on the reports. Not stand the. Approved. Review. Of any other any other questions any other business. Not we stand adjourned.
