We're five minutes over and it's raining outside and I know people want to get home. So one of the things that I want to, so I'll turn it back over to him whenever he gets here. One of the things that I wanted to comment on was the governor issued, I guess, executive order to create an additional task force on occupational licensing. And I know that Senator John Cooper and Representative Bruce Cozart are going to be chairing that task force, I believe.
And so I wanted to recognize, so there was perhaps some confusion about what we're doing and what they're going to do. And so I think we're going to be going down two different paths, but kind of simultaneously and parallel. So I wanted to represent of Cozart to recognize you. if you want to just kind of talk us through this so we're a little more clear. Thank you. Thank you, Madam Chair.

The working group is what it is. It's not a task force. It's a working group, and this is what we did about three years ago
when I believe Senator Dismayne was pro tem at that time and Speaker Jeremy Gillum got together and put this together from the NCSL coming with 16 states from across the different places in the nation to work on occupational licensing and try to figure out and solve some of the problems. So we put that, the governor put that group together at that time and what we're actually doing is he put this back together at some recommendation from the NCSL meetings that we were at to keep this going
to try to work with our OLAC group, which is all of our licensing groups and probably some of them out there today to keep communication going and what's needed and what's going. But it actually has no legislative authority other than it will give a report to the governor, but it will not have any legislation coming out of it. No, we can make recommendations for legislation, but we would make them to you at this group. But it's nothing that we will come out with as that group will do legislation that I know of.
I don't think so. We could do it individually. Any legislative owner could always do legislation. We can't keep them from doing that. But we're here to work with the OLAC group and to coincide with anything you need us to do. But we are not here to do your job in this committee.

this point sure um thank you madam chair uh last month we had a list of of these things
come out in our last meeting and looking through the list over the last month um or from last month's meeting went through here and looked and saw then i didn't realize it before and i think probably
most of us never realized that salespeople are licensed for automotive sales and I'm not sure how many states we license a salesperson for a to be an automobile salesperson or a ATV salesperson but it sounds kind of like a I don't know what sort of training or or requirements they have to go through in order to become a licensed salesperson doesn't seem like there's a lot
necessarily it's just a fee that everybody gets charged and so looking at it it it appears to be kind of a pointless license just that we're taking money out of the pockets of hard-working Arkansans trying to earn a living for their families and I'd make a recommendation that we do away with it so that's what that recommendation is for the other one was with regards to all the various fees that they're all over the board with regards to
some of them are 900 annually some of them are 400 annually and just a recommendation that those would be a little bit more consistent with regards to what the fees are that we're charging motor vehicle or dealers manufacturers distributors and the like and so my motion would have been for further development of a recommendation prior to inclusion in the final report of of doing away with those salesperson licenses as well as making the the annual fees
for manufacturers, distributors, branches, and the like more consistent across the board. Okay. Before

and Licensing okay thank you go ahead okay specifically here we're talking about some of the license pardon me and fighting allergies that we charge in our agency. One of the things that we talked about that was discussed here has to do with the salesperson. And what I did is did a little survey of all of the people around different states that border Arkansas,
Louisiana, Mississippi, Missouri, Oklahoma, and Tennessee, and requested information from their agencies as to what they charge for all of these licenses, and we're kind of in the middle. We're a little high on some. We're a little low on others, and the only state that doesn't charge for salespeople is Missouri, and Tennessee is higher, Oklahoma is higher, Louisiana is higher, and Mississippi is a little below us, but the only state that doesn't license is Missouri,
and kind of the reasoning i think behind that has been in the past that if there's not a license for these folks if they do something that is wrong they get caught rolling back odometers which is much more difficult to do today than it used to be but they get caught doing something that's improper then we find out about it when they are trying to apply for a new license then we can keep that from happening so it's a it is a way to keep up with licensees in
the state and these are generally not paid by the individual most of the time it's the dealer that actually pays these license fees we we really don't get much complaint from dealers about it at all but you know I'm sure there's some that say they'd rather not but then if you look at all the rest of the fees again they're all pretty close around in the neighboring states as to what we're charging okay

okay the letter what we're talking here then uh these numbers, I don't have a physical agent. I'm authorized for a physical agent, but I have been doing that. So I'm the one that kind of puts these numbers together. Okay. We license the manufacturers and the distributors of the manufacturers. And these two numbers that you see right here, the 280,000 and the 77,000, 650, that's the two numbers that come from
licensing both the distributor representatives and the salespersons and with that money one of the things we do run our agency obviously but we run fairly fairly lean but one of the things that we really do with that is we have two hundred thousand dollars a year that we issue in grants to education in Arkansas. It either goes to high schools that have programs that are training technicians for the automotive industry
or it goes to vocational, some of the colleges, the community colleges that also have the vocational education. And a list of those that I think has been passed out talks about the ones that we have funded around the state. And over the last four years, we have funded approximately $600,000 in grants. And then we got permission to up that from $150,000 a year to $200,000 a year this year.
So a lot of those fees that are being paid in the way of license from, I'll say from the manufacturer and distributor representative license, that $280,000, the vast majority of that really goes into education grants. and it's going right back into helping education here in the state of Arkansas. And, of course, most of the dealers are kind of high on this because we're training technicians that can go to work, hopefully, for them later. Okay, like mechanics and?

and they need this. And if that goes away, then, you know, we sit here and we talk a lot about, hey, we need to reform education. We need to look at the trades. We need to do more here and there. but then we're going to cut off the very resource that we're using to help achieve what we say we need to reform and you're telling me that that's not going to be replaced no sir no sir okay if somebody could tell me where we can find the money to replace this then maybe i could be a little more supportive thank you

What we do is if on a license application we ask are they a felon and then if they answer that they are a felon then the dealer has to sign off on that saying they know that this person is a felon or that they've they've been arrested and what happened they have to tell the dealership what happened and then the dealership has to sign off and tell us they're okay with what happened and what what this person did they still want them. okay is

talking to some people down there about buying a car and it's a little bit different and the thing that has really prompted my question uh and and like representative richmond i've got a community college in my district that benefits from this but it it appears that this is really more of a of a head tax on salesmen is it's not really a licensing thing per se like if you're a lord i shouldn't even
use this cosmetologist i mean we make sure you know what happens when you
put this stuff on someone's head you know and so you're it's there's an educational aspect
as well as just a fee paid to the government, and I'm not, I'm sensitive to the fact that we need to fund these educational programs, and obviously this makes it easier. It's a kind of a low-hanging fruit because these people want to work, and the dealer wants to hire them, and as far as the felons, one of the largest dealers in the state is Steve Landers, and Steve Landers has been
proactive about hiring people that have have a criminal background they went to the department of corrections and he's been a to me a good citizen in giving these people a second chance and i'm sure some of them became salesmen later but you know and i applaud steve doing that and he's he's he's it's a it's a ministry to him as much as anything and i appreciate that but I come back to the fact of we're just raising a revenue rather than
doing something that has some you mentioned the odometer thing that's almost impossible to change now and I'm not so sure that that's maybe under the state police thing with the used car licensing side of things. My real question had to do with manufacturers and when you talked about a manufacturer's distributor representative is this someone that works for say Ford and they come into Arkansas
and kind of their liaisons between Detroit and an Arkansas deal is that kind of who those people are yes sir okay and and the reason that this is so interesting to me is that you're watching the the national you know it's just it's all in the news now the whole way that cars are sold now is blowing up. You've got, and I know it's used cars, but you've got the Carvana thing that's going into West Memphis. Tesla sells directly to the consumer. You go online and you place your
order and they kind of bypass the traditional dealership way of doing things. Are they, does Tesla have to sign up with the state of Arkansas? Are they registered through this, for example they sell a lot of cars here but they don't have any they don't have any dealerships i'm just
curious if are we do we have a system that is geared toward the buggy whip what may presumably be the buggy whip days of automotive distribution actually right now we do not that

is something that's being looked at very strongly all over the country not just in arkansas right now the ones that are the manufacturers that are licensed are the ones that have bricks and mortar stores here and basically our law says they're supposed to have a bricks and mortar store in order to sell into arkansas tesla is skirting around that there's no doubt about that because they are you can see them on the road all the time but our law is basically designed for the bricks and mortar stores and the manufacturers that supply product to those stores well it it

It seems to me that if somebody comes out with a new idea, they're not evading our law. They're just coming, just like if, you know, Amazon didn't have a bricks and mortar place here in Arkansas, but originally they didn't. And, of course, a lot of the other ones that do have a big box, we don't have to name anybody, everybody knows, felt there was a competitive disadvantage, and that's why we've extended the sales tax to cover them too.
and that's a good thing, but I'm just, I don't, I'm not comfortable with the idea of the state of Arkansas playing favorites in the market. I'd rather we, we be neutral in the market and let the market respond and, and let consumers kind of make that choice, and I'm, and I mean, I love seeing the money, how the money's doing good things, but, you know, maybe there's a better way to do, or maybe just be straight for everybody and say, you know, this is a tax on your dealership based on how many salesmen you have and we're going to send it to the high school and community
college rather than calling it a licensing thing and that's that's where i'm i'm doing it uh thank you for your your answers and your information if like senator hindron if you get this equivalent information on texas i would also like to see that and madam chair thank you for

chair um just so this this information your handout here uh i got after we sat down
here this afternoon same time as everybody else did so i hadn't had a chance to look through this before this meeting started um it is if your if your numbers here uh on your
revenues and expenditures if i'm adding them up correctly or subtracting them you took in about $67,000 more last year than what you actually used in expenses so your your fund balance is growing a little bit every single year and the primary thing that I'm I'm interested in and caught my eye with regards to this as we're looking through it last month was the salesperson licensing which you're saying it brings in around $77,000 a year so we're looking at basically pretty
close to the same amount especially if you have over two million dollars in fund balance i think all of us are enthusiastically supportive of educational programs particularly with regards to technical but that's kind of a separate and different debate over whether or not we should be licensing salespersons or not if it's just a collect revenue it it almost seems to me as if it's it's probably more paperwork than what it's worth for fifteen dollars a salesperson but the recommendation just for the committee's consideration that I'm making here is that we
further look at this and develop it it's not something we're not passing legislation today in fact as I understand it or I'm assuming you might be able to answer this question this is not something that we can even change today it would be a statutory change in the next session is that these fees are set by statute right yes so so we would have to whatever we decide today is just to look at it for further consideration for next year so i think continuing to develop and get more information about it there's a lot of good questions that
were asked today and we have a lot more information than we did last month on this I will, for the moment, set aside my recommendation on the motor vehicle manufacturer distributor portion of it and just focus narrowly on the salesperson. I'd like us to continue to look at repealing those occupational licensing, which is basically the difference in what you're actually spending each year.
So that would be my recommendation moving forward, or motion, I guess, that we further develop the recommendation for repealing that for the next session. okay so just to clarify

well it's a total shock to me that we're funding education through a commission and I think that raises concerns so I definitely believe we need to keep this on the table for discussion and I believe that if we're going to fund education it needs to go through the proper channels but I would like to see these programs continued and these grants continued I mean being from the automotive industry it's extremely important that we have you know our youth coming up with the
opportunity to receive this training in school and go tech schools and things like that I don't believe we'll have any trouble finding the support to make sure this gets funded i'm just not sure we should be doing it through the back door so i'm going to support the motion keep this on the table for discussion in the future all right representative cosart madam chair you know

they're trying to do is and i think they're probably trying to help their industry by finding these groups of schools that offer diesel mechanics offer auto mechanics and things that that help their industry so that's probably why they pick and choose the groups and it probably could be a local group that they're also represented in too so i'm not sure about that but but i think i like the part about the education and i know there are a lot of people that do that kind of education grants separately than what they do through the department of career

the terms that we use to refer to the certifications for the occupations themselves those are worker inspector air monitor contractor supervisor project designer and management planner in addition we have a license program for essentially for the firms themselves and for those we have licenses for contractor consultant and training provider on the the information we provided to you the contractor consultant because of the way it's defined in regulation 21 soon to be rule 21 hopefully are put together as
contractor consultant they're defined similarly so they're put together on this report in addition I'm happy to answer any questions on any of those occupations

that in process certainly we have a memorandum dated january 14th i i thought it had been submitted with the report but i apologize if it hasn't it's it's from our uh department of energy and environment our our director of the division of environmental quality and it uh essentially it directs the offices of which i'm the senior Associate Director of the Office of Air Quality to come up with essentially, we'll call it
substantially, determine whether or not an individual is substantially, has a substantially equivalent certification, should have their fee waived and be allowed to work here. So in practice what we do is we adhere to this policy and if we determine that they have a substantially equivalent license or certification, then they're allowed to work here with simply a two-hour refresher
