These are requests by agencies to increase the spending authority for line items that are supported by a cash fund account. The first item is a letter from the Arkansas Arts Council. It's a request to increase appropriation by $46,000 to a grants and aid line item. The increase will allow the agency to spend an unexpected grant from the Wingate Foundation. I spoke with the department and learned that the grant will be used to make sub-grants for arts curriculum development, summer and after-school art programs, and in-school artist residencies. The next item is a letter from Ozarka College. It's a request to increase appropriation by $500,000 to a capital outlay line item and $250,000 to an operating expenses line item. The increases will allow purchase of materials, equipment, and to make renovations possible for a technical training center in Ashfield. The new training center will offer courses in automotive technology, diesel engine repair, medical professions, welding, and construction trades. The letter states the programs will be supported by cash from the college's reserves and from grant funding. Next item is a letter from the Arkansas Rehabilitation Services, and it's a request to increase appropriation by $513,333 to an operating expenses line item for the Arkansas Career Training Institute in Hot Springs. The increase will allow extending boiler operations, security, and maintenance upkeep on the property. This request will be supported by a rainy day fund transfer, and that will come in the next section on the agenda. The next item is a letter from the Department of Agriculture, and this item was on last month's agenda. The committee sent this request to ALC without a recommendation. ALC sent this request and a related rainy day request back to Pierre for reconsideration, contingent upon the department and dfna addressing members concerns discussed during the committee meeting the request is to increase appropriation by 1 million and it will allow the department to make grants and support projects in the buffalo river watershed this letter is to establish the spending authority and the funding will come in a rainy day release and that is again on

I think Senator Irvin for her lead for her and the area legislators up there having meetings for the public, the things I didn't find out until this morning, I tried to keep up with through the news because I wasn't able to go, not on the committee, but she did invite me and I wasn't able, was the subcommittees of the Buffalo River Commission and the inclusiveness of small animal agriculture. have something further, too. Yes, sir, and I want to echo your comment about the legislative leadership and the meetings that we held. I know several legislators that are here were also at the meetings in Marshall and Jasper and provided some really good insight and feedback to their concerns and their issues and how they would like to see this move forward. Regarding the subcommittees in particular, we have not identified those directly yet. And the reason why is because we wanted that to be a joint effort between the BRCC members, the four members that make up the BRCC, as well as the governor through its executive board as well as the legislators in particular the legislators in that particular area so regarding small animal owners and small animal agricultural producers we we certainly would invite their participation to to be on those subcommittees uh for you know regarding the makeup and what we're looking at agriculture certainly would play a role in those subcommittees uh and in particular looking at you know agricultural producers that are uh that are well known well respected and within the area not someone from Little Rock but people within the area that are known respected that people value their opinions and an insight and those are those are the people that we want to serve on these subcommittees and I know that there are you know we identified at least two from from those public meetings that were held in Marshall and Jasper that that we think would be really good participants on the subcommittees we have we have not reached out to them directly yet just pending the results of this request and the

funding coming over. And I appreciate hearing that. And just to state, we're talking about a million-dollar rainy-day fund being put out there when we have senior citizen centers closing. We've got other ones struggling that we've asked for additional monies for. And while this is monies that can do some good, there's a lot of places monies can do some good. and I'm looking again as I stated before is is down the road as I try to do because I've got a short nose and sometimes I follow it but beyond Secretary Ward beyond the current administration when we have this I mean all the states of watershed may not be the Buffalo River watershed it is as critical as it is but i want everybody to understand and i want this public we need to be inclusive when we're doing things and discussing things and previously what was put out in media was that the subcommittees all the ones named and i read them last month they did not have small animal agriculture on there that is critical to this state. So, and you can have stacked committees and hopefully just having a voice of two people, especially if they are active in their other larger associations will be a voice to help balance that. So I appreciate your leadership on that. I appreciate, again, Senator Irvin and other legislators would do that. But looking beyond down the road when other things come up, I hope that's done as a forerunner rather than us catching it here.

Also, the first thing I want to say really is to thank the people of Searcy County and Newton County. The people of Searcy County and Newton County came to the meetings in Marshall and Jasper, and they deserve all the credit here. They are the ones that showed up. They spoke out loudly. They gave great input. They asked great questions, and they expressed themselves really sincerely and personally and intimately. And I give them full credit, honestly, for this. And I really appreciate Representative Ladyman, my co-chair for the House Public Health Committee, for authorizing us to meet there and to driving all that way. I really want to thank all my colleagues that drove up to those meetings. It was a long day. And then I really want to thank you, Wes, and Stacey Hurst and Dr. Nate Smith and Dr. McMullen, who came from the health department. and listened. And that's the most important word. You listened. And I thank the governor for meeting with us as well in this letter. But again, y'all were the ones there on the front lines. And you came and you listened to people. And I think that's really what this whole thing was about for all of us, was the ability to really listen to the people who are affected by this policy that we put forward and for them to have their questions answered and addressed and their input given and taken and received and acted upon. And you did that at the meeting with those two individuals. And I think they will be great. And I think there's a whole list of names that I think will be really good moving forward. Hopefully they will agree. Because the last thing I think the legislature wants to do is relinquish our ability or our job of oversight over appropriation over spending that's the legislative branches role that's our role in government to make sure we know how the taxpayers dollars are spent and that they're spent wisely and that they're spent effectively and efficiently and so the last thing that we want to do is authorize a million dollars that's just going to sit there that nobody's going to participate with because they're so skeptical right that's just a waste of us spending a million dollars sitting over there doing really no good so that's why this whole process was really important to me and to the area legislators representative Keith Slate was has been incredible on this issue Breanne Davis Jack Fortner Ron McNair all of y'all have been really really wonderful in this process John Payton, Nelda Speaks, and I know Senator Flippo was not able to be here, but he's very supportive of all of this as well. So, and Senator Rice, and so I just, I just want to say, you know, I think we, we had requested that there would be oversight and reports coming to Public Health Committee, which was, have been agreed upon as well. We are happy to meet jointly with Agriculture culture committee if we need to do that or however that proceeds or if those requests are made to us we're happy to do that because and I also think it would be beneficial to have once subcommittees are set and we've been able to have good exchange and communication on those subcommittees and the way they will function is to go back and have meetings after those are set with those people I think would be really beneficial as well because a lot of people's questions probably didn't get answered the first time in Marshall because we were trying to find out the information ourselves about what this was and how it was going to work so I think we've we've done our job well and I think moving forward it's going to be hopefully beneficial because those people that live there who are going to be affected will have the input to direct this. And I also have to say, too, that I know there's a lot of skepticism from the million dollars that was given through the private sector. I've had conversations with the Nature Conservancy about exactly where their intention is for that money, and that is to leverage or to be able to use that money to supplement the match if there's a match for a federal program they're really focused on the USDA programs and the RCPP programs which I can tell you farmers in this area and everywhere understand how those USDA programs work and representative former representative David Branscom is the head of the USDA and he lives there he's from Searcy County lives in Marshall um but they're very familiar with those programs because they do them all the time so if you know that's the intention for that money is to help with that match portion of it whether it's a city or the county or an individual farmer so i do appreciate all the communication really that i have received on this issue and so you know with that my final thing and thank you madam chair for indulging me but the separate request the separate issue is the appropriation request and jake thank you bleed mr bleed thank you for being here um because i think there was some confusion um after legislative council that might be readdressed at legislative council about the way this is a separate issue about rainy day funds and the development enhancement funds and how that's kind of commingled and how it is operated and you don't really need to address that here today but I do think there needs to be more of a look at that because to the public a rainy day fund means something and we and I say we because that's the legislative branch's job too and the executive branch we need to really kind of think through that in my opinion because it a rainy day fund was the four million dollars that governor beebe released for the drought to help with farmers and hay forage and all of that people understand that um but they they don't understand i don't think this and so i think we just need to do a really a better job of communicating and using our words wisely and um and make sure that we are intending what we are saying So with that, I appreciate this and support these requests, items for both B and C.

And we can't, as legislators, forget that Arkansas is our number one. Our number one growers are here in our state. now in Section E. These are miscellaneous federal grant appropriation requests. These are requests by agencies to increase spending authority at federal funds resulting from an unanticipated federal grant award. If a grant expires, state funds will not be used to replace federal funds unless it is later appropriated and authorized by the legislature. The following requests have received an approval recommendation from DF&A and are sent to this committee for review. The first item is a request from the Department of Health. It's to request for 2.4 million in federal appropriation and to establish one position. They have a grant from the CDC and it will fund projects related to the increased ease of use of the prescription drug monitoring program and education for prescribers, opioid misuse, and drug overdose surveillance and prevention, linkages to care for substance use disorder, education and awareness of opioid crisis, and support to partners like the Arkansas Crime Lab and the Arkansas Drug Director. The position, that's an epidemiologist, be reviewed in the personnel committee later today for title, class, and grade. And this item is 100% federally funded. The next item is a request from the Department of Education, Division of Elementary and Secondary Education. It's a request for $4.8 million in federal appropriation. They have a grant from the U.S. Department of Education to advance literacy skills. Funds will be used over the next five years to provide access to books, materials, resources and activities, and for professional development. This item is 100% federally funded. The next item is from the Office of Attorney General. It's a request for $96,000 in federal appropriation. They have a grant from the Office of the Inspector General to investigate and prosecute Medicaid provider fraud and patient abuse or neglect. This item requires a 25% state match, which is $32,000. I spoke with the AG's office and learned the state match will come from their general operations fund which is supported by state central services but they said there's a possibility that it also could come from the consumer education and enforcement funds madam chair those are all the items for mfg's question senator arvin

have the quarterly and monthly reports. Various provisions of law, either in Arkansas Code or in an agency's appropriation bill require making reports to ALC for information purposes. In some instances, a member of the committee may request an agency to submit a report regarding a matter to keep the committee better informed and updated. The first report is for DHS. It shows quarterly interagency and division match fund transfers as required in special language. The report shows over $3.1 million in transfers from the individual division's fund accounts to the corresponding grant payments accounts. The next item, and Madam Chair, I have to apologize, I did miss a print. So we have the second page of the AG officer's report, and so staff will be handing that out. And this report shows the quarterly cash account activity. The report details five settlements, and at the bottom of the first page is the current balances of unappropriated funds. And in the pages that are being passed out by staff, it shows the clearing of cash receipts, as well as disbursements for the consumer education and enforcement. The next report is for state police. It's a report that shows the asset forfeiture expenditures for each quarter of the fiscal year. The report shows $80,000 in expenditures for the first quarter out of the TPC0100 fund. This is the fund for federal asset forfeiture. And the next page, it shows 53,000 expenditures in this quarter out of the TPC0200 fund, and that is the fund for state asset forfeitures. The next report is for federal grant applications, and it shows all federal grant applications by state agencies in the first quarter of fiscal year 2020. The next report is federal grant awards, and this report shows all federal grant awards to state agencies in the first quarter of fiscal year 2020. The last quarterly report is from ADEQ, and it's a status report on Bella Vista hazardous waste removal. It's a report required by special language passed in the last session. The agency received $20 million in additional appropriation and the ability to receive $10 million in loans from the Budget Stabilization Trust Fund to remediate the underground fire site in Bella Vista. According to the report, total expenses occur by the state to date are $955,500 and will be paid out of the Hazardous Substance Remedial Action Trust Fund. A loan from the Budget Stabilization Trust Fund will not be required. While Phase 2 was in development, the Bella Vista Property Owners Association assumed ownership over the project and completed fire suppression in June. The property owners groups is currently working on an official restoration plan total expenses to the state are expected to be under 1 million and the report states agencies actively investigating potentially responsible parties who could be held liable to the safe for costs of the remedial or recovery actions at the site once on september 11th the agency executed an administrative order where thomas fredericks and fredericks construction company agreed to pay 70 000 for potential cost recovery liability and 6 500 for a civil penalty the time period for the comments on the order has not yet elapsed and the report continues that the agency will continue to seek cost recovery when the investigation is complete and there's a final accounting of all expenses incurred by the state. The next report, G2, is for the Budget Stabilization Trust Fund, and it shows cash flow loans throughout the fiscal year.
