Thank you, Madam Chair. May I go ahead and present? Yes, please. So this is the directed trust bill that we passed a few weeks ago. It went down to the Senate. This amendment is very simple. Number one, it adds Senator Malik as the Senate co-sponsor. And then it just does clarify that a directed trustee has a duty to comply with the direction of a trust director within the scope of his powers although the wording of the amendment is not
identical to the uniform law the Uniform Law Commission has now approved it and it is it is uniform so now we have the Arkansas Bankers Association Arkansas Bar Association and the Uniform Law Commission are all supportive of this bill and that's all it does and I would entertain any questions first members are there

He didn't want to hold it up on the House floor, and so he asked me just to add in one sentence that says, at the first time of arrest, and you will see that on the amendment, and that's the concurrence that you see before you. And so if you don't have any questions, I ask for a due pass on the concurrence.

The only changes made in this particular bill when it got on the Senate end is they changed a shall, was changed to a may, and then they also on line 12, they put an after final adjudication. Thank you, Madam Chair. Committee members, this is the bill where we enhance the penalty for intimidation of a witness, a juror, or tampering with an investigation. The only change that was made on the Senate end was the tampering with evidence or with an investigation. We had elevated that or enhanced that from a Class A misdemeanor to a Class D felony. They changed it that informing or testifying to change or to tamper with that investigation would still remain a Class D felony.
However, everything else in regards to that statute would also remain as a Class A misdemeanor. That was the only exception in the amendment they made on the Senate end. Members, are there any

Thank you, Committee. This is just to concur and send an amendment. Basically, if you recall, when this bill came through, Initially, we had that the penalty would be enhanced for drug paraphernalia with respect
to any Schedule I or II substance, and there were some comments made. We specifically wanted to target heroin and fentanyl because those are the drugs that we're having the most problems with currently, and so any Schedule I or II substance was pretty broad, and while I don't think that that was necessarily wrong or bad to do it that way. In the Senate, they said, let's specifically target the drugs that we're having a problem with, again, which are heroin and fentanyl. And so in the Senate, they replaced Schedule 1 and Schedule 2 with simply heroin and fentanyl. And that's what the Senate amendment
does. And make a motion to pass or to concur in the Senate amendment.

Thank you, Madam Chair. House Bill 1789 is my adoption bill that we heard in the committee. Sent it down to the Senate, got a significant haircut, came back 11 pages lighter. So now we have, it's same wording as before, it's just missing the third section.
The five attorneys that I'd mentioned that were in opposition now are just neutral. they're in full support of it so is the bar association um if you want clarification on anything but like i said we've already seen the bill so it's just cleaned up representing collins
