And uh we recognize my co-chair uh Ward Law for, uh, Adam B for consideration adoption the final recommendation on the firearm concealed carriage law study. Members, thank you, Mr. Chair. Members at our meeting on October 17th, Representative
Josh Miller presented the final report to draft legislation of the ALCam and Fish State Police Subcommittee firearm Study. We voted to adopt the recommendation of draft legislation. Under the procedures for this study, they were adopted by AOC in August of 2023. This subcommittee was tasked to considering the recommendations of the game of fish subcommittee, making any revisions we feel needed and then providing final recommend ations to the full ALC based on discussion of members in this subcommittee, I propose
We send the 4 ALC all recommendations of the game and fish subcommittee with the following two additions, which were are included in your packet. JLC 152, which is a bill to prohibit local governments from regulating knives or knife making components. And before I read the second one, I will say that these bills were discussed in the game of fish subcommittee. So these are not true new additions. Section 21 of JLC 174, which amends Arkansas Code 115117 to allow an employee of a private employer
to store his or her handgun in his and her vehicle in the parking lot of a private employer. Your packet includes an updated final report of the subcommittee, the report of the game and fish subcommittee and draft bills is presented on October 17th. JC 174 with the new section 221 and JLC 152, which is the knife bill. At this time, chair, I would move for adoption of these documents as final recommendations to the firearm and concealed carry law study of the AOC and I'll be happy to take any questions.

We, uh Representative Aman apologizes for not being able to be here today, but he's out of the
country in France and uh for a long planned visit, so he couldn't be here, but um what we're recommending and asking for your consideration, uh, and recommendation to the Legislative council is that uh the hospital and Medicaid committee that you, uh, we have in the legislative council, be renamed and include and But it would read hospital, Medicaid and developmental the
uh disabilities, uh, study, uh, subcommittee. Um, and that to me, it was relate to matters concerning protection and advocacy for individuals with developmental disabilities and examination of the activities of entities, um, designated to care. to carry out their duties, uh, in this state in regard to these institutions, so that would be our recommendation.

OK, members next up we have, uh, Mr. Kyle Halls from Uh, per night or is going to have a Presentation for us. Thank you, sir, for being here, if you will. State your name, who you're with for the record. So Kyle Hall, I'm a principal consulting actuary at Per night.
I'm also the director of our, uh, risk strategies and solutions, uh, department. So what we've done here is we've drafted two requests for a proposals there for two different types of vendors. One is a captive manager and the other is for uh brokerage services. Um, I'm assuming everyone has a copy of at least one of these, OK. So I'll just go through this, um. you know, fairly high level
here, um, you know, it's a draft if and when this becomes approved, we'll, we'll remove the, the draft language, uh, we start with just the table of contents, get into the uh the introduction and, and the purpose. The main thing, uh, one of the main things here is a calendar of events, and that's on. Uh, the 4th page or 5th page depending on which file you're looking at, uh, so tomorrow, uh, again, if this receives approval tomorrow would be the release of the proposal, um, we're giving
the vendors until 3 weeks, so that's until January 10th to respond in terms of any questions they have on the RFPs, uh, a week later, we plan to address those questions and by the 22nd we asked the vendors to give us a notice. their intent to respond from then the responses are going to be due on the 31st, and, uh, the next week we'll notify the vendors who are advancing to the next phase, and, uh, and then a week after that, which is
February 14th, is the release of the demonstration instructions for that next, uh, phase. So the roles and responsibilities essentially it's going to be uh myself and my team at at per night essentially doing kind of the first set of uh uh releasing the RFP also, uh, we will be doing the initial vetting our thought is that we would get maybe up to up to a dozen or so, uh, vendors that would respond to each of
these, and our goal is to try to narrow this down to maybe 2 or 3 that the executive subcommittee could evaluate uh and and essentially decide to move forward with. Um, and then we move on. So most of this just goes into kind of the, the rules and, and, uh, the requirements that uh we are asking of the vendors. Um Section 27 it talks about the evaluation process and and ultimately what we're uh gonna be looking at uh from the
features, the benefits and the approach to the experience and qualifications of the vendors, uh, to the references and ultimately the pricing as well and it shows the weighting that we're gonna use, uh, when we make the, uh, selections here and again, per night's piece is just to go through and and whittle the field of uh vendors down to probably the top 23, or, or possibly even 4. if, if there's 4 really good, good vendors, uh, that would fit the role. And uh from there, then it would be up to the subcommittee to,
uh, to finalize the decision on, uh, you know, on, on the specific vendor. Um, and then section 3 just talks about the, the scope of services. These are a little bit different between the captive managers and the brokers, but in essence it's everything that we would need those vendors to do, uh, 32 talks about the proposal format and um exactly what we're looking for and, uh, Ultimately then in um 3 2.7.
These are some of the uh certifications and disclosures that we've asked for, um, there's a signature page, uh, at the end. So, Uh, that's all I had. Are we still kind of looking at something similar to the state of Tennessee. In in terms of the structure and everything, yes, yes, OK, that's exactly it. Have we, have we come to a number yet, um, around what kind of the the capitalization would be in terms of infusion of fund from the state initially. No, we have not finalized that yet. Uh, just a
quick update on that, we, uh, finished our, uh, actuarial study using data through 9:30, so we have a better feel for the potential claims and losses for the upcoming funding year. A lot of those. that the answer to that question is going to depend on the renewal terms that we get from the carriers on this, so we wanted to uh be able to find out exactly where the ideal place to, uh, put the captive will be, but it's likely the captive will retain, you know, pretty significant amount of risk. I just can't comment at this time
in terms of what the capital requirements would be. I, I was just gonna say we haven't gotten that far yet. Follow up, Mr. Chair. Uh, and then have you had a chance to look at all relative to, uh, FEMA and captives, uh, Tennessee is experiencing an issue right now, uh, on, um, Helene specifically relative to some significant claims and FEMA is not recognizing, uh, that they have a captive and there's causing some issues. So I'm curious if we've gotten that far. Um
As well as far as claim payouts and potential situations. Yeah, it's, it's on our to do list, um, Jill, I don't know if you want to talk about it in more detail. Go ahead. Thank you, Mr. Chair. We're, uh, going to set up preliminary discussions with
them, um, prior to y'all, uh, drafting up your legislation just to find out what their concerns would be to make sure that you, y'all can take that into consideration as you, as you move forward.
