In chair sees a corral. Thank you. Thank you, Senator Scott, for OK, Senator Stone. You have a Senate Bill 251, you. This be Senate Bill 251.
Senator Matt Stone

You would, uh, state your name for the record and you recognize, Matt Stone, state senator, District 2. Members, I have a bill today. Um, that is brought by an agency, the Arkansas Trails Council, um, has one member that serves on the Arkansas Department of Parks, Heritage and Tourism Council and under current law that member must serve as secretary. Of that council they just want to remove the stipulation that that is not mandatory for that person to serve as a secretary. OK.
And members have questioned of Senator Stone? Seeing none from the committees, anyone in the In the audience, wish, wish to speak for or against this bill? So no stone, would you like to close your bill? I'm closed for the bill and I make a motion to pass. do pass. Senator letting is 2nd, all in favor say aye. All the poll say no. Thank you. Senator Ervin is not here. She's on insurance and commerce. Uh, I don't see Rodney
Baker, uh, I could run that. I went outside looking for him, but industry is not here to speak on that, so I'm not going to entertain those bills since the sponsor's not here. I did tell her I'd run them for her, but, uh, industry's
not here on that, so I will not. run that. Uh Anyone here run Senate representative
Speaker 14
2:08
Shepherds. That OK, holder, you have a question.
OK. OK, that's fine, long as he gets here.
There you go. We'll look at House Bill 1413. Senator Stone, you again recognized you got off the

mic, recognize yourself, uh, Matt Stone, state senator, District 2. Uh, members, I have a bill today that deals with the brine production currently when um producers extract brine out of
the ground. It's in a unit and that unit could be as little as maybe 1500 acres up to maybe 20 or 30,000 acres of production. A unit is set up to make sure that all the royalty owners in that unit are treated fairly and equitably. But as units depleted minerals over time, sometimes for sake of efficiency, units need to be expanded or contracted. And what this bill does is let the producers move um units, move acreage from one unit to
the next for the sake of efficiency without diminishing their uh without diminishing their right to return on their royalties and everything done under this bill would be regulated by the oil and gas commission and no acreage could be moved from one unit to the other without the oversight and permission of the oil and gas commission. And with that I've entertain any questions? Um
Senator Jimmy Hickey, Jr

Um, I yeah. I, I just want to make sure I fully under that I understand this. Don't, don't think I need a disclosure, but I do have properties in this. What's probably the lithium designated thing, which is going to be a product of the Brian. So I will say that, but So As of right now, like if you're in oil and gas or whatever, and they begin pumping. It's within like a certain contiguous. Weigh-ins that then they pay all mineral owners. Is that correct?
That's my understanding for sure. Are we, does this do something different? Is that the
Senator Matt Stone
Unverified
4:37
way I'm reading that? But the, the way I understand it, it just allows them to move acreage from one unit to the next for the sake of uh production efficiency, but Mr. Chair, if you would, if you would allow me, I could like to bring Mr. Mark Day to the table, and I think he can speak to
that question, Senator. Pa, this, uh, Senator Crow's chair around y'all can both sit on the end. Steve you would uh introduce
Mark Day

yourself for the record and you're recognized? Yes sir, Mr. Chair. My name is Mark Day, and I'm the public relations, um, and, uh, land manager
Senator Jimmy Hickey, Jr

at Lanxus in El Dorado. I, I want to make sure I fully understand what you all are doing, so and. You have to get a simple for me, that's, that's good. So I'd rather, I'd rather know it in, uh, ABC if I need it.
Mark Day

So we have what we have is we have 3 ron operating units. Um, we have a
West unit, a central unit, and a south unit, um, what we, what we would like to do is we have wells that are in our central unit that we would like to be able to have the ability to move to the West unit. And so those to increase our bromine capacity in the West. Unit. So yes, to answer your question about contiguous, yes, the property that we will be moving, we would like to move with the possibility to move is contiguous to the West unit.
Senator Jimmy Hickey, Jr
Unverified
6:02
So whenever you say move, you're just, you're just talking about you're gonna allow that to be
Speaker 30
6:08
paid in, in that other particular. That's correct. That's correct. So, that's right. So we have and
Senator Jimmy Hickey, Jr

6:13
Good. I'm sorry. I just want Why? And, and if. If Senator Stone said that, I want to hear it again. So why, why would you, why would you
Mark Day
Unverified
6:23
have to do that? So currently, so we have with the 3 units, our units are 40+ years old. And we have plugged probably close to 20 supply
wells over the past 40 years. And so we have, we have our central unit wells that are, we only have 3. Operating whales in the central unit currently for a 40,000 acre unit. And so what we, what we have is in our West unit, we have a bromine tower that can handle more water than what's already coming to it currently with a 1210 to 12 supply wells we already have. So we would like to move that water from the central unit to the west unit. Now, again, that takes
pipelines, that takes right of ways, um, that takes dealing with, uh, working with our stakeholders, but it's really to increase our product in the West unit, um, and, uh, maintain the, um, Maintain the um To maintain the West unit and increase the size. So we would be decreasing
Speaker 33
7:22
the size of the central unit and then, um, increasing the size of the west. I

continue OK, so I understand if you're just, if we're just looking at bromine production and I, I
understand the efficiencies of it, but with everything that's been transpiring down there in that area. If we do this. If we allow this acreage to be transferred. Let's just say that it is for something that's lithium. Somebody that has that type of property. So then is it going to be in a, in a, OK, no, sir. So this will just be, this would just be as it relates to you all basically for, for. The bro, the bromine production or getting the, the brine for
the bromine. So, it's not going to automatically make it where, uh, If That, that we're gonna have properties. Uh, that are then gonna have to be designated in different, different areas if, if there's mineral, minerals or, or however that gets worked out. That's not gonna happen. No,
Mark Day
Unverified
8:25
sir. There will nothing's going to change. The Minerod owners will still continue to receive their bronze royalty payment and then win and win and the lithium, um, royalties established and there is lithium
production, then there'll be an additional lithium payment for those miner owners. Nothing's going to change. But
Senator Jimmy Hickey, Jr
Unverified
8:47
So that, that track that they're gonna get paid on it. So you could be, you could be getting paid differently with the track that you're doing, it would still be contiguous with the, with the lithium. Yes, sir. OK. Yes, sir. Whereas y'alls may not be contiguous. Is that right? No, sir, it is. Yes, sir. So really what you're doing is just ones that are literally just Very close to each other that
Speaker 40
9:09
have the line and you're just wanting to move over. That's that's exactly right.
Speaker 41
9:16
Yes, sir. All right. Thanks for the explanation. Any other questions? So you
can hunt anyone in the audience wish, wish to speak for or against this bill? Seeing nuns in their stone,
Speaker 11
9:27
would you like to close for your bill? Uh, members
Senator Matt Stone
Unverified
9:34
I'd also like to know that there's uh no known opposition to this bill also and
with that being said, I'd make a motion to pass. At a motion, sir. Senator Hickeys 2nd, all in favor say aye. All opposed. Thank you. Thank you. Senator D's, you have, you're just very enough. Seeing no one else here to uh present uh I will, uh Yeah, I thought maybe it was Sir
Speaker 12
10:05
Gilmore, not. Uh, with no one else here to
