If you would introduce yourself a record here right my name is Doug Spencer I'm with legislative audit. Of there is one funding for this report from the fiscal year two thousand eighteen audit. On. Our tester for trial court employee expenditure shows that there was an overpayment over a three year period for a fourteen thousand dollars. The agency. Has is still in the process of working to determine if they're
going to try to collect. Of this over payment and the employees involved are still employed with the agency. For fiscal year nineteen we've already completed that audit and there were no findings and that concludes my report. Any questions for legislative audit. Senator Chesterfield yes where the money's reimbursed. Properly dispersed the agency is
still waiting to determine what the prosecutors going to do before they try to collect the funds is my understanding. They are they are Senate they have sent this to the prosecuting attorneys on our our office in to to the prosecuting attorney yes. Is that our standard procedure I understand that I'm wondering and sending it there. We did not as the agency to see if it could read them get the sick the reimbursement first before we turned it over the past few.
Never there's an overpayment our office automatically sends it to the prosecuting attorney. The agency is waiting to determine if the prosecutors going to find fault with the individuals before they seek reimbursement thank you. See eighteen. There. Alright you're recognized. Thank you Mr chairman of how many employees were involved the primary the majority of the funds were for one individual and it was I believe it was a twelve thousand dollars of that was for one individual. And it was over three year period for you many well known for three years yes the problem was that there was some Misunderstanding I think would
be the the the right way to phrase about where to claim mileage from where there was from the residents are from the official station and so this went on for a period of three years what what is it what is the state policy or their policy regarding that the policy is to use the shorter. Of residence or official stations so for example some some trip trial court employees of have to go to several
different courts service one so they may work at court a but then once they get there they have to go to other courts but if it's a shorter distance from their home to their second court. Then they're supposed to take the shorter distance and. Not all of them did that is what we found in our test. So when you say not all of them do that is that mean it was more widespread just one employee well there was a total of fourteen thousand dollars twelve
thousand of it was for one individual and then the other mounts for smaller. Total forty two thousand thirteen thousand fourteen fourteen misunderstood fourteen thousand three years yes Sir but the employee was aware of this and no no we don't think the complete was aware of it. Like I said I think there was a misunderstanding of what the policy was because the. The circuit judges the one that signs off on the expenditure
they're the ones that review it and so I think it was a misunderstanding of the policy and then the management's response which is included in the audit they went back and reminded the the judge of what the rules were. Was the one the court or more than one of the well the majority was that one court I don't have the I don't have the information but we scored it is. But the but no the in total it was a different court. Thank you Mr chairman.

The bear the administrative office for the non judicial business of state courts. The department appropriations summary is on page six they have twenty eight appropriations. Only ten of them have changed
levels seven solely have changes in salary a match due to adjustments made in the current biennium that are requested to continue into the next biennium. They're requesting a discontinuation of two of these appropriations and to appropriations that were established during the interim. The agency is requesting fifty point four million for FY twenty two and fifty point five million for FY twenty three. There is no executive recommendation. And I'm gonna go over the change locals.
On page twelve the administrative office of the courts. This is funded from state central services in state administration of justice the agency is requesting about five point three million each year of the biennium. There is an increase in salary a match due to the addition of two positions. There's an increase in judicial education of forty thousand dollars to educate thirty six new circuit judges. There's an increase in court interpreter fees of forty thousand due to growth in the
Hispanic population throughout the state. On page twenty as the court improvement program this is funded from federal revenue. They're requesting about one million each year of the biennium. there re allocating twenty thousand from the professional fees line item to conference and travel expenses line item to be more in line with actual expenditures. Juvenile drug court date data management system this is on page twenty eight.
This federal program has ended so they're requesting to discontinue this appropriation. On page thirty one is the AOC state wide software license. This was established in peer last June this past June their requesting thirty thousand each year of the biennium this is for software licenses for individual state courts this is funded from the fund balance in cash funds. On page thirty two the juvenile justice reform this is another one that was established in
June. It is funded from federal revenue. They're requesting about a hundred ninety six thousand each year of the biennium. On page thirty four is the drug court enhancement two thousand eighteen suspended from federal revenue. They requesting about one point eight million each year of the biennium. They are requesting for an increase in operating expenses conference and travel expenses professional freeze and grant in aid for a total appropriation of
about one point seven million each year of the biennium they had received an additional one point six million from federal revenue. And the last change level is court automation enhancement they are actually requesting a discontinuation of this appropriation Mr chair that concludes my presentation. Yes ma'am we'll get a man I thank you. You guys would introduce
yourself for the record senator Chesterfield has question. I'm Marty Sullivan I'm the director of the administrative office of the courts. I'm Tim Holt often the director of the court information systems division I work for Marty. Thank you so much I hope you all work for us as well A as I'm looking at it do you have any contract with vendors. We have several support agreements with
vendors for our our database management system we have the continuing support for the oracle database for case management system we have support from Avenue for the case management system you are outside cleaning service or is it in house. Well let me just cut to the chase I'm concerned because the layout this review of of budgets. No A agency seems to have been able to hire any minority
contractors so I just want you to know that that is a concern of mine and I don't think it reflects well on this state the second question is actually on page thirty two you have actual expenditures of eleven thousand four hundred and fourteen dollars and yet you are asking four hundred ninety five thousand eight hundred seventy four dollars could you tell me why that big a change. Two four. That the current.
Total budget goes from eleven thousand actually spent. Two hundred ninety five thousand eight hundred and seventy four dollars could you tell me why such a huge increase and I can I can certainly follow up with the Jennifer cries are juvenile director this is a federal grant and it's for the juvenile drug courts this is an appropriation that will allow you to access money from the rental government correct okay thank you that answers my question I appreciate it thank you Mr chair. employees the TCA in the court reporters work directly for the circuit judges so this particular judge was in a circuit that ad I think five or six counties and his staff person was calculating their mileage from another circuit court building to and from and. You know what the judge signed off on this then approve this so we calculate what's on the seat
and and double check that so when this came up the judge came here and testified and and gave information to the the committee and. I didn't realize this was still going to be honest report assist other this is over with in twenty eighteen so the the circuit judge as been working with Larry gently I know Larry gently was turned over the prosecutor and so I I I don't know the status of the reimbursement for the status of what Larry jellies investigation they have not sent a report to be letting me know what they're
doing now certainly follow up with that this afternoon and let you know okay well I'm just curious to you know the policy seems to be so complicated that maybe the judge didn't understand it or he did I mean of. Against the the thing I'm pleased with is the fact that your looking into the trying to work through it Mister chairman I have one more question in your
own page of twelve you're requesting two additional of positions and and I looked at your budget vacant positions and you have twenty five positions throughout Europe you're a a agency the that are vacant so what could you use one of those. Positions rather than adding two additional ones. That's certainly news to me that we have that many vacant
positions I'll have to run that report because I don't think that's the case I think one problem with that too is seven years ago we took over the management of the the TCA is in the court reporters for the circuit judges so the AOC has fewer than two hundred employees to serve all the courts in the state and so if you look at that number that probably includes all of the TCA in court reporters which is an additional two hundred plus employees for the circuit judges so I know we've had some turnover with the TCA the court reporter some
assuming those are the vacant positions well what. The I got this this comes from August reporter Joel filed with the view of legislative research. Shows of the authorized four hundred and two positions budgeted three hundred and seventy seven and then it shows of vacant positions within the whole of your operation of of twenty five I wish you would look into that.
See if you can you know utilize what you have available thank you Mr chairman if I may it's it's probably a combination of multiple factors so we have additional employees that are coming on June first G. January first because of the the new judgeships that were created so that that will be part of a currently we have five vacancies in court automation were waiting for the budget to to stabilize since we're dependent on fines fees and cost to to fund these
position so we're still under a hiring freeze on those those vacancy. I come you you only have three positions that are over two years ago so a I would look at I wish you to look at those to answer thank you thank you Mr chairman thank you thank you Representative Senator hammer you're recognized for a question. Good morning thank you Mr chair back to the issue is raised about the contracts that are given out in about minorities have an opportunity to bid on those when you BID those
contracts out are they open to everybody to apply for them. Yes I'm assuming so as far as the the billing cleaning services that we do that through building services I'm I'm assuming we don't we don't build those out we're just rental wars of the justice building so that might be a better question for building services okay that that's one of the points want to get to as far as you have anything to do with that that's not really under your purview that actually falls under building services correct correct alright thank you Mr.
Senate just for you have a question yes I just need to know if that's true of all of these that they all fall under building services all of these agencies now so I know to home to go to find out about contracts and not. I take up the committee's time because I do think it is important that our contracts reflect the makeup of our state. And we have chosen to identify minorities as ethnic minorities women and disabled veterans and I think it is imperative that we
know what efforts are being made and while these things may be open to all we know from the the contracts that were let house get to the much quicker than others because they know the system and so I want to know to whom I should go in order to make sure that we're giving people the opportunity to become participants in this process in the state of Arkansas all people ethnic minorities women and disabled veterans and if we could find that out I'd appreciate it Mr chair thank you so much.
Yes ma'am I can answer that that's the if in a procurement and building services on this particular one and that's going to very depending on the agency but we can identify for that for you at each time if you would like that would be helpful yes ma'am if you don't mind just hit your button so we don't forget and Kevin can tell you exactly where to go on each one alright thank you so much yes ma'am. Senator Stubblefield you have a question. Yes for sure thank you morning what kind of effect is covert
had on the office of the courts your overall operation it's been one of the most stressful times I'd. We've had. We lost an employee one of the Supreme Court employees passed away of covered we've had employees that have lost children to go but. it's been it's been tough I when I was fourteen enough to been offered this job four years ago I never imagined that I would be putting together a supply chain of PP for courts around the state
we hit the ground running because the cities and counties could not find PP right away to date. The administrative office of the courts has distributed over seven hundred thousand mask to the court community we've given out fifteen thousand bottles of hand sanitizer and over five hundred thousand close another issue we had was the cities and counties in the sheriff's offices couldn't find a medical grade thermometers those laser
thermometers so I stayed up. One night and found the distributor and and Las Vegas I was in north in a lot of and we were able to get two hundred and fifty of the medical grade thermometers here and we've distributed those out to every county and if you come to the justice building right now we just announced our fourth disbursement of PP and judges are picking that up today as we speak so it's it's been unusual to say the least the number of of court staff around the state the number of judges frankly
that have contracted it is concerning I know many members in this very room have been affected as well so just like everybody else it's it's been has created a backlog. We look at the the data for the the civil cases in and the more rural areas not so much the real unique thing about this is the transformation to zoom we provided soon accounts for all judges in the state and we. Certainly the Supreme Court
knows the importance of moving dockets and the judges have done a remarkable job of adopting zoom and doing soon hearings there courts all over the state that that look just like this that have the plexiglas they're having trials will be there they're working and and honestly some of them putting themselves in danger I mean you look at that the district courts the number of people that they see is is phenomenal and the things that they're doing is really been kind of pro active and you look
at one of the judges he had a for Dyer the jury selection in the back of a pickup truck and he was literally standing in the back of his pickup truck so people can social distance we've had district courts that have created drive through quartz so you can actually drive up and they text you that you know you you can drive up to a certain spot so I mean the courts of really adapted remarkably an extremely proud of all the things that we've done and I I've got to take a moment to commence the administrative office of court staff because
they've really done a remarkable job. Thank you Mr. Thank you you think Senator Senator hammer you have one final question I do thank you Mr chair so on the basis of your answers are to Senator Stubblefield do you ever see that the courts are going to go back to what we would refer to this previous cove it is normal or are we going to be able to continue some of these practices that may actually help create some savings within your budget and be able to opens up
to new opportunities absolutely I mean another thing I never imagined that I would watch the Supreme Court to an oral argument on soon and the supreme court's doing soon moral arguments absolutely I I think zoom is here for to stay a specially with the turn over a new circuit judges we've got thirty six circuit judges that are retiring and December so we've got new training for the thirty six new judges that take the mention January we're doing soon training for them it it's it's
certainly a an unusual time but we are we are adapting to the technology and we're gonna continue to use it I I percent in the future absolutely alright thank you thank Mr. So I entertain a motion. Thank you Mr chair. Says on page thirty six is the court of appeals. The court was established to help alleviate the case load of the Arkansas Supreme Court. They do have one appropriation it's on page thirty seven this is funded from state central services. The agency is requesting about five point seven million each year of the biennium again this is one that does not have an executive recommendation.
Change the rules are an increase in salary a match to the reclassification of several positions there is also an increase of sixty thousand to the legal counsel appropriation line this is due to the increase in attorney fees to those attorneys handling direct appeals. And if you look pages thirty eight thirty nine or just a duplicate of pages thirty six and thirty seven so you can disregard that and that concludes my presentation Mr chair.

If you would introduce yourself for the record. A good morning of Brandon Harrison a judge on the court of appeals and the soon to be chief judge. And I'm and Solomon I'm the chief staff attorney in court of appeals. So looking at this it goes up almost a million dollars and the reasoning was reallocation of positioning positions so if you guys could could you explain how come it's costing us a million dollars more to pay people at
the court of appeals certainly I'm earlier this fall are court appeared before and Legislative Council peer review and then Legislative Council asking for an ever increasing our salary appropriation that was to achieve parity with the Supreme Court law clerks that was approved in September and so growing our budget for twenty twenty one has been increased and so this twenty twenty two and twenty twenty three appropriation just carries that forward.
Okay Representative would recognize. Mr Longmore live of the. The request was made to the personnel committee on or a class that's the difference in pay between the Supreme Court Clark's and the appeals that the currently so that's the reason for your. And we also now I think I'm mislaid law we for just a number of buildings already that belong to the state so that there is an opportunity I would like to ask them about their commitment in the future do we have someone here from the office transformation now.

The auditor of state's office has for findings fourth fiscal year two thousand eighteen audit the first three dealt with. unclaimed property stock records.
Our testing found that the agency did not have adequate controls over Starks resulting in Arkansas citizens being other over pater underpaid when collecting their unclaimed property start. The second finding related to the market the market sales price of the stock not being taken into consideration when pain now unclaimed property. The third finding.
Note that a detailed history was not being maintained by the auditor of state on each of the unclaimed property accounts relating to the stock in the fourth finding was that due to lack of management oversight agencies calculation of excess unclaimed property transferred to the department of finance and administration was understated by three million dollars we have concluded the fiscal year two thousand nineteen audit is
scheduled to go next month and I have no findings that concludes my presentation. Thanks served represent Kevin are your question for audit. You're recognized thank you Mr chair. So these are repeat findings but you're saying that they have cleared them up since this last audit yes ma'am okay do we know if they've made the people that were damaged hold. The.

last line and it talks about the over placements in the continuation of those payments and how some people were over played out of others were underpaid okay kind of what concerned me was of the very last sentence in that paragraph is until corrected. Yes he'll quit doesn't say that it has been corrected it says in teal until corrected inaccurate claims will continue to be paid
as if that statement implies. That it's on going inaccurate statements are still. Be IT applied or are being sent out so have a have a mis read that or could you kind of clear that up for me hopefully it's not continuing that statement was true in this report was issued in two thousand eighteen since then the agency has taken steps to correct that problem. acts as the disbursing officer for several programs. On page forty one as their department appropriation summary. They have ten appropriations. The agency is requesting about fifty nine point three million each year of the biennium there is no executive recommendation. They only have three appropriations which change levels and all of these have to do with salary and personal services matching.
the first one is operations on page forty two. It's funded from state central services the requesting about two point seven million each year of the biennium. And they're requesting do match dismiss be made in the current binding requested to continue into the next biennium. On page forty four is unclaimed property. But it from state central services requesting about two point nine million each year of the biennium again just match adjustments there.
And on page forty seven is the deputy prosecuting attorneys. Is funded from state central services and requesting about twenty five million each year of the biennium and again it's just match adjustments as well this concludes my presentation Mr chair. They do have a Levin appropriations the agency is requesting about three point five billion each year of the biennium there is no executive recommendation. They only have three with change levels I'm going to go over those. The first is on page fifty forts their operations suspended from state central services the agency is requesting about six point one million each year of the biennium. They are re allocating two hundred thousand from data
processing system services line to operating expenses this is due to an increase in banking fees. On page fifty seven you'll see the local sales and use tax for city. Spend it from local sales and use tax the requesting eight hundred million for each year of the biennium. This is an increase of thirty million due to continuing increase in internet sales. On page fifty nine is the uniformed tax rate this
amendment seventy four splendid from a trust fund. They're requesting at one point seven billion each year. AS increase of two hundred fifty million and this is used for distribution of the uniform rate of tax Arkansas school districts this concludes my presentation Mr chair. Any questions on the treasure. The General Assembly created the county aid fund in order to assist counties with the increasing cost of providing services. The department perforations summary is on page sixty six they have five appropriations. They are requesting about. Five hundred and forty eight point four million each year of
the biennium the executive provides for the agency request. They're preparation start on page sixty eight general revenue to counties it's funded from general revenue. Agency request is requesting twenty one point four million each year the executive provides for the agency request appropriation only and general revenue funding at twenty point four million for each year of the biennium. On page seventy one is special revenue to counties this is
funded from special revenue highway turned back in severance taxes to counties. The agency is requesting two hundred and five million for each year of the biennium and the executive provides for this. On page seventy three is mineral lease. This is funded from sale or lease of minerals oil or gas on federal military land. Agencies requesting twenty million for each year of the biennium the executive provides for the agency request.
On page seventy five is the real property tax reduction this is for counties. Suspended from property tax relief trust the agency is requesting three hundred million for each year of the biennium. And the executive provides for this. And the last one is on page seventy seven property tax relief counties is funded from property tax relief trust and the agency is requesting two million each year of the biennium the executive provides for the agency request this is a
