All right with that chair she's a quorum we're gonna go ahead and kick things off first up on B. one annual expenditure revenues from additional wholesale sales tax on fuel an additional vehicle registration fees. on hybrid electric vehicles in casino gaming. Are you gonna give an overview I guess of the report. And directly if you just got could recognize yourself for the committee and you're welcome make remarks on the report. Can are at present with my mask offered any to keep it on. Okay okay Laurie tutor Director of Arkansas department of transportation and today and we have a presentation on for the agenda items we have a few slides we have four reports I that we have sent to all the members to review and I'll just go those really quickly and open it up for any questions to the email I have so. Okay then the situation here okay so our first report is required under at four sixteen which is now Arkansas Code twenty six sixty four one oh four of Act four ACT four sixteen established about ninety five million dollars a year for a bridge and roadway preservation improvements on the state highway system and it comes from a motor fuel tax electric and hybrid vehicle registration fees and casino revenue. Part of the requirements of this act is that we provide a report a yearly report on how we spent that funding and and so that's what this report is about as I kinda looted to maintenance and preservation of highways and bridges is the only use this the only way we can use this funding so it has to be for those types of projects. And for this year we didn't have a full year of funding because of the way that the the revenue was generated this first year of this revenue so we had a kind of a lesser amount but we used all of that revenue we really do twenty two projects hundred ninety eight miles through twenty eight bridges and those are listed in your report and there's a map this companies that list so I'll stop right there and if you have any questions I'll be glad to answer. Thank you director members of the chance to review. At six forty six true that is. Okay. Section if you're recognized for a question. Are there any major issues on the bridges another was some concerns we have some older bridges is there anything that we need to know or be concerned about no ma'am okay that's it thank you who you're with. We have any other questions. All right seeing nine we have a motion read to review the report. I've got a motion the second all those in favor signify by saying aye all right reports from reviewed I to be to the congested routes crash history expenditures and highway system mileage as required. It back over to you for that okay thank you this is ACT seven eighty nine of twenty nineteen it's now Arkansas Code twenty seven sixty five one forty seven and this is a requirement to prepare report yearly I was in specific information that spelled out in the law and that includes the ten most congested routes in urban areas. The ten most congested routes in rule areas crash history by county of the five locations with the highest number of crashes. It for regulate is crashes in general and then another a set of dated it looks it just fatal crashes. We look at expenditure of highway funds per person state highway mileage per congressional district and then expenditure of highway funds for preservation. This report is got a lot of data in it and the Representative Lundstrum who sponsored the the. This legislation in twenty nineteen. we've been in contact with her and we are working on making this a little more user friendly a little easier to read for. nontechnical. If anyone it's outside of our everyday operations of the department is probably difficult to decipher and read so working on that and we've made some progress in that we put together some maps. So that you can actually see the locations of the crashes of the crash data that we have in there and we're going to continue to work on this report to make it easier to understanding reading so I'll just put that out there but I'll stop right here and let you ask any questions. Gates my understanding those maps are available today on our website of the meeting links accord staff and then so if with that I'm gonna turn it over to the C. forty nine for question comment. Thank you Mr then. But Got this I guess we got email the other day on this that you know you always go look at your home district counties and all and I had it was always fun. the data interesting is there anything that you all keep up with. in the way of what I'm saying is be agreed. Versus car pick up attached to that that is built not uninsured need see that base but is there been any big major changes in any of the. Routes that we have in the state to. S. eighteen Wheeler at the I hope we keep up with that and we have that data I don't know if there's any I'd have to work a lot we have to look at that and see if there's been any big changes but shall analyze that in in your I'm sure you road update construction safety part of it is if if there's a change. And. The the big red car yes we and you know under the federal highway rakes we have to we have to analyzers the safety of our routes in and report on that and use that to use that money it has to be used to reduce crashes so we have to keep up with all that data so we have that available and we and we do we do that constantly we have a whole section dedicated to safety analysis of our roads thank you for your. Would you like to see The best example of the maps on the screen. Yes I'd be great at the then we do have it I just pulled one up on mine. what what example do you have I like to ask a question about one's mission is to help works okay this is gonna go to Lonoke county do you have that one. I yes hold on. Look I did it. Okay let's see if I can find loan okay let's see if So how do you all utilize this amendment some of this is already information that you all have on hand it's kind of part of a missive in the formula as you all look at what needs to be adjusted for maintenance or widening or whatever to make and then area safer how does that play under these maps this information play into. You know I guess your game plan on how your protest projects well what we do is We we look at we look it we look it crashes all over the state and we analyze that and we look for trends you know system why trans like you see these cable median barriers that we put up everywhere that's based on a huge analysis of cross over crashes then we look at other types of crashes like rearing crashes in and side swipe crashes if we have a huge number of those that has to do with the congestion and and you know something that needs to be done to improve that is to reduce those types of crashes. Are the other thing we look at is a run off the road crashes in wet weather and if we have an in the usually high amount of wet weather crashes in the area we see we focus in on that area and we look at the pavement to see if there needs to be you know we look at that because sometimes pavement become slicker over time and then all the sudden we see a spike in wet weather crashes so we go in there and we fix that so I guess I don't know if I'm answering your question but we we always are like I was telling Senator Rice we have a whole section dedicated to analyzing the safety data the crash data and to make sure that we're finding those spots their hot spots if you will and in using our money to the best of our ability to reduce crashes because our goal is towards zero deaths I don't know if you've seen that or not we've tried to make a campaign and that that are our main goal at the Department obviously is safety and towards zero deaths is is is a huge go in our safety plan that we have to put together every so often to give to the Federal Highway Administration and from that safety plan we have to follow that with any of them funding that we spent. So but as far as me. Is there some happening question or formula that you all use issue identified the priority spots yes we have a way of per are prioritizing. Those that rise to the top that more to it more dangerous areas than others and yes we do that. Okay it I would be curious and just seeing how that works as far as the formula how you all to implement it so unique you know ranking from one two hundred of sure you know but you identified and hot spots and how you work that lists through amongst the districts that sort of thing And speakers to see if we will be we would love to do a show in Kalanick's pretty impressive what we're able to do in these big heat maps that we do is we make and if if the if the subcommittee is warning that I can set that up with it won't be me I'll bring in the person someone that knows this ink kind of walk you through and just to see what we do in that regard if that something utilized and I think it's a great city of represented Lundstrum recognized for a question or comment yes I am first of all I want to thank you for taking the time and the diligence to put this act into motion I wrote I realize it's a law that you took it to heart and put a lot of thought into it the whole highway department really took this and ran with it and I appreciate it thanks very much and not the maps of each county are really telling and and I'm hoping that this will help us have the money for all the cars and I know Senator Stubblefield. Feels the same way that we appreciate that the thought in the time that went into this and I'm another others that may have questions once they digest all of this information it really helps to break down where we're spending the money and I just commend you and the folks behind you that put the effort into it so thank you I thank you and I'll pass that along because and the staff really put some time into this report and I'll let them know how much it was appreciated I'm I'm looking forward to seeing our tax dollars have the money for all the cars and I think this will validate that decision okay thanks thank you thank you. Yeah and I pulled up on my phone too so in a in a finally get it to load just takes a little bit is the size and trying to do it over the the wifi so um. I think I I wish I could find some the original numbers at first and I finally located him as the kind of scene back in on the map on my phone okay but you know that makes a lot of sense and I liked I liked the the lay out. Thank and we'd we're more than willing to print everybody out a booklet of these maps it but we thought that might be too much information we didn't printed agreed yeah I'm glad that we've just got online okay I think it's great. Representative you're recognized for a question yes I just want to follow up and they put a lot of effort into the top ten on highest death rates and traffic and I think it's worth putting a little bit just a little bit of focus on that and I would encourage each of you to look up your counties they put the death rates and traffic on each of your counties and it's in there where you can actually put it and screen shot it and I think it's important for all of us to put that even on our Facebook so people know where the pinch points are and where the death rates are I mean it's up to us ultimately so but could you review of the top ten. Okay on death rate and traffic lights traffic. Okay so this state the top ten most congested routes in urban areas is that what you mean Representative yes okay that's on page two of the report. and as you can see. The. Over on the most right hand column that's the average daily traffic we keep up with that we have a permanent traffic counters on most of their inner states and then we have we do TM. Temporary traffic council of the state as well and other we have a whole section. Dedicated just to keeping up with traffic on the system because we use traffic in just about everything we do and what comes to analyzing your route in determining funding for that route so traffic is a very very important part of what we do and can collecting that data. So Anyway this is just the list ranking one three ten we have five listed twice because that was a tie self five is really five and six but since they both had the same traffic there shown together is five. Most of these segments are what we have been calling thirty crossing it's the thirty five thirty encouragements between five thirty and highway sixty seven that goes up towards Jacksonville. And as you can see those are the highest traffic volumes in state which is probably know surprised anyone here I'll just stop right there she looked through a lot read through each one bit stop right there and open that up to see if there's anyone that wants to question those for those segments of road I'm just a quick question on the follow up is chairman the top ten most deadliest highways in our state obviously it's gonna be hard to traffic but could you give us like the one or two I know we've had some problems in Washington Benton County but just off the top of your head what is this report tell us about. Death right on our highways. This report I don't have that's not theirs well it there's some of the report the pictures will tell us that the number of fatal crashes in the location the highest number of fatal crashes. Okay like for each county the hot okay you want to talk about like for Washington County and fate bill there's one area that's had sixty six crashes this is this is great information it's very well put together if you're from Washington County and you look at this you go wait a second I need to pay attention in this area okay so that that is on page twenty eight the beginning of that report and those are fatal crashes that we we keep up with we kept we keep up with serious injury and fatal crashes that's very important to us but this is just fatal crashes and it shows by county if there was a fatal crash in that area the top five locations but there's in many county jails the main way more than five because there was just one in that particular location and so there was ties if the if that makes sense so let's go to Washington County which is on page. Funded. There's a map on page seventy two. Are the on the map session the crash record map. one okay. Oh okay you're looking at the map those are total crashes not fatal okay I'm sorry I got confused for a minute and that was my fault no I know what you're saying now okay let's go the. On the map it says locations with the highest number of crashes and then it says locations with the highest number of fatal crashes. Okay that the sixty six is crashes okay all right let me see And then it's listed alright sixty nine crack as you see the blue mmhm highs number of crashes that's. A person earning like property damage it's not it's all crashes including fatal and nonfatal are broken out in the red dots and you can see that most of those are just one one crash there's not very many that are fatal crashes that have occurred more than once in in one place okay so those sixty nine crack eighty nine crashes. Those are all crashes at that location so in Washington County you can see that. Like it for twelve and I forty nine. You've got a hundred and forty nine crashes that's the number one place in Washington County with with the most crashes. The this everyone see that can you see that. See that one hand of I can rate rose one hundred forty three crashes at that intersection that intersection area. It's the number one. Crashed number one and far as the number of crashes in Washington County and it's right there that signet significant number of crashes the other traffic right there is he is. Is significant well and there was one fatal crash right to the west of that intersection so if you look in the fatal crashes. On four twelve at that place there was there was one fatal crash in this report. I don't see they did not label the fatal crashes like that. But I can get them to do that but most of our fatal crashes there just be one crash at that location that caused a fatality or multiple fatalities but it would just be one crash okay well this is very very very helpful K. and I'm I'm done with my questions thank you chairman for the latitude. Thank you and we're looking at this I guess what I'm curious about so that that particular area you meet you've identified it you already wear of the hot spot what was going on what I'd like to see was it what is the response been in that area I'm gonna be like what what is are not done does that mean. What I mean or I mean I guess you look at it and say number one it was ice and maybe there's nothing you can do or or number two was construction related which the construction is no longer on going a minute there may be multiple issues that requires no response from are not. but in an area like this would you look at what do you do what's been the progress so far to try the levy eight that that's to me would be I would I'd like to see that process in some ways okay who will be glad to do that that'd be. That'll be a great presentation for gas all right sounds good. How do we have any other questions on B. two. Signon once will of committee gotta motion of you if you senator rice to get a second five represented Lundstrum all those favor signify by saying aye All opposed to all right I would be to spend reviews of reviewed out of the three proposed legislation filing during regular session and we'll turn that back over to the Director. And just one more thing about this report I guess everyone understands that for the preceding ten years it's not a one year that that many crashes occurred so let's make sure you know I'm a not a said that. Okay so This through this report or it's not exactly a report it's more images state package if you will but this has to do with Act two ninety nine of twenty nineteen which is now part Arkansas Code and it's our proposed legislative package for this year. And we went through this with the commission M. at their November meeting. And we received approval from the commission which is a requirement of this legislation that the commission five of voice voter but recorded vote approves our legislative package that we've gone through this process we've presented it to the commission and they approved it and now we're in the process of getting that put together finding sponsors and we've been working with B. L. are are proposed budget legislative packages year is there and it'll it's part of the part of your and documents so you can see and see in some. In detail what we're gonna be doing but in general we're going to we're going to change vehicle wait for intrastate commercial motor vehicles. And we're gonna change the maximum vehicle height law. both of these are to ease them regulations both of these will reduce regulations on our trucking industry so we feel like they're they're good it's good legislation in our highway police is behind this they think it's good legislation so it won't reduce safety but it is going to make things better for a trucking industry. number three we're going to amend we hope to amend three location assistant laws just simply to referred to the correct federal law right now federal law the statutes the where they're located has changed and we're just going to make our state laws match M. two to direct it to the correct federal law. The changing the oath of office for are not employees this is just because there's some employees as you can imagine I may have a night time job being only has two jobs but it doesn't interfere with their normal duties at the department and we just wanted to make our oath to reflect that. In they not be entitled to be more reflective of what's going on. And then finally we had some changes we've got to make to our Arkansas State Highway employees retirement system or Asher's and those are shown in the Show in our package so I'll stop there and I do have a question okay part of the aisle part of that legislation requires that we present this package of legislation to the Arkansas Legislative Council at their December meeting which is Friday but we're not on the agenda but you are you know that the cochairs are to represent the subcommittee so I don't know if if I'm it says me or my designate can I. Make you my Disney or do we need to have someone here to. I don't I guess I just want to put that question out there because we're unsure where we go from here stand so the AOC is delegated you know the review of the report to this subcommittee okay now we're going to present the report chairman McNair I would represent this report this for you know that which would include you know this sub reporter this this section okay now there's a possibility that there will be questions from the committee members any of that are not members of this committee but members of eight the full LCD up and so I would under it's not may yet or ever after they when they say a delegated means a delegate of the highway department would be here to answer questions if there's any questions okay not you then someone from our department I'd hate to try to answer the question so but yeah okay that and I have a I've already. I've already got a meeting of head on the books for months on Friday but Randy Orton is going to be here to answer any questions I said Europe because I felt bad about canceling this meeting that's been in place for so long so I guess we'll do. Per. All right so that's all I had a house open it up for questions on this Legislative patch Senator Rice you're recognized. If thank you on the. Intrastate weight change it says to comply with federal motor carrier. Is that something they changed recently the bill to change. no and I've got Chief Thompson here from Arkansas highway police in would it be alright if I invited him to appear just to dress that. Yes okay. And just recognize yourself for the committee in you're welcome respond. Good afternoon thank members of the committee my name is Jay Thompson the chief Arkansas highway places great question senator so basically back in nineteen fifty five forgive me I was not born yet but state of Arkansas adopted the federal motor carrier safety regulations to the motor carrier safety act. If you go to the federal motor carrier safety regulations. The definition of a commercial motor vehicle at the time was a vehicle with the gross vehicle weight rating of ten thousand one pound or more. So back in those days trucks like I drive today at twenty five dollars twenty five hundred the gross vehicle weight rating would in this high back then in the fifties is it is in today's time. Over the years the federal motor carrier safety regulations have not changed their definition of the commercial motor vehicle. however. The definition of. CDL required vehicles twenty six thousand and one pound or more so what we saw is over the years some of the smaller vehicles for example a Dodge twenty five hundred for a twenty five hundred truck pulling a little cargo van who was that was being utilized by a plumber for example do implemented residential Your auto loan services your flooring services for example my brother had a talent flooring tile business years ago and. If you added the gross vehicle weight rating of his twenty five hundred to a truck to the little small cargo van or trailer he was pulling he actually met the definition of a commercial motor vehicle. So we were holding him and some of these small Arkansas businesses accountable are that we're applying for a motor carrier safety regulations to them the same federal motor carrier separate regulations that are interstate transporters are following so eighteen Wheeler trucks so we are actually one of are the only state within the sasco the southern region that has not went back into state law in chains that weight threshold. So what this is like the director said we're basically D. regulating the smaller trucks the structure not even on the chart when it comes to our crash data but we have been performance safety inspections on for several years because this law so that's director to do not a suggestion that we change this law to give them a little bit of relief and and and enforce the federal actions where they need to be enforced but thank you for the question correctly and and thank you for bringing this forward relinquished years ago got a pass it but will will try to help many colleagues don't understand how many small businesses fit into this nation again we all will safety and if you just said the crash data this is this is not reading for unsafe they're not. The government said for a long time a pickup a camper on the boat. That you see going down the highway is more dangerous with the possible possibility of. We've been back forth in it is some of the small box trucks that will fit within this twenty six thousand filed. Thank you again for clarity that's only for the state of Arkansas. is all we have control under. Is. And and we can talk off line I would be more clarity than that to be here. The role that. USDOT. In Arkansas highway police. Or what survey were decided Arkansas DOT. I need some clarity. In the regulation on this twenty six thousand pounds is that going to eliminate them from the need to register as a. DOT vehicle. No so we're talking about intrastate carriers on in your you're correct this state of Arkansas has no regulatory option to not enforce the federal motor carrier safety regulations on interstate carriers ahead a motor carriers required to apply for a DOT number when that motor carrier crosses state lines so this this relief that we're talking about is just for our Arkansas vehicles that are typically falling within that weight threshold of ten thousand one pounds or more two ten twenty six thousand pounds or more and lesser homeowners quantity of hazardous material that requires them to be plaque or did our some type of vehicle this transporting sixteen or more passengers obviously they they won't be out of the regulations because you know transporting passengers are precious cargo particularly when it comes to our children the health children in schools and things of that nature but. It's it's just for intrastate only so if the if if I'm going across state lines everything still applies. We have not required anybody that stood in prostate within the state of Arkansas to to get any type of a federal DOT licensure. At this that is correct Sir they are not required to do so thank you Mr. Six thirty I think that center Chesterfield yes thank you Mister chair and good afternoon good afternoon good to see you all again. first let me say what I like. It's always good to say which I like I like the change in the oath of office. Because it does speak to the needs of those individuals who have to have second jobs in order to make ends meet I think that's a great change thank you have made to make it more palatable for them thank you I'm concerned though as we move down to the retirement Beals okay and. Senate race already asked my question about the the wait time. I am concerned about us moving. The contribution for the employee from zero to seven percent. Are we doing that in one step we going to do it over a period of time. And. Yes ma'am in fact that was already approved in the last legislative session that increasing employee contribution it was done in increments it was done employees is it is being done incrementally that is what I thought it was but it seems here it's saying we just does it be from zero to seven percent and then give people a chance to adjust their income with the income be going up exponentially as well yes in L. I'm with you now this zero to seven percent for tier one on the drop is for new new hires only so this won't take into this won't go into effect and if you're if you if you are E. all passed this law. And it went into effect July first two we hired somebody on July first it would be thirty years before this goes into effect so the individual would come in what is a contribution right now zero no whenever the individual comes in ending becomes of employee they contribute seven percent okay. And very close to what we do is teachers to six point six percent bus that used to be and so it's seven percent now that seven percent that they pay their whole careers for thirty years then when they drop they hate when they enter into the drop if they just. Right now they pay zero percent but we're going to say for new hires because we're trying to keep the system healthy we want you to continue paying the seven percent of your salary into the retirement plan for new hires only win in thirty years when you go on the drop okay so. Instead of doing as the job drop used to do once you went into the drop the contribution stopped all of that so we're going to continue those contributions going forward in order to maintain the solvency of the system yes ma'am. Will you be the only ones doing that I will the apers and the rest of me doing that as well at a at my memory serves me right and I'll send you I have a chart that shows that you know comparison to all the systems bit sent some of those systems are already doing this there already you know once you go into tier two you start contributing again anyway but send systems are just containing that contribution all the way through while you're on the drop in if you look one of the big things we've done this time is our employer contribution will continue wallop employees on the drop as well okay but we didn't want to. The employer the Highway Commission determined we would start doing that if it's approved in July but we didn't want to put this new regulation on existing employees they were already under the and the perception that when they went on the drop they would have zero percent for five years so existing employees were not changing but new hires we are if that makes sense it does how are you selling the drop in because it used to be they sold it to us when I was in this thanks per started in that we went in the drop. we would not have to pay a. They would discontinue taking out the six percent or whatever it was at that time discontinue the six percent we can leave it in it would gather a interest so much would go to SO much would go to the system so what's the sale now what's the total package will the sale of course when I went on the drop it was like I got a six percent rate back then it was six percent because I got a six percent raise right. And but that wasn't that. I'm speaking for myself that wasn't the reason I went on the draw I went on the drop because I wanted to have the opportunity to save some money which you don't have that opportunity is a state employee very. So it allowed me to make a little mistake and that was what made me want to go on the drop it wasn't that I mean this six percent raise in salary ever your take home pay that was nice I enjoy that and to to I went on tour to it came back. I just say that I'm hoping that most people be like me that's not what's driving so you gonna sell it in that even though you gonna continue to make the contribution it is an opportunity to save money that you wouldn't ordinarily save right if you are just working as an employee that's right okay I'm just trying to figure it all out as we go to retirement how we gonna change of what has become a part of a systematic thinking as far as the drop programs are concerned that's correct but you know. I will we're just looking for ways to keep the system very healthy for employees and while the employer does it is doing a lot the employees have to do some things to as you probably well know so this is just an intent to keep things really healthy and viable going forward And you want to move from the of three eyes years to the five highest years yes ma'am as a money saving thing I'm just trying to get it all right yes yes and then discontinue the Health Care offset on drop accounts what does that mean well right now retirees that actually are not active duty not only drop their at home drawing retirement check they get what's called a health care offset offset some of the cost of their insurance it's part of their package part of the retirement package in its automatically deposited into their Into their account. Well active employees on the drop we're getting that same offset but we're already are insurances already we're paying part of it the lawyers paying part of it so actually it was kind of a little bonus if you're on the drop you were getting some additional money so this was like a double digit yes ma'am that's why I'm just trying to get to it quickly. Your calls my hand. Well anyway. That. Quickly we're doing away with the ballot please don't you want to give them an eight the double dip of that comes from the office that they're already getting the health insurance apportionment paid that's right to the employer they pay a portion of it and then in addition they were getting this amount of money yes this is going to come before the retirement committees I want to be prepared for conversation yes yes all right and reduce the marriage requirement from two years to one year to make a spouse eligible to receive the survivor benefit and then changes reciprocal service benefit calculation utilizing our dads high salary to calculate explain that to me because I don't know what you're talking about okay sometimes people move from old. We have an employee that came from another state agency it was probably making a lot more money and then they come to our diet and they enter our retirement system in there and it's reciprocal rights but there what we're saying is we're not going to pay your retirement benefit are not based on your high salaried and other state agency I don't know if we were reciprocating if they just happen to move from another state to here no so and all of the all of the system's going to do this very thing is a lot of people retire and make good money and then they just wanted. An easier job if you will income. Anyway we're we're gonna fix that were you you're right if you do forget to stay long enough you're gonna it's gonna be based on your high salary at our dot nodded into their state agency a. Not that that happens very often because normally hold holder. It used to be you had five years of reciprocity is that not correct anymore is that what you're talking about the five years reciprocity between states are not and H. E. R. S.. Look at the gross vehicle weight rating of your trailer in it those two combined exceeded twenty six thousand one pound or more yes Sir you would have to have a medic I mean a CDL the confusing part is is the ten thousand one pound or more is what throws you into a commercial motor vehicle which would require you to comply with all the Federal Election with the exception of having a commercial driver's license which is not required until is twenty six thousand one pound or more or and if in less you or someone that was exempt from have a CDO. Thirty seven a current lay if you you were talking about the lawn care businesses and everything like that there that that's a commercial business said what part. They still wouldn't be required to have a CDL even if they're over the ten thousand pound. And then we're looking at contractor progress and that's based more or less on the amount of work that's been accepted in the amount of time that's passed. And then you can look at the the time you can see contract days days added by change order any can kind of follow have the projects progressed in been Lincoln but change order with additional days. Then there's that hi chart that kind of shows you what what what the days at about change order are are about. And then of course the cost information so it's you know we try to put that into a format that sees your to follow easier to read so I'll just stop there and give you all the time to look through the report I don't know if you've had time if you have any specific questions about certain projects will be glad to try to answer questions or get back to you later if we can't.
