Okay members it's one thirty we're gonna start the meeting I'm gonna start by just giving you an update on some housekeeping items. A and for everybody in the room personal items will not be heard in the subcommittee will not be listed on the agenda unless the language is being requested to be codified non codified personnel related language will be heard in the personnel subcommittee their agendas and related documents are posted on the web for each meeting number two the agenda is structured so
if there any items held over from the previous meeting they will be dispensed out first today so we will do that on the items or held over from last time all agencies that have language with date changes only to be continued in the appropriation bills will be dispensed next all agencies with changes new language deleted language markup language codifications will be dispensed last. Amber three status in an email to all members of the subcommittee with a link to the special language manuals on the general assembly's website so
members can accept access the information prior to the meeting if any member is unable to find this information please notify us so we can be of assistance. And with that members you you should have in your package this says items held from the previous meeting. So we're going to start with that Mrs Hamilton you are recognized. Thank you Mr chairman good afternoon members as chairman
Hester indicated we're gonna go through this packet first these are items that were pulled out by members from our previous meeting there were some changes made to the language is only one piece that remains unchanged what we're gonna go first you Page nine in your special language manual we are behind the first tab that says we want. This is language for the health department there was some language that included the medical board the state board of
optometry and the dental examiners board this is employment of attorney language all three entities have got this language in their bill and it was put in one place once it was consolidated into the health department under transformation the request originally was to codify this language their concerns from members regarding the codification so what you are looking at now is the on codified version that will appear in the bill.

The next few items are similar we have on page thirteen the state board of chiropractic examiners this dealt with some investigative services language
for consumer complaints you'll also see similar language on page forty four were still in volume one dealing with the board of examiners in speech language pathology and audiology also investigator language and then we had some language on page fifty six for the ABSTRACTERS' board of examiners although it says professional fees this was also codified language that was going to be dealing with investigators there was a concern or representive Tosh regarding the requirements of these investigators and the
fact that there was no reporting so what you will see in your packet. On page thirteen. On page forty four in on page fifty six there has been language added to what is in the manual regarding the duties of this investigator the board has to contract with an independent investigator or private investigator to perform any work as required by law and they have to under this subdivision that's being added have enterprise or
background in this subject matter in which he or she is being contracted to investigate there's also additional language added requiring the board to follow Report annually on or before December one with both the Senate Committee on state agencies and governmental affairs and the House Committee on state agencies and governmental affairs and inclusion in report would be the number of complaints that have been filed the list of those have been investigated and the purported violations and a
summary of the findings of each investigation two pieces of codified language the additional requirements will be added to the codification the piece of language that is not codified this will be just added as new language and that's what will be in the appropriation bill. Page twenty one. Page twenty one December. This is language for the department of health we are still in volume one this is page twenty one this is legislative intent language everyone of the members had a concerned that this language was similar to what we call boiler plate language regarding legislative intent and other appropriation bills the point was made that this language is a little bit more restrictive because it dealt with tobacco settlement funds that have to be expended
in disbursed under initiated act one the member has accepted that explanation the language will remain unchanged so as you see it on page twenty one is how will appear in the appropriation bill. Nankana.

So there are two pieces of language that were recommended for codification for the workers compensation commission the first piece of language relates to their investment authority it grants the workers compensation commission authority to allocate how their funds are invested and they direct the treasurer's office how on how to do that the second piece of language relates to the final transfer once all of the funds are exhausted all the claims are exhausted from the second injury trust fund gives the workers compensation
authority to transferred the remaining balance to their other funds both of these pieces of codified language had in them that it would be the authority of the chair of the workers compensation commission. To to allow these actions to happen some of the members were a little bit concerned that only the chair had the authority so the members asked that we also include that the chief executive officer of the workers compensation commission with the approval of the workers compensation commission
do these actions so these are the two changes that are made all the rest of the languages the same. Any questions for members. Seeing under a motion I have a motion do pass and a second all those in favor say aye. Opposed say no. Motion carries. So. Page two.
Page two your gender age sixty two. happen members were gonna move to item C. on page two of your agenda these are all of the agencies who just have requests for continuation of language there are no changes and so the option is to batch the language for these agencies anything that members would like look that discussion pulled out we are able to do that so if you'd like to take a few minutes and just
have a look at the list and check the language in your manual we can we can do that. With. Mr I have a request on to page six under the assessment coordination department transfer provision I'd like to pull that out for a separate vote please. Without objection.

Members were still on page three of your agenda and we're still in volume two in your special language manual the first piece of language that we're going to look at is on page one this is a request for deletion James Perriman or Adam as we call it the analyst for this agency. Mr chairman you are recognized.
And thank you Mr our first piece language we're beginning on page one. This is also connected with the language you're going to see on page seven this is for assessment of vehicles this from act one ninety two of twenty twenty two this was meant to help more Kansans with hot again tire inflation as you'll see if a used vehicle was assessed in twenty twenty and again and calendar year twenty twenty two if the value could Rick had increased the assessment would not be hired its public value in twenty twenty.
The agency's action have this deleted because this was attached to DFA regulatory division and on page seven you'll see this is new to the new ones will be added to assessment coordination division. Our next piece of language with changes we're looking will be on page four. Page four is language with the legislative recommendation for codification. This language establishes a maximum funding level for the
cost of re appraisals at seven dollars per parcel based on actual appraisal cost. And in. Part that's part a of the language part be you'll see any expense in excess of seven dollars per parcel will be borne by the county and then below that also says expenses borne by the county can't come from funds given to the county by the state. And the exact recognition provides for codification.
Next piece of language with changes was giving over six. Okay going to page seven and this is the new language I mentioned earlier assessment of vehicles that is the same purpose as the deleted language and on page one but this is been this is added to assessment coordination. Which at and go over it again if used vehicles assessed and twenty twenty assessed again in twenty twenty two if the value of the vehicle is increased the assessment will not be higher
than the published value in twenty twenty. And that includes a presentation for. Process for nation yes. Representative Cavenaugh you have a question yes I have a question for this segment coordination. Department.
Good afternoon Senator Carter director process the coordination division thank you for being here absolutely I questions going to be dealing with the special language on that used vehicles yes ma'am our intent when we had this was that it would help the people not have to pay any additional monies on the use vehicles because the market had gone crazy because of the limited supply. Those assessments a lot of them had already been sent out in the county state want to have to
send out new ones is my understanding. Is that what. You recall. Well they re assessed the vehicles what they asked was that they not have to re mail all of the new assessments anyone was of course can come into the office and I can hand them one or whatever they just want to have to do the mass mailing I don't know if you remember I believe it was in twenty eighteen there was a little issue and they had to do a mass re mail and it costs the
county hello a lot of money especially the little counties that didn't have that in their budget and when that happens if a if a taxpayer gets the assessment with the wrong assessment and they pay by the mail. So they're paying higher assessment than what we ask them to do. No because we pay a year behind right so those assessments were done those actual values will not be taxed as far as the tax bill until this coming spring so
they have not sent out those bills yet exactly they will not go out March okay because I want to make sure that our intent was that they not have to pay it so we want to make sure that we're not. Bills no the bills will not go out until March of twenty three and then the other question I had is I have heard that there were some counties that just said they weren't going to to follow by that state is that true have you heard I have not heard of any counties that have
said that to me and as far as I know the software providers Changed it I've not heard I have not had a software provider tell me that a county refused to allow them to put the other database in their system okay I have not heard that thank you and Mister chair of the property thank you. On page four we have the. Assessment. Seven dollars per parcel. That number's been there since early two thousands my correct. A it was actually I think it believe it was two thousand the legislation that founded this of property reprisal was ACT eleven eighty five from nineteen ninety nine and that set the amount that could be in that fund at that time eight it has been seven dollars per parcel ever Eversense the rules were
promulgated I believe that was in two thousand. In a notice that most the county should have been reassessing right now are probably going to a three year cycles that a five year cycle yes representative we had seventeen counties that value this year and out of seventeen fifteen had enough growth to move from a five year cycle to a three year cycle let not increase the cost of the county use are all the county staying within seven dollars per partial to you know well a lot of counties do have additional
expense for this other than the seven dollars just because of twenty years of the increase of M. of personnel and of vehicles and all the other things that go into it I'm we still have a few counties that have that are at the seven dollars most of them are a little bit more than that and then of course some of the bigger counties they may be open to the nine dollar range. recognized the share ma'am you'd mentioned that the counties had to bear of a non budgeted large expense on doing those three males and then you also stated that no counties that you were aware of had refused to allow the new software to be added to their system because my understanding had a choice thank you have a software company bring the new data in order they could enter the data themselves is that correct. Well I'm I mean the only way for
them to have done of the second to just enter it would have been for them to override the existing data set that was in their system and they would have had to have a huge manual and had to slip and go so the software providers win in and re did it with the old data set of the values that that you as the body had requested and just put the took the old data set out or the new data set out to put the whole data set it was my understanding that that that the software provider said we can
give you the data and you can kidding yourself or or we can do it as a software provider. But it was my understanding that if they chose that path of software provider to to do the work the county was charged for them doing that. I have not heard that I have not had an assessor tell me that okay I think we should probably follow up on that I think our counties are being charged a fee for that software provider to enter that data into their system and certainly not something that county's ask for
that and they may have certainly charge them just for removing the database and putting another database backend that may have been a charge that they have sent out but I don't have a knowledge of what that charge monthly and you check on that please I sure will thank you. Members we are still on page three of your agenda we are going to go to department of finance and administration disbursing officer that starts on page nine in volume to.
Mr Berman you're recognized. Thank you Mr. Our first piece with changes we're going to start on page nine this is for pregnancy resource center grants this is why was it was attached to act one eighty seven of twenty twenty two a standalone bill for disbursing officer is also connected with the language on page special language on page eleven. This is stab wishes the definition for pregnancy resource resource centers and then you'll see in section B.
and C.. Gives the party finance administration the authority over creating a grant program to disperse grants to pregnancy resource centers. On page eleven use. You'll have the funding language or the language for the funding transferred establish a one time transfer of one million dollars from the rainy day fund for the pregnancy resource center grants. And as this was meant for a single year the agency is asking the same this one was to be deleted and the second
recognition fine for the agency request. Our next piece of land has to. Changes we're looking at Page twenty six. Is another piece of language for codification. Language with recommended legislative recommendation codification sorry this language states that the department of workforce services division of workforce services will file a quarterly report. Flipboard certifying benefit
payments that are made to former state employees this is related to disbursing officers unemployment compensation claims section. And then also says that upon satisfaction from this report Jesus lots of the state shall reimburse the agency for the payments that were made. Date and exactly recommendation provides for the codification of this language. Our next piece of languages changes is on page thirty.
This is set up a time reporting. This is language once again with the legislative recommendation for codification. It states that every even numbered year the chief fiscal officer of the state shall file a report with Arkansas Legislative Council summarizing all transfer appropriation and additional positions in relation to unanticipated federal funds. And the second recommendation provides for this codification. The next piece of language. This is page thirty five.
This is language asking to be deleted because it is already codified members before we actually make a motion on this piece of language I want you to see what the language is I noticed in your manual as as just a week. The staff is handing out the language as Mr payment indicated this is language that has been codified. But since the members are familiar with that I wanted to make sure that you understood what we were looking at this is
language dealing with credit to the indigent patients fun yes but as someone said the original title was credit to the indigent patients fund which is tied with the indigent patients fund appropriation in disbursing officer. The language itself states that all revenue derived from the fifteen extra days of greyhound dog racing would be remitted to ASU mid south been deposited a special revenue. As credit to the indigent
patients fund that would then be used to defray the cost of hospitalization of Arkansas patients and healthcare facilities and five delta counties. And then also there's the process of how County and certify the CFO and get the funds disbursed. And I said for the recommendation is for deletion as special languages already codified in the executive recommendation provides for the agency request.
Our next piece of language with changes we're looking at page forty three. And this is also connected with language on page forty four. Both of these pieces of language relate to the fire and police pension appropriation. Page forty three this is language for with a legislative recommendation for codification. You'll see in the first paragraph that. Arkansas police Arkansas fire and police pension review board certifies to the state the
amount of funding recommended for disbursement then section two would be the actual disbursement of those funds. For payment of the firemen police pension officers pension for relief fund. And the accompanying language on page forty four also language with right what's a recommendation for codification. It states that the funds distributed with that previous special language shall not be used to enhance benefits of the recipient's. And the second recommendation
provides for codification of both pieces of language. Our next piece of language with changes is going to be on page fifty six. This is language with a legislative recommendation for codification relating to workforce development fund workforce two thousand Development Fund biology's. The language states how available funds are to be distributed from the work force two thousand program including
limits on how much is available to institutions. Rules in case an institution changes its status within the system. And limits on what those funds can be used for. And the second recommendation provides for the agency request. Our next one which is on page fifty nine there is a hand out the look company this. If you bear with this members in
your manual on page fifty nine were still in volume two there is a recommendation for deletion of this language. Legal department has since looked at it and conferred with members and there's an alternate recommendation and you will see that in the handout that is coming around okay. Yes this is languages for intrastate metro planning grants. The language stated that authorized funding would be evenly distributed among planning and development districts. The language is rigid was
originally asked be deleted as the west central Arkansas economic development district was already recognized in code. But the language they're the stated that the grants would be evenly distributed was not in code so the agency has to have this replaced with a revised legislative recommendation. And the revised at legislative recommendation is in front. And executive recommendation provides for this agency request. Our next piece of language on
page sixty six. This is for the law enforcement side and grants. And it is also connected with the next piece of language on page eighty five. This first piece of language refers is from these are both from act two twenty four of twenty twenty two. A standalone bill for disbursing officer. Where this creates the problem the first use of language outlines the requirements eligibility qualifications and procedures for the law enforcement stipends grants.
There was fifty million dollars authorized in this second piece of language on page eighty five outlines the funding transfer for that fifty million dollars from general revenue a lot reserve. You also see on page eighty five that any funds not expended. After June thirtieth twenty twenty three would be returned to general revenue. As this was a one time program and the agency is also is asking language to be deleted because it was a one time program and the executive recommendation provides forty agency request.

volume two we are going to move to state parks and tourism we're going to start on page one of one Mr parishes the analyst for this agency. Paris you're recognized thank you Mr chair on page one on ones for state parks heritage tourism and the first item is Arkansan major historic rehabilitation trust fund this language that was recommended by the executive this is not an agency request the language allows a secretary
to transfer up to fifteen point two five million from the general revenue lotteries are fun and that's to go to the Arkansas major historic rehabilitation trust fund that is to offset costs of that tax credit program that was enacted in two thousand nineteen there is also an appropriation section that was requested by the executive to provide spending authority for these funds yesterday in budget hearings of the committee did not adopt the executive recommendation to establish this appropriation.
The next item is on page one of two this is for parks budget allocation this is going to codify this section along with purchase uniforms there's two sections that's one oh two and then this section on page one of eight request today's to pass over this item it will be revised and reworked there were some concerns were identified so we'll move on page one on nine. One page one oh nine is the tourism attraction feasibility
grant program this is a legislative recommendation for codification and the executive recommendation provides for codification language authorize the division to make grants to cities and counties on a one to one dollar matching basis as up to fifteen thousand dollars per Grant for feasibility studies in tourism attractions this requires notification of Senate and house members of an award in their districts in there no changes other than codification the next item is on page one eleven. On page one hundred eleven is
employee contracts this is also legislative recommendation for codification the second recognition does provide for the confirmation the language authorizes the department to contract with employees for the provision of golf lessons at the department's golf courses outside of normal working hours of the employees must be certified to the office of the Asian and the compensation from these contract is not retirement eligible there are no other changes other than codification of share those are all the languages they have a change.

If the language isn't adopted by the subcommittee will not be incorporated into the appropriation bill but will the bill or go back to the no you won't see it when the bill is drafted and it goes back to joint budget you will not see it included in the appropriation right I just wanna make sure it will go back to but yes the bill that we don't have to take any action here to move it back over. Okay.
Members were still on page four we're going to move to the department of the military Jennifer Rika's analyst for this agency we're going to go to page one fourteen we're still in volume to. This record and then five seven you are recognized. Thank you Mr chair Jennifer a fiscal analysts with bill Maher. Are gonna get military says on page one fourteen they have two pieces of language that they're requesting because of fights actually a legislative recommendation.
The first one is the extra help languages extra help positions at camp Robinson or effect for Chaffee they shall not receive pay that exceeds eighty five percent of maximum annual salary for a comparable position and they cannot exceed eighteen hundred hours per fiscal year the executive does provide for this request and on page one fifteen is another codification. This is.
Regarding the State Military lakes they can stock the fish they may start the fish each year for special event by using fines maintained in the camp Robinson public find and rental income but they shall not use stage general revenue.
