Tony Europe is chairman thank you committee members we're working on this one in the first I want to talk about on top your packets this morning is a personal reference guide we just want to go over a few things this morning before we start service kind of clear on what we're doing personnel committee is responsible for setting the classifications and the number of positions that are going to be in these agencies appropriation bills next fiscal year going into the session so what you'll see first legislative authority gives the legislature the authority to set the positions set the salaries set the the number of the positions in the classifications we talk about the personal committee duties we're gonna look at every agency division department higher ed institution constitutional agency they're all gonna run through here and I'm gonna send reports back to A. L. C. JBC. Terminology we're gonna use we're talk about individual positions so that's you know basically one holder for one employee when we talk about a single position a classification that's the job or the job title assigned to a position the pay grade that's the salary range that's paid to the employees that set a pay grade is the same if if you have a job however many positions you have with the same job they all have the same pay grade okay cross gray downgrade this is gonna be a big one this is where an agency has a position authorized for the classifications of state authorizes an accountant the agency is decided in the interim that they don't need that account at the moment but what they really need is a project manager and so they may cross great downgrade that position and use it as a project manager as opposed to an account what happens is if they do that for long enough OPM recommends that that become permanent that you you really don't need that account anymore you need the project manager in your appropriation bill reclassification this is the process by which we switch over that accountant to the project manager they have to ask for this and what it looks like is your authorizes an account in one year the next year the same position be authorized as project manager classification upgrade this is increasing the grade of a job that's all it is if a job is currently authorized at a grade GS ten and they asked well we need to be a GS eleven because we have a hard time keeping people this is what it is when when we authorize an upgrade and in the committee it doesn't authorized very many of these it affects every position in state government authorized with this title so if we were to authorize an upgrade for administrative assistant that's a title that used across every department every division in state government it would affect all of those employees and positions title change. This is simply changing the title the job it doesn't change the great it doesn't change the duties all it does is change what we call that particular job you're gonna see a lot of these this year because we have new prefixes coming in because of transformation so a lot of the titles that are at the department of health all got an eighty H. prefix added to their title department public safety you're gonna see a lot of DPS prefixes added to those classifications. as we switch over the back page special language we are going to hear in this committee special language that is related strictly to personnel that would affect classifications positions pay grades for some reason we may look at Increase salary rates for certain meeting certain criteria three special language but those are things that we're going to hear in this committee and report back to a LC JVC As we go for hearings in duties. This is just kind of the process that we go through agencies have. Going through a process with OPM and with the F. and A and. To put in what they need for next fiscal year that's what is in these reports with OPM's recommendation with the what changes need to be made and these reports only represent changes that have been recommended we're not gonna go line by line for every position at every agency D. at DHS in and of itself I think has six thousand seven thousand positions so what we're looking at for each agency department division institution are the changes that have been recommended for them session duties so right now hearings we're gonna hear every agency we go into session we will only hear the agencies that are sent back to personnel by JBC generally those are gonna be agencies that have additional positions added to them or if there have been changes made maybe by governor's letter or a member amendments they get sent back to personnel for review again. the next page we have there's been some questions in a or C. JBC this year we've talked about authorized positions verses budgeted positions so we just kind of want to walk through this everybody's on the same page about what that is and how this works so when when you establish and agencies appropriation bill through the session we're gonna seen that a particular agency as a hundred positions authorized an appropriation bill okay during their annual budgeting process so when they go into the next getting ready for the next fiscal year with that appropriation bill the agency decides that they can only budget AT of those one hundred positions that may be due to the amount of funding that they have it could be due to the number of positions they've used historically but for whatever reason there budgeting AT positions so twenty positions are left in those positions are what we consider on budgeted positions now assuming those positions are vacant the you know because they're not using them either read insurance nor retirement is paid almost twenty under budgeted positions at that point they're just words on a piece of paper in the appropriation bill it's data and asus in P. bass in the database that we're keeping track of but there's no money being spent either by the state by the fence by the division by the department for those positions now that leases AT budgeted positions Let's assume that ten of the eighty are vacant. Those ten positions even other vacant the agency budgets for them because they may feel in during the year so we now we got seventy budgeted positions are filled ten positions budget positions are vacant insurance will not will skews me will be paid on the ten vacant budgeted positions but retirement will not okay so the money paid to those vacant positions goes into the EBT fund this sets the cost of insurance for state employees and retirees and pays out the insurance claims insurance and retirement will only be paid on the seventy positions are currently budgeted and field if any of the ten vacant budget positions are filled during the fiscal year the agency will start a retirement when they are filled okay so there's questions about that we just want to kind of get that out there that people understand what this is and how this works and we one answer any questions is anybody might have at the moment You Mr chairman the only other thing is on the back of this document I've put that pay plan so as we roll through these requests if you have a question I mean you can ask the question on mine but there's a PAYPLAN back you can see with the pay ranges for any given pay great okay. We budget for a certain areas that are hot that have all that are harder to feel because of where they are what we call that I can't remember the term it's a geographic differential senator okay and it's not in here right no ma'am we won't generally discuss that that's generally something we talk about during the interim when the agency brings a plan to the committee where they want to pay it geographic differential because you're right because it's hard to feel for whatever reason okay that's what I need to know because I kept thinking that perhaps we would have that in here as well thank you Mr chair. All right Tony we're gonna go ahead and get going on item B. one the Arkansas public defender commission I Mr chair Mister angel is going to present that agency down through item for I believe yes Sir. You're ready thank you Mr chairman. I'm the one is Arkansas public defender commission. They're currently authorized two hundred and seventy six positions that'd two via the growth pool in the interim a systems specialist I DO six in a public defender program coordinator GS six the committee report your personal committee report you'll see that on lines eight and nine of the first page. These requested to bolster the public defender I to support and handled us a higher workflows that they're seeing right now. Section of the report story on line sixteen in fishing report out our hundred and seventeen re classifications the idea here is to bring the attorneys up to a higher classification to give public defender some flexibility to re class and adjusting to folks around as they need to there no raises anticipated at this time. Of the titles being affected here or a public defender to just twelve those public defender one fifty two public defender Attorney one fifth there's fifty of those. And public defender there's three of those all those be going to public defenders three. Of these to put to put positions and every classes bring that requested two hundred and seventy eight positions as an increase of the two positions. There's a piece of special language Mr chairman is continuing language in egg it exempts extra help positions for the commission for parent council from limited hours worked per year. It also allows personnel working part time to be utilized as extra help with any agency. Total compensation for personnel working part time and as extra help is capped at the maximum of the grade GS eleven the language is needed to provide flexibility for personnel who were serving clients that have nontraditional work schedules. Next section contains four title changes these are real lines eighteen through twenty one of the first page. Those are investigator for to investigate a one. A. S. P. chief information officer to DPS chief information officer. AS P. for chief fiscal officer to DPS fiscal officer S. P. program manager to DPS program manager and I want to know if the staff does not recommend first title change on line eighteen the investigator fort investigator one this change will adversely impacts and personnel the AG's office as well as some folks already DPS these being reclassified later in the ports of negates the need for the title change here. DPS edit three growth to positions in the interim the store on line twenty six page one go to line six on page two. The last session starts at line nineteen shows for positions being transferred to DPS admin insured services and the position is one of the session note. The net request for solicits for forty nine positions as a decrease in the four being transferred out. The next division. B. four B. crime lab. Currently authorized one hundred fifty two positions the requesting a new classification DPS chief fiscal officer GS thirteen. On the first page on line nine is where you'll see that need to be re classified and transferred later in the report. And they're on the crime lab made for requests from the opium swap one these on the first page of your report you'll see those on lines fourteen through seventeen. The crime lab request to re classify to positions lines twenty four and twenty five on the first page it's a crime lab scientific operations manager GS thirteen. To DPS chief fiscal officer GS thirteen accounting operations manager GS eleven to a forensic administrators GS eleven. The transfer in sex positions to DPS is administered services division the star on line five of the second page they go to the end of the report. These changes request of one hundred forty six positions as a decrease of the six being transferred out. Special language Mr chairman its new language that allows a crime lab to pay a maximum of fifty percent above the maximum salary for to positions crime lab director for the medical exam division and crime lab associate medical examiner these request this language is requested so the crime lab can recruit and retain personnel for these positions. The next item before seat state police. Eight ball a question is do we get to the end. Senate we were gonna try to do all of the department of public safety but if you have a question that need to be asked right now you're recognized I sure appreciate you that but I need to know last the staff reckon the executive Rick a different. And why we this growth I'm still not sure about the growth drop on page one from ten positions to ninety five and I need some clarity on that and then I'm I'm happy to move on Senator the the staff recommendation is different because that title the queue five seven U. that that job title existed the attorney general's office it started at the attorney general's office transformation pulled crime victims reparations program from the AG over to state police and so it pole with at this particular classification well. By making this title change from investigator for to investigate one it is it would inadvertently change it at the attorney general's office as well so that's the number one reason we don't want to change number two is the positions that state police in DPS have with this title two five seven U. their reclassifying those positions to something else anyway so indicates the need for this title change so we just did it because if it because it's not needed at either one of those entities and it would and rightly change the AG that's why we we recommended not to do it okay and in going from the ten to the ninety five that is the transfers that are coming out of the different divisions of the department of public safety state police emergency management Suppose Celeste all of those divisions gave up positions to the department of public safety's shared services division back in June and July okay and so what they're doing is they're wanting to make those changes permanent so we're shifting those positions permanently up to that shared services division which is agency ninety nine thirteen but it will not increase the cost no ma'am the money the money the money went with the funding the appropriation all goes as well with these positions okay so we're not we're not growing state government here we're just moving things around so with the course but that the growth of ten to ninety five those eighty five positions is negated by the elimination of the eighty five for the movement of those eighty five positions out from the other divisions okay. Is this supposed to save money or disposed to maintain it because transformations bills be all about saving money. I'll let somebody else into that question I believe that's a topic for another committee okay Senator thank you. Thank you Mr chairman this question it might be for the agency. it's in regard to the a recommendation from the task force in regard to the law enforcement standards and training and the recommendation that they made. A. To the county sheriff send the cities to reject federal immigration program I would like for them to I would like to hear some more about that explaining exactly what they meant by that. All right is there anyone here from the commission on law enforcement standards. Morning David introduce yourself for the committee will get that right to the question good morning I'm Jamie cook on the secretary for the department of public safety and also the director for the commission on law enforcement standards and training also serve on the Arkansas. Enforcement task force to advance the state of of law enforcement here in Arkansas I Senator Stubblefield let you not discuss the recommendation from the task force once I believe because I was gone at the time and I will say of the at the time that this recommendation was made a lot of the task force was gone so I expect this recommendation actually be revisited prior to our final report but the recommendation was made to not support the two two eighty seven G. programs that we have existing here in the state of Arkansas the two eighty seven G. program is a vetting system for the first one born of persons in our country who are arrested and booked into the jails the two programs that we have in Arkansas at Benton county and cricket county. I will say that recommendation was made as share for weed at cricket county already left the task force meeting as well so I expect he has some things to say the recommendation was not that the task force recommends we don't Enforce federal immigration laws that had to do with the two eighty seven G. jailer program is so this recommendation would not come in conflict with the century city law no Sir. I guess overall made maybe the agency can give us a little bit better explanation of. What their anticipation for the need of this is. Okay you want to take that one. I will be happy to start but I think the director from life is coming up all right what happens over this past biennium as we did approve special injure right up to the maximum for both these particular time. We did a pretty special into rates for these titles up to the maximum over the previous biennium however they still have not been able to fill these positions so this language is somewhat modeled after what the med center uses which allows them to go above the maximum in times of critical need and our report that if they do decide to use this language that come back to personnel committee to get final for okay so that would happen I guess during ale see in the interim if necessary to come yes Sir and it's just for these two positions right both two title to the eligible assistant medical examiners okay so how many are we talking about total. Would you can introduce yourself for the committee please and thank you guys for the question my name's karma channel on the director the state crime lab thank you and for this we've got seven positions we have two that are on filled and so what are you know could affect when we hire could affect the apps you all seven but the real intent is to be able to get out there and recruit and which is vitally important because we have had no success and attracting a qualified personnel for the job my chief medical examiner he's already basically stepped into an associate position to give us the ability to hunt for chief and we're we're authorized to go to the Max at two seventy again with no success or so should medical examiner we are authorized to go to one ninety nine which is mid for that position and again no success. So I believe this is important special language because if we don't attract appropriate personnel for medical exams for the state of Arkansas then it's it's not gonna be good force in in any way shape or form or any citizen of Arkansas wanted death certificate it's also very important to a for accreditation because already were like my medical examiners are over stretched on the number of cases they do and which alternately what that means is losing accreditation tradition as you all know is extremely important to give confidence to the citizens of Arkansas that we're doing a good job and we're doing the necessary work that that were paid to do so it's it is the other ancillary thing to that if we if we don't address the situation and we cannot track personnel than we can lose your accreditation which also means we're going to lose our credibility in court road billing for means when be losing some cases so it again it's extremely poor legislation if there's anything in the laboratory the keeps me up at night so that one and this will give you the the opportunity to increase the salaries of the already existing fill positions as well absolutely and and to notify look my existing I've got three apologists now that I've got to that are sixty five. One that so actually sixty six one the sixty five and and my closest next one is forty eight so I've got three that could potentially go to any time but this will give me the ability if I have a successful candidate it'll give me the ability to negotiate a salary no of course with the approved by committee okay thank you. Thank you Mr chairman is is I understand this this but this is an ongoing problem that we've addressed in personnel or attempted to through salary increases or adjustments and understand the city of Memphis pays more for their person then then you're able to but hear my question also is is is not also affecting the process of the court prosecuting attorneys and being able to move cases for which. Right now we're able to do that effectively because with the limiting staff again we're over taxed and they're basically we're we're doing too many cases but you're exactly right Representative city Memphis looking for chief at three hundred thousand in their own successful at that so it is a problem I do want to you all to recognize that this isn't just a problem in Arkansas this is a problem across the nation they're only possibly forty board certified forensic pathologist coming out of program so we have to compete with all of that and that's a daunting task but we have to obviously because we're gonna affect the court system which is is gonna be detrimental. Madam secretary of these ninety five positions were verses ten. It is a as presenting senator Chesterfield questioning these are being cooled and what you what I would call central office is that true. I believe those ten positions that you're reference and are the ones that we absorb from the crime victims reparations board which came over to us from the attorney general's office and the liso blog fortunate support office that came to us from. Career in I believe so that would those are the ten positions. Mr Warner my correct on that. Okay but I will be sure and stand with the the ninety five. The ninety five a request in Chloe's will be drawn from the agency's making up your department into your central office yes are we pulled in all of our human resources personnel fiscal personnel and legal personnel and information technology person there's no okay will they be will they be performing the accounting functions in that time sighing yes I mean they'll they'll they'll your yours this will be your central office appropriation relative to your role coverage of all the agencies that are listed here yes Sir the core yes Sir that's correct thank you Mr chairman. If we were to provide legislation that would incentivize individuals going into this particular area since there's such a shortage. Is Senator basically we've looked at this from a wrangles and and one of the things that we're doing we have a bill During the session that will actually help us with loan forgiveness okay and the idea with that is again another incentive for someone coming out I mean these individuals go for thirteen years for education when they come out they have a on average three hundred to three hundred fifty dollars three fifty thousand dollars with a student loans. so what the bill that hopefully you guys will see will actually incentivize them at twenty five thousand dollars we crime I would have to promulgate rules to set up everything necessary for that and when they get the twenty five thousand dollars are obligating themselves for another twenty four months the maximum out that they could retreat could get I would be a hundred thousand dollars We didn't just come up with us you did some research and found in Maricopa county that they were successful in a program like this and they're able to obtain they have seventeen medical examiners or have been very successful in retaining can keep in the so we have a plan okay yes ma'am our thank you thank you Mr thank you senator. Mister chairman next item state police. B. four C.. The current authorized one thousand ninety three positions. And on the person or committee report on the first page lines nine and ten they have a request for two new classifications AS P. driver's license examiner supervisor GSO six DPS executive assistant yes eight. These be utilized after the positions or reclassified later down in the report they're eight title changes for state police and like admin and sure services step doesn't recommend the first one line fifteen it's the Q. zero five seven U. investigator for investigator one just as before. A state police have any MSG position grants coordinator GS seven if you look on the second page see that on line five. There's seventeen three classes there on page two is well lines twelve through twenty five. And you'll notice that the investigator that's been mission for is a first one line twelve. State police wishes to transfer fifty three positions to DPS is admin insured services division these begin on page three line five they go all the way to the end of the report. State police total request is for one thousand forty one positions as a decrease of fifty two and that reflects the transfer of the fifty three and one MSG. That's it for state police. Next item is be FOR D. Arkansas crime information center also known as a C. I. see their current authorize seventy four positions. Of this the requesting a title change a see I see division manager to DP S. division manager was on the first page eight line eight. Was thirteen fourteen have to swap two positions that a CIC. Which is made permanent DB administrator I. T. O. eight and information systems security specialist at IT seven. A CSE request six re classes the star on the first page line twenty one and they go to line six of the second page. The rest of the report list twenty one positions being transferred to DPS administered services and brings a CI sees request a total fifty positions as a decrease of twenty four. Moving on. A and B. forty is a department of emergency management also known as Adam. The card authorized one hundred and ten positions the requesting five re classes lines nine through thirteen personal committee report. And transferring a state systems administrator lead IT own nine to DPS is administered services division. Seventeen division of Arkansas state board of physical therapy which is to authorize positions in executive recommendation provides for one title change item seven C. is a division of Arkansas social work licensing board which has to authorize positions in the executive recommendation provides for one title change item seventy division of state board of chiropractic examiners which has to authorized physicians in executive recordation provides for one title change. The next item is seven II which is a division of Arkansas state board of dental examiners which has three authorized positions in the executive recommendation provides for two title changes. Is the division of dietetics licensing board which has one authorized position and is that gonna recommendation provides for one title change I am seven G. is a division of Arkansas state medical board which is forty one authorized positions in executive recommendation provides for one title change I am seven eight is a division of state board of nursing which has thirty authorized positions is that a recommendation revised before title changes in five request occasions which are reflected on lines eight through eleven and seventeen through twenty one respectively.
