Senator Jason Rapert Unverified 0:00
We've just got a couple of things here to deal with. So, Senator... I move we adjourn. Well, that's a little early, but I think that's coming soon. Your representative is coming. I move we censure him. Yeah, yeah. We got one last shot at that, don't we, Senator Chesterfield? Okay. Well, members, thanks for coming back this morning. We just got a couple things. So we've got three bills that are actually live on the agenda. The first one, without objection, we're going to go ahead and move House Bill 1958 to the deferred list. That one was really pulled down last week. I probably should have mentioned that already, but that is on the deferred. And we've got Representative Gonzalez. We'll be preparing here. We'll get your bill next. But first thing on the agenda is Senate Bill 592. 2. Senator Elliott actually has this, but I believe Senator Chesterfield or Bledsoe 1 is going to run this. So whichever one of you would like to take that up, let's go ahead and handle this, and then we'll be

ready. Okay. Senator Bledsoe, you're recognized for presentation of the amendment. All right. Thank you so very much, members. This is a concurment in the amendment. We've already heard the bill, but I have with me David Roten from the Medical Society, and he's going to help with

the concurment. Thank you. David Roten with the Arkansas Medical Society. The bill's passed down here. We amended it down on the House end to add some language that the insurance carriers wanted and we agreed to so that a physician that's terminated from an insurance company can also be for anything that could cause harm to a patient. In the original bill, it just said they violated the standard of care. We've added language that says or they have done something that could jeopardize the safety of a patient. Okay. I have a motion for

adoption of the amendment. From Senator Chesterfield, I have a second from Senator Teague. All those in favor say aye. All opposed, no. The amendment passes. And I have a motion. Just to concur and send an amendment. All we have to do is concur in that. So I have a motion again there just to make sure we're on par. A motion to concur in the House Amendment and send it on to the Senate floor. All those in favor say aye. Aye. All those opposed, no. The bill is concurred and moved on to the Senate floor. And Representative Gonzalez, I believe you're up, sir. Thank you, Mr. Chair. Full committee.

You're recognized for presentation. detail of a description do you all want on this bill a good one this is a bill from the ag's office it keeps our most vulnerable populations from getting messed over by bad dme companies okay they have any here

Senator Jason Rapert Unverified 3:33
anyone here for it this morning yeah do you have anything you'd like to say on the

Speaker 19 3:41
bill sir just state your name and who you represent what it actually does is stop false advertisement from dme companies if they're advertising that a device certain device will get paid for without a prescription or recommendation from a physician or provider they can't advertise that anymore they can advertise it it you know that about their product but they can't say that it will be covered so what's happened in the past they'll advertise hey if you come get this wheelchair, whatever it may be, you know, your Medicaid or Medicare will pay for it. That's not always the case because you can't get it approved by the provider. And then they get the patient ends up getting stuck with a bill. So this prevents that. It gives a mechanism for them to give that device back and not be responsible for paying

for it. Does that actually, does that have anything to do with television advertising? Because I know I've

Senator Jason Rapert Unverified 4:38
seen those ads on major television. So either one of you, is this bill, because a lot of that's national advertising, so how will that impact? You're still going to have national advertising hit the screens in Arkansas. That'd be a question for this guy, not the

legal mind. Good morning, Mr. Chairman. Sean Johnson. I'm a senior assistant attorney general with the Arkansas Attorney General's Office. It could affect that sort of advertising, but the bill only prohibits any company from saying that it will, that Medicaid or Medicare or some other payer will cover the durable medical equipment. And that's what sets it apart. So

Senator Jason Rapert Unverified 5:16
they just, you're encouraging them to change a word to be more honest, that it might cover it. Is that it? It could

Speaker 29 5:24
do, could do. And this is an opportunity, though, mainly for a consumer to be able to return a product that they didn't realize would not be covered. Routinely, a consumer will receive an item that they have bought because they saw that ad on television, an item that their doctor does not believe that that consumer actually needed, and then the consumer receives it. When their payer won't pay for it, they then have no recourse to return it. What this bill would do and this statute

would do is authorize that consumer to return that product. Very good. Senator Chesterfield.

In many of these advertisements, I guess I'm one of those who reads the bottom line, because I don't believe most of them. Would Arkansas be added to that list of names of states at the bottom line? Is it possible to get us there because it says not accepted in so-and-so, Nevada, California, da-da-da-da-da-da? Would that lead to that? Senator, it

would be up to their legal counsel to determine whether or not there needed to be a disclaimer there, but it very possibly could.

Okay. Thank you for the bill. All right. Yes, thank you for bringing that. Thank Attorney General Rutledge for getting on this issue. Representative Gonzalez, do you have anything further? Close. All right. Is there anyone that'd like to speak for or against the bill? Seeing none, I have a motion do pass from Senator Chesterfield. I have a second from Senator Bledsoe. All those in favor say aye. Aye. All those opposed, the bill

passes. Thank you, Representative Gonzalez. We'll be looking for somebody to carry this on the Senate floor. or if one of y'all wants to think about

that. Well, one of my colleagues might love to do it. If they don't want, I'll be happy to run it on the floor for you if you want me to. So we'll take care of that. What's that? All right. Senator Chesterfield is going to pick that up for you, Representative Gonzalez, and I'll be there to support her. All right. Well, members, that's right. Members, we don't have anything further. It's been a great session. Most of our heavy work got done early on, and so I appreciate the hard work. Senator Chesterfield, thank you for being here. I know this is your first time, and you've done very well. But appreciate all of you. And, again, thanks to the staff for all that you've done, and thanks for all the people who have been here throughout the process to help us. All right. We're adjourned.
