your bill. Thank you, Madam Chair. So, members, House Bill 1209 and I think it's H.R. 1005. These are the same thing, but we've got the same language in rule as we have in statute, so we've got both. But this is when we visit about rules a few weeks ago, this is a rule that would broaden the scope of the transportation committee to include energy, infrastructure, energy, and environment. I'm not going to belabor the point since we've already talked about it once, but just to remind you that the thought was broadening the scope there, you would get infrastructure-related items, environmental issues, so on and so forth, perhaps in front of a committee. uh that was more interested in those issues those things are many times intertwined it's hard to talk about one without the other uh and practically speaking would shift a little bit of workload off of public health over to this committee um visiting the representative warlaw earlier he had a few concerns about some health issues and just want to restate it doesn't take anything away from public health so if there was a a issue fluoride bill is one i use for example that would probably still go to public health that's not really an infrastructure issue it is a public health issue so it doesn't mean that you couldn't put issues like that bills of that nature into public health would just broaden the scope of the transportation committee to include more infrastructure and related issues we have to take any questions

was really going to be quiet till they call me out my my issue and as as a member that served as chairman of public health is a lot of times and i explained this represent days earlier you have multiple departments that testify on certain bills so a lot of times you'll have a bill such as fluoride where you have adq and you have department of health if you split those out into department of transportation and Even if it is a storage tank issue, if the Department of Health had to be in two committees, you're now splitting apart how many people have to be at the Capitol and where they have to be. So that was my concerns, but from talking to him, sounds like he has a plan for those things to stay in one committee, but still a concern I have when you get to split in these departments across because you're looking at more people to work as government relations, more cost and all those issues. but thank

hr 1023 okay 1023 committee this is a rule is there an amendment on it there is an amendment okay you're recognized to present your amendment okay this is amendment uh in rule that have to do with committee selection the amendment is basically uh several changes taking some language out of the proposal that representative jean had uh myself several other members have visited since we first introduced all the different options that were filed and proposed and the amendment basically is a handful of agreed upon changes to the rule to get it where I think most people support it.

you're recognized to present all right thank you madam chair thank you committee okay so hr 1023 as amended now committee would change our committee selection process back to a process where members choose their committees by seniority as we discussed last time we talked about these the process would be for everyone to select their committees in the house chamber in order of seniority from one to a hundred greatest least we do that process once for a committees once for b committees and then once for budget audit and council a couple other changes to note one thing that we just amended in was language that originally proposed by representative gene that would allow the speaker of the house to make adjustments to committee membership following committee selection process only for the purpose of adjusting the majority and minority party ratio so we talked to practically how this would work so everyone would pick committees one to a hundred by seniority a's b's and then the big three there is no requirement in the rule for a particular majority and minority party ratio or makeup there's no limitation on how many people in minority party could select a committee we do maintain the four congressional caucus district makeup so you still are limited to five people from each congressional caucus on a committee that's how it's always been that how we get some geographic distribution across state on all our committees so we maintain that um this would give the speaker let's say um one committee uh let's say the makeup was similar is now but somehow we ended up with one committee that had a majority of the minority party on it the speaker could make adjustments but he's limited uh if you look at the amendment that's on the second page he's limited it's first of all he can only make adjustments to change the majority minority party makeup second he can't do he can only adjust it to the point that the majority party has a majority on the committee so let's say let's see this language says specifically adjustments to committee membership made by the speaker shall not exceed placing 11 members of the majority party on a 20 member committee so let's say the minority party had 11 people on a committee the speaker can't take six of them off he could he could take two off just to swap the majority-minority make-up. The other caveat on that is that the final committee membership and the announcement of any adjustments the Speaker makes has to be done no later than House orientation in December. One other provision in this that was in H.R. 1023 as originally proposed was a provision for trading. We did trading in the past when we had committee selection by seniority. This more or less formalizes that trading process. You would have until the end of the business day on the day that we select committees to make trades. It would be more formalized, similar to pairing a vote where you would need signature of both members or caucus leader and the speaker. So any trades that are made, you'd have conceivably several hours to do that. You have to make that trade by the end of the day and have the approval or checkoff of the speaker and your caucus leader. Make sure I cover everything here. Yep. So in summary, you pick your committees in order of seniority, one to 100 in the chamber. We maintain five members on each A and B committee from each congressional caucus. You have the ability to make a trade until the end of business that day, and the speaker has the ability to make any final adjustments necessary to may, it is permissive and doesn't require him to, may make an adjustment relative to minority majority party makeup on a committee any questions

to present it in its entirety thank you madam chair members uh just to quickly go over the amendment the amendment strikes all the language from the original resolution and the amendment is the resolution now so from the original resolution really the only thing that changed was it added the last two lines onto the the resolution which would be a new 41b a bill shall not be placed on a committee agenda until the second calendar day following the initial filing of the bill so the original resolution struck the two-day rule the two-day calendar we've discussed this before where when a bill is filed or when it comes out of committee it has to wait on the house calendar for two days before it can be heard on the house floor as we've discussed before we I think actually the last time we we talked about this was the day that we suspended that rule for the remainder of the session in the last four regular sessions since this rule was originally adopted we've suspended it every single session so the as soon as the session got busy so it didn't make a lot of sense to continue with a two-day calendar rule however upon further discussion it seemed as if there was a lot of support for putting a an additional time restriction before it got to committee not after it came out of committee so that's what the amendment that we just adopted to the resolution does is if a bill is filed on let's say for instance it would go to a Wednesday committee instead of filing it by four o'clock on Tuesday and getting it heard the next morning in committee this would step it back one full calendar day to where it have to be filed by monday in order to be on the wednesday's committee agenda allows the public a little bit more time in order to see what's on there as well as members to know what what's going to be coming before their committee so adding that second calendar day separation in there i think that explains the entire resolution now as amended i'd be more than happy to answer any questions

thank you madam chair giving everybody a second to take a take a look it's a short resolution so I just want to make sure everybody's read it and anybody that wants to get irritated at me has the chance to do so because I know this is probably not a very popular thing to talk about in this committee what house resolution 1074 seeks to do is change the way that the rules committee is selected and i want to start this off by saying please please remove yourselves from this equation because this has nothing to do with any member of this committee or how this committee conducts itself it it truly doesn't i love everybody on this committee most of you have been seatmates of mine or um currently are um but when i'm looking at processes and rules in in my head I think it's important to remove yourself from the equation because it's not about us as individuals. It's about the process that the House has as a whole. And the way that the House Rules Committee is selected right now, having been selected by the Speaker, I think is a conflict because the House Rules Committee also rules on the Speaker's decisions. so when the committee is chosen by the person on which they are making rulings it looks like a conflict I've I've this has again nothing to do personally I mean I've had a couple bills that have come through and have passed this isn't some vendetta or anything like that but this is my third term here and this is just one of those issues that's always kind of nagged in the back of my head because even if everybody on this committee makes their own individual complete decision the perception outside of the committee is not that way simply because of the way it's selected there's an assumption that's made and I don't I don't think it does you guys any good I don't think it does the house of representatives any good and I just think that the process should be that the members of this particular committee this one in particular because it has the sole ability to make rulings on decisions made by the speaker i think that they need to be representative of the representatives chosen that way now if we end up adopting this and every single one of you gets put right back on this committee i will be smiling it has nothing to do with you individually it's the process so um that's that's basically what i'm going for here uh what the bill says is uh it changes the number of the house rules committee from 15 to 16 and with four of each coming from each congressional caucus which is similar to to what you have right now but it's it's the selection of it it's it's who controls the selection that truly changes in this um and that's that's the bill uh or the resolution and the speaker would choose the chair and the vice chair from from those uh 16 folks so it would stay approximately the same size as it is now but you would come from the congressional caucus versus speaker selection and i'll be happy to take
