for Tobacco Control. Madam Chair, members of the committee, thank you very much for having an extra meeting for us. I appreciate that. As Representative Davis said, this is just simply a cleanup bill. The vast majority of this bill is that it's removal of old, outdated language or repetitive language. It simplifies places where the wording was unnecessarily complicated. It takes in and does add the addition of some language that was left out in our 2015 vapor bill. And then it moves certain provisions from one section to another where it would be more easily read and understood. outside of that there is a 30-day transition period that is currently available to retailers to renew their permit when a store is sold from one to another we've found this to be troublesome over the past three or four years we've had 27 incidences where retailer a sold a store to retailer B and had fines and suspensions that were owed on his store. So retailer B was unaware and started out basically from day one not being able to sell tobacco because state law says we may not issue a permit until the fines and suspensions are paid and served. We just feel like this by making the retailer show up and get his permit from day one, this is a much cleaner deal and actually helps the new retailer not to be stuck with the old retailer's fines and suspension. It also removes the ambiguity of who owns the store and when. We had a situation earlier this year where retailer A sold to retailer B. Retailer B incurred a fine or a failure to purchase from a licensed wholesaler, and by the time we caught that and fined it, he had sold to retailer C. So there was nobody then to make the state whole. Final thing it does is it restructures some permits. Currently if you're a tobacco wholesaler and a cigarette wholesaler you pay two separate $500 permits. We're going to streamline it where you just pay one $1,000 permit. We're also flipping for smaller retailers or vapor only stores they'll pay a lesser amount and retailers that sell every item will pay the same amount that the vapor stores were that's it and I'll take any questions I guess at this time members are there any questions madam chair for

I've also had DF&A review it and although they haven't had time yet to crank out the fiscal impact, they see no problems. They expect the fiscal impact to be zero. That's

begin thank you madam chair I'm Michael Keck government relations director with the American Cancer Society's Cancer Action Network I appreciate the effort that's been put into this bill and the desire to clean up some of the language eliminate the duplication I do think there are some major policy issues that are brought forward with this that i want to make sure this committee and others are aware of uh that by this bill moving forward you're you're calling for some rather significant change certainly the timing of this is a little bit problematic 53 pages of uh of tobacco related language as i told someone earlier i don't speak tobacco others are fluent in it and fully understand and have a better understanding and I do of how the laws all mesh together. I do not, but I appreciate the willingness of Mr. Good to make time available to answer some of my questions. He's done a good job of that. I do think some of this could be handled in rules and regs, but there are some policy components of this that are being brought forward to you. Act 1235, that was passed in 2015, does require e-cig and vape shops to have an area that calls for a requirement of cleanliness and basically some workplace safety issues that need to be a part of their work, their workspace. This bill removes that. In addition, there is a section that removes all of the child safety, childproofing requirements. Now, yes, there is a federal law and components of FDA regulation that call for that, but I think it's important for our state law to be consistent to make sure that that is enforced and available. With reports continuing to come out about the uncertainty of the health and safety consequences of utilizing e-cigarettes and vape products, I think adhering to those standards is the bare minimum that we can do. Again, I understand the effort and have no problem at all with the desire for consistency and language for there to be a reduction in duplication, but for this to come forward at this late moment without a legal review and an economic impact from DF&A and for the Attorney General's Office to have had the opportunity to look at it from a tobacco settlement perspective, but maybe not other aspects of this, I would like to ask that this slow down. For that which can be dealt with through the rules and regulatory process, I would ask that that be done. and for these major policy issues to be studied and reviewed and if there's a plan to move forward with it an alternative to get these things done we would welcome that rather than simply having those canceled and and left
