you're recognized thank you mr speaker so this bill is kind of a second piece to the bill that i that we ran on the house floor this morning or this afternoon about non-emergency transportation So what happened, what else happened with the non-emergency transportation? Apparently, I guess a rule kind of snuck through ALC, or to me it's kind of snuck through ALC in the broader rule changes that said that non-emergency transportation through the NET providers did not have to be or would not be used for the early intervention day treatment centers moving forward.
So it's my understanding that a lawsuit was filed, and DHS decided at the last minute to issue emergency procurement to get these net services available using the same brokers that they had used for this developmentally disabled population. And so we probably had roughly a month of, if not a little more, of disturbed, actually probably about six weeks of disturbed services for everyone. So this would be like I have a friend who has a 30-year-old autistic son who traveled about 30 miles each day, and he went over to a center in Stone County, and it made his
day. He got to go and work and be productive and they produce things just like we have now a store at DHS that sells the goods that these people make. So it was just completely disruptive to their lives. So what I'm doing with this bill is essentially saying that the Department of Human Services shall provide or offer coverage of non-emergency transportation services for individuals receiving the daily DD services that may include adult developmental day treatment or early intervention day treatment.
So I've talked with DHS, and it's my understanding they were looking at an amendment, and now they have decided that this language does work for them. So I have had no opposition to

Okay. All right. House Bill 1949. So I'm running this for Representative Vaught. She, Representative Gassaway and myself, kind of been working on this all session, trying to figure out exactly what to do. So Representative Gassaway contacted me back in the summer, and I actually drove up to his district in Paragould, And we met with a couple of ladies, one whose daughter had committed suicide and one whose, I believe it was her brother who had committed suicide.
And we were, we spent probably almost three hours talking with him, going over all the issues that were involved from the time of diagnosis of the behavioral health issues through all of their, you know, their inpatient stays, their outpatient stays, all the issues with the hospital, with the facilities. what we could have done, what we could do differently, the funding. So I say all that to say, Representative Gassaway, we were trying to figure out what could we do to help this population to try and ensure that we have more services
and that we have the services that we need for the state. And what we realized was this problem is too big for us to solve in a legislative session. So we didn't want to form a task force. So Representative Gassaway is the chair of JPR, and what he wanted to do was essentially create a legislative study on mental health and have it run through JPR. It would meet to conduct this. It shall meet at least once every two months. The purpose of the study is to assess the strengths and weaknesses of mental health resources in the state
and recommend legislation to the General Assembly regarding best practices and improvements for the 2021 regular session. And it just kind of tells what the review would cover existing health care facilities in the state, Medicaid programs. So it's fairly straightforward. We tried to keep it as minimal cost as possible while essentially trying to come up with a solution that we could possibly present next session. Any questions from committee?

deals with the independent assessments, which was the biggest piece of contention, I think, both between him and some of the committee members. So what we're saying is in that independent audit that the facilities would not be responsible for the cost of that, but the department would be responsible. So DHS would then be responsible for that. on the occasion that they decided they needed it, it would be at the department's cost. Also, one other thing that he mentioned in that email was the penalties, and I think he testified
to that. So I did pull up the long-term care manual. I compared the penalties, and I felt that the penalties I had in the original bill were excessive. So I matched that to the penalty in the long-term care manual for nursing facilities, and so we took that from $5,000 down to $500, and I took out the daily penalty. So it now matches the long-term care manual penalty. So with that, I think hopefully I've made most of the changes that were requested at the last meeting.

So, colleagues, when I get done with this bill in committee, I heard from folks that when I added the allowance of prepared foods, what I was trying to do was to help our little small stores, our convenience stores, to be able to sell biscuits in the morning instead of a Coke and a candy bar. But in trying to do that, maybe add rotisserie chicken, I've opened the door for McDonald's and those kind of things. So hearing from folks that would have voted for the bill on the floor without that or removed that part there, trying to help those folks, I guess I added some confusion.
I also took out the candy part because there was some confusion from vendors here where they would allow a Twix bar but not allow a Snickers. So we took out candy completely. this before, so I won't reiterate it, but I'm going to read some things from you in an article, well, and some things that came up from the American Academy of Pediatrics, some other folks, so I won't have you take all the words of this from me. From the American Academy of Pediatrics and the American Health Association, they agree that they, in their offices, try to encourage patients not to drink sugar-sweetened beverages and soda because it's a leading source of added sugars in our American diet.
But they also say, along with that, that we need to have some policies on the state level to help with the consumption of sugary beverages. They said excess sugar consumption contributes to childhood and adolescent obesity, dental decay, cardiovascular disease, hypertension, dyslipidemia, insulin resistance, type 2 diabetes, mellitus, fatty liver disease, and all-cause mortality. They said the Federal Nutrition Assistance Program should ensure access to healthy food and beverages and discourage consumption of sugary drinks.
And that's from the American Academy of Pediatrics and
the American Health Association. On the other end of the spectrum with the geriatrics, the American Geriatric Society says that over a nine-year period, people who drank diet soda gained almost three times as much belly fat as those who don't drink diet soda. Researchers have theorized that the consumption of artificial sweetness leads to more sugar cravings and therefore causes people to eat more calories than they normally would. Drinking soda causes your blood sugar to spike and it sends your pancreas into overdrive,
producing insulin to metabolize all that sugar. So it's no surprise that from the American Heart Association Journal, circulation found that consuming sugary sweetened beverages like soda was linked to the onset of type 2 diabetes as a correlation between obesity impact and developing type 2 diabetes. So in the state of Arkansas, in the ages of 15 to 19-year-olds, we have a 50% higher rate of diabetes than the national average. That's why over and over I've been trying to tell you guys that we need to improve the health of our state, and I think this is something that will definitely cause that to happen.
Arkansas Packers agree with this and repeated surveys show that 70% of Arkansans agree with this bill. I would like to see it. It's just common sense to make sure that our tax dollars not being spent on something that has absolutely no nutritional value, leads to poor health, and then increase our health care costs, health care costs across the state. I mean we're very aware of that with SB 99 that we're at eight billion dollars now with Medicaid and at some point we've got to make some difference. Officer. This bill is currently we have 35 illegal dump control officers in the state of Arkansas
employed by the solid waste districts. What this bill does is it changes the program to an environmental officer program and it opens it up to all the municipalities and counties of the state. So we could potentially have 500 environmental officers licensed by the state of Arkansas to do legal dumps control, check on tire programs, evaluate tire dumps, et cetera.
This program will be administered by the Southern Arkansas Tech Environmental Academy. We will have one citation book that will allow and will be developed between adq and the attorney general's office it'll be useful for all of the recipients of the education program they'll be able to write citations across the state currently if you are an IDCO in a solid waste district that has
more than one county you must go to each county and get the district attorney in the county the district judge to approve the citation this streamlines all of that, and there's no cost to this program, extra cost to this program, and it's completely voluntary. I had
